ORDINANCE NO. 760 AN ORDINANCE DETERMINING THAT CERTAIN ACTIONS HAVE HERETOFORE BEEN TAKEN IN CONNECTION WITH THE IMPROVEMENT OF NORTH 7TH STREET, AND SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF LA PORTE, TEXAS, WITHIN THE LIMITS HEREINBELOW IDENTIFIED; 'ACCEPTING THE BID OF, AND AWARDING THE CONTRACT TO, GULF BITULITHIC COMPANY, A DIVISION OF WARREN BROTHERS COMPANY, FOR THE. CONSTRUCTION 'OF SAID IMPROVEMENTS; APPROPRIATING AVAILABLE FUNDS OF THE CITY OF LA PORTE, TEXAS, TO PAY.THE CITY'S SHARE OF THE COSTS OF SAID IMPROVEMENTS UNDER SAID CONTRACT; APPROVING THE ,CONTRACT AND AUTHORIZING THE EXECUTION ~HEREOF ON BEHALF OF THE CITY; APPROVING AND ACCEPTING THE PERFORMANCE BOND AND PAYMENT BOND, HERETOFORE EXECUTED BY SAID GULF BITULITHIC COMPANY 'AND ITS SURETY IN CONNECTION WITH SAID CONTRACT; DIRECTING THE 'CITY ENGINEER AND DIRECTOR, DEPARTMENT OF PUBLIC WORKS, TO PREPARE AND FILE WITH THE CITY COMMISSION CERTAIN ESTIMATES OF THE COSTS OF SAID IMPROVEMENTS', AND OTHER PERTINENT INFORMATION IN CONNECTION THEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. The City Commission of the City of La Porte, Texas, hereby finds and determines: (a) That by Ordinances No. 749 and 750, both duly enacted on the 7th day of June, 1966, the City Commission did determine the necessity for and ordered the improvement of North 7th Street, and sundry other streets and avenues in the City of La Porte, Texas, within the limits defined and as described in said Ordinances, and did, among other things, by said Ordinances approve certain plans and specifications' for such improvements and ordered that advertisement be made for competitive bids for the construction of such improvements; and (b) That pursuant to said Ordinances advertisement for bids ,for the construction of said improvements was published and , had in full compliance with all requirements of the law, the Charter of the City of La Porte, Texas, and of said Ordinances and upon the date and at the time in such advertisement stated, bids were ,received and opened, whereupon the bid of Gulf Bitulithic Company, a division of Warren Brothers Company, in the amount of Eight Hundred Fifty-one' Thousand Two Hundred Fifty Dollars ($851,2,50.00) for the construction of said improvements was received and found to be the lowest responsible bid for said work and improve- ments and such bid was accepted; and (c) That thereafter the City Engineer and Director, Department of Public Works, did prepare and file with, the City Commission an estimate 'of the portion of the costs o~ said improvements to be paid by the City of La Porte, Texas, such estimated costs to be paid by the City of La Porte, Texas, bei~g the sum of Three Hundred Ninety Thousand Dollars ($390,000.00); and it is hereby found and determined that there are current funds on hand in the Treasury of said City of La Porte, Texas, sufficient to cover said costs to the City of La Po-te, Texas, and available for such use and that same has been so certified by the Director of Finance of said City; and '.. . . -2- . (d) That pursuant to its said bid, Gulf Bitulithic Company has executed a contract, ,and it and a good, sufficient and lawful corporate surety have executed a performance bond and a payment bond, 'which contract and bonds were prepared and approved by the City Attorney and are in full compliance with the specifications, the law and the Charter of the City of La Porte, Texas, and all of which'have been submitted to the City Commission for its approval, execution and acceptance on behalf of the City of La Porte, Texas. Section 2. The City Commission of the City of La Porte, Texas, has, and does hereby accept the bid of Gulf Bitulithic Company, a division of Warren Brothers Company, for the construc- t~on of said improvements in the sum of E~ght Hundred Fifty-one Thousand Two Hundred Fifty Dollars ($851,250.00), ,and the contract e for the construction of such improvements is hereby awarded to said Gulf Bitulithic Company. Section 3. Said Gulf Bitulithic Company havi~g already, as aforesaid, submitted to the City Commission for its approval and acceptance an appropriate contract, performance bond and payment bond, all prepared and approved by the City Attorney, such contract and such bonds are hereby approved and accepted and are hereby found and declared to be in full compliance with all requirements of the law, the Charter of the City of La Porte, Texas, the specifiGations and bid for said improvements and the e surety on said bonds is hereby accepted and approved; and the Mayor of the City of La'Porte, Texas, is herepy authorized and directed to execute said contract for and on behalf of the City of La Porte, Texas~ and the City Clerk of said City is hereby authorized and directed to attest the same with the City's seal; and the Mayor of the City of La Porte, Texas, is hereby authorized and directed on behalf of said City to accept and approve said performancef bond and payment bond in connection with said construc- I . tion contrai::t. i: Siection 4. The estimated amount of the costs of said r improvement!s to be paid by the 'City of La Porte, Texas, under the abovementio:ned contract is hereby found and determined to be the sum of Three Hundred Ninety Thousand Dollars ($390,000.00), and . . . -3- there is hereby appropriated out of the Construction Fund of the City of La Porte, Texas, the sum of Three Hundred Ninety Thousand Dollars ($390,OOO.OO), ~hich sum has been certified by the Director of Finance of said City to be unencumbered and available funds for such purpose, to pay the City of La Porte's share of the costs of said impro~ements, or so much thereof as may be necessary to pay and discha!ge the obl~gations of the City of La Porte, Texas, under said contract. -Section 5.
