I apologize for taking so long to answer your inquiry.
I have enclosed a copy of all ordinances for the City of
La Porte concerning "Railroads", and the City ordinance
concerning vehicular speed limits. Our Police. Chief tells
me the intersection of the 1100 block of Barbours Cut Blvd.
is at State Highway 146, therefore the speed limit is set
by the State of Texas.

Your letter of June 24, 1977 was received in my
office today with reference to train blocking Spencer Highway
crossing and furnishing copy of City of LaPorte Ordinance X973,
requesting answer to questions in Section 20-8, paragraph (b).
Sec. 20-8. Report of obstructed croasin~s.
(1) Southern Pacific switch train was operated at
about 2:00 PM, June 24, 1977 on Spencer Highway
crossing.
(2) SP engine 3764.
(3) Southern Pacific Transportation Company.
(4) Conductor S. J. Cansler.
As explanation, a switch crew moved in a generally
southern direction with engine leading pulling a cut of cars
that required switching and placed in groups for the various
plants in that general area. Movement stopped and a total
of three switches were made assembling the cars. The cars
then were moved generally north clearing the crossing.

The crew members did not record the actual minutes
the crossing was occupied by the movement, but stated it took
very few minutes.
This has been called to the attention of all train
crew members working in that general area and their assurance
obtained that crossings in the City of LaPorte will not be
occupied any longer than is absolutely necessary by our train
movements.

Dear Mr. Patterson:
Please be advised that the City Commission of
the City of La Porte passed Ordinance No. 973,
a certified copy of which is enclosed herewith,
at its regular meeting on December 3, 1973, said
ordinance prohibits the obstructing of railroad
street crossings for more than five minutes at
one time.
This Ordinance will be published in the La Porte
newspaper on December 6 and December 13, and will
have an effective date of December 17, 1973.

In the morning of 5-30-73 Mr. James Kennedy, Job Foreman
for the Southern Pacific Co. project came to my office
to request water services for his project. At that time
I advised this man that the City felt this was an illegal
operation and we would not be a part of it. I told him
that the City could not provide water to his project.
THis statement was given to him upon the advice received
the previous day from Knox Askins, City Attorney. During
this discussion Mr. Kennedy, the Job Foreman, did inform
me that they were in the process of pumping the pit dry
in order to use dirt on the project.
I was contacted by Mayor Thomas later this morning(5-30-73)
after he had talked with City Attorney Knox Askins and he
advised me that if any dirt was removed from this pit to
send Mr. Dan Kennedy, City Inspector out to stop them and
if the company refused to stop then send a police car out
and have the foreman arrested, brought in and given a chance
to post bond.
At 2:30 p.m. 5-30-?3, I received a call from Knox Askins
requesting that picl~ures be taken by our Police Department
on the progress of the Southern Pacific project now under
construction. I contacted Chief Freeman and requested that
Sgt. James LaFitte be allowed to take pictures and inform me
as soon as possible. Upon Sgt. LaFitte taking pictures of
the project the Chief of Police reported back to me that
Sgt. LaFitte had advised him that Dahlstom Corp. was removing
dirt from the pit. I then contacted Dan Kennedy,City Inspector,
and advised him to go out and request that such operation
cease as it was in violation of our Sand Pit Ordinance No.
945. At approximately 4:25 p.m. Mr. Kennedy radioed me
in City Hall and advised that the company refused to cease
their operation. I advised him to stand by until I could send
a police car out to the site. I then contacted Police Chief
Freeman and he sent a car out to take care of the situation.

regulating gravel pits, sand pits, stone quarries, rock quarries,
and earth excavation pits within the City of La Porte. It is my
understanding that Mr. Dan Kennedy,, Building Inspector for the
City of La Porte, has previous~.y,furnished you with a certified
copy of this ordinance.'
The activities of your corporation on the above referenced
property appear to be in violation of the terms and provisions
of this ordinance, and you•have been so~advised. I understand
that you have advised the City of La Porte representatives that
you have sought the advice of your attorney as to the applica-
tion of this ordinance to. your present activities on the above-
referenced property, and that your attorneys have advised you
that your activities'a're not in violation of this ordinance.
We would appreciate receiving a letter from your attorneys,
stating the reasons for their opinion that your activates on
the above referenced property axe not in violation of the ordi-
nance. We would appreciate you giving your immediate attention
to this request.
A copy of this letter is being furnished to the owner of the
subject property, as shown by the latest tax rolls of the City
