ORDINANCE NO. 761 AN ORDINANCE CALLING AN ELECTION IN THE CITY OF LA PORTE ON THZ QUESTION O~ WHETHER TEE CITY SHALL ENTER INTO A COOPERATION AGREE- MENT WITH THE CITY'S PUBLIC HOUSING AUTHORITY; DESIGNATING AN ELECTION PRECINCT AND A POLLING PLACE; PROVIDING FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING FOR RETURN &~D CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FO~l OF PROPOSITION ON BALLOT; DECLARING LAW APPLICABLE TO SAID ELECTION; PROVIDING A SAVINGS CLAUSE; AND PROVIDING l~ EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COlfMISSION OF THE CITY OF LA PORTE, TEXAS, THAT: e Section 1. The City Commission of the City of La Porte hereby determines on its own motion that an election shall be held within the corporate limits of the City of La Porte, Texas, on the 1st day of April, 1967, between seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M., on the question of whether or not the City Commission of the City of La Porte shall enter into a cooperation agreement with the City of La Porte Public Housing Authority. Section 2. The City Commission of the City of La Porte hereby designates and establishes all of the area encompassed within the corporate limits of the City of La Porte, as one e election precinct for this election, and the City Hall of the City of La Porte is designated as the one polling place for such election. Voting machines shall be used in the conduct of such election. Section 3. Mrs. H. M. RaLston is hereby appointed Presiding Judge of said election, and Mrs. Otis Harrison is hereby appointed Alternate Presiding Judge of said election. The maximum number of clerks which may be appointed to serve at said election is three (3), who shall be selected by t~e Presiding Judge or the Alternate Presiding Judge, e as the case may be. section 4. Absentee voting by personal ap~earance shall begin on the 20th day and shall continue through the 4th day e . . -2- preceding the day of the election. Absentee voting shall be conducted by the City Clerk at the sane place as provided in Section 2 hereof. Voting machines shall be used for the casting of absentee votes at such election. The City Clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the Clerk's office, or at any time when the Clerk's office is not open to the public. The City Clerk of the City of La Porte is hereby authorized and directed to appoint deputy absentee balloting clerks, as necessary. Section 5. Immediately after the close of the polls on ~. the 1st day of April, 1967, the election officials shall make due return thereof to the City Commission of the City of La Porte, and the City Commission shall canvass said returns at the earliest practicable time, and shall, immediately after canvassing the returns, declare the results of the election. Section 6. Notice of said election shall be given by publication in the La Porte-Bayshore Sun, not less than thirty (30) days prior to the date of the said election, of the following notice: CITY OF LA PORTE NOTICE OF ELECTION e Notice is hereby given that an election will be held in the City of La Porte, Texas, on the 1st day of A?ril, 1967, for the purpose of detennining whether or not the City Commission of the City of La Porte shall enter into a cooperation agreement with the City of La Porte Housing Authority, in accordance with the Texas Housing Cooperation Law [codified as Article 1269 (l),Vernon's Annotated Texas Statutes]; that said election shall be held at the City Hall in said City between seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M. on said date, and the following named persons are the appointed officials of said election, to-wit: Presiding Ju~ge Mrs.. H. M. Ralston Alternate Presiding Judge Mr~. Otis Harrison e Absentee voting by personal appearance shall begin on the 20th day and shall continue through the 4th day preced- ing the day of the election and shall be conducted at the City Hall of the City of La Porte, between the hours of nine o'clock (9:00) A.M. and five o'clock (5:00) P.M., except on Saturdays, Sundays, and legal holidays. Section 7. The City Clerk is her~by authorized and directed to give notice of said election in accordance with Section 6 hereof. Section 8. The propositions on the ballot at said election shall be worded as follows, to-wit: "FOR THE CITY COMMISSION OF THE CITY OF LA PORTE ENTERING INTO A COOPERATION AGREEMENT WITH THE CITY OF LA PORTE PUBLIC HOUSING AUTHORITylI IIAGAINST THE CITY COMMISSION OF THE CITY OF LA PORTE ENTERING INTO A COOPERATION AGREEMENT WITH THE CITY OF LA PORTE PUBLIC HOUSING AUTHORITY" Section 9. Said election shall be held in accordance with the provisions of the law pertaining to elections for the issuance of city and county bonds as contained in Chapters 1 and 2, Title 22, Revised Civil Statutes, 1925, insofar as applicable to and not inconsistent with the provisions of Section 7-a, Article 1269(1), Vernon's Annotated Texas Statutes. Section 10. Each and every provision, paragraph, sentence and clause of this Ordinance has been separately con- sidered and passed by the City Commission of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision, and if any provision hereof shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the valid portion shall be in force just as if it has been passed alone. Section 11. This Ordinance shall be in effect immediately upon its pass~ge and approval.
