ORDINANCE NO. /,77 AN ORDINANCE AUTHORIZING AND DIRECTING GULF BITULITHIC COMPANY TO PROCEED WITH AND CONSTRUCT THE IMPROVEMENTS UPON CERTAIN STREETS OR UNITS, WITHIN THE -LIMITS HEREIN REFERRED TO, COMPLETE WITHOUT ANY OMISSIONS IN ACCORDANCE WITH A CERTAIN- CONTRACT HERETOFORE AW.ARDED; ASSUMING AND AGREEING- TO PAY TO GULF BITULITHIC COMPANY THE AMOUNT OF CERTAIN ASSESSMENTS LEVIED AGAINST CERTAIN OWNERS AND THEIR PROPERTIES ABUTTING UPON SAID STREETS OR UNITS; MAKING APPROPRIATION OF AVAILABLE FUNDS FOR THE FOREGOING PURPOSEj TAKING OTHER ACTIONS AND MAKING FINDINGS RELAT.t!AD TO THE FOREGOING; AND PROVIDING FOR THE. EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS: , . Section 1. The City Commission of the City of La Porte, Texas, hereby finds and determines: (a) That the City of La Porte has heretofore executed a coritract with Gulf Bitulithic Company, a division of 'Warren Brothers Company, as authorized by Ordinance No. 760 enacted March 6, 1967, for the improvement of certain Streets or Units in said City within the limits and as identified in Ordinances Nos. 71;.9 and 750-, both heretofore enacted on June 7, 1966, which contract provides, among other things, that said Contractor shall not be obligated to make said improvements in the portion of said Streets in frontof any property against which valid assessment liens cannot be levied unless the owners of such property shall satis- factorily secure to the Contractor the payment of the amount of the costs of improving said Streets assessed against them and their properties; and (b) That said Contractor has heretofore duly notified the City of La Porte of the exempt properties abutting upon said Streets or Units, the owners of which have failed or refUsed to satisfactorily secure the pay- ment to Contractor of the portion of the costs of im- proving said Streets or Units assessed against them and their resn~ctive properties and that Contractor has det- ermined to leave out or skip said improvements in front of such properties unless the City of La .Porte assumes and agrees to pay to Contractor the amounts of the assessments levied against said owners and their res- pective properties in accordance with the terms of the above mentioned contract; and (c) That the omission~of said improvements in front of such of said properties hereinbelow set out and iden- tified in Section2 hereof will create serious traffic hazards and that the Streets or Units upon which said pro- perties abut, as hereinbelow named and identified in '; e . '. connection with such properties in Section 2 hereof, should be improved complete without any omissions or skips and that the City of La Porte should authorize and'direct said Contractor to construct said improve- ments in front of said properties identified below in Section 2 hereof, so that the Streets or Units upon which they abut will be improved complete without any omissions, and that inconsideration therefor, said City should assume and agree to pay the Contractor for the amounts of the assessments against said properties as herein- below set out in Section 2 hereof, upon the transfer and assignment without recourse by the Contractor to the City of said assessments and the paving certificates evidencing same upon completion of said improvements, and further should appropriate a sufficient amount of the Cityts available funds for that purpose. Section 2. That said Contractor, Gu]f Bitulithic Company, is hereby authorized and directed to proceed with and construct the improvements provided for by the above identified contract upon such of said Streets and Units as are hreinbelow named and identified in the schedule contained in this Section 2, complete, and in front of the properties above mentioned and as hereinafter described in this Section 2, so that said Streets and Units so identified shall be so improved without any omissions or skips, and in consideration therefor the City of La Porte hereby assumes and agrees to pay to the Contractor the amounts of the assessments against said properties, such amounts, the names and tit Unit- numbers of said Streets, the names of said owners and the description of said properties, and the Item Numbers of such . assessments as same appear upon the assessment rolls, being as follows, to-wit: ~ ..". eo _ '.... ~ .~"". , .--.....- ~. . - 2 - I'.. The amounts of said above listed assessments, totaling $15,880.23, shall be paid by the City to said Contractor con- temporaneously with the payment of the final estimate due to said Contractor on each of said respective Streets or Units in accordance with the terms of the above mentioned contract, and upon the delivery to said City by the Contractor of a proper assignment, without recourse, tO$id City of said assessments and the certificates evidencing same, in accordance with the terms of said contract. Section 3. That the sum of $15,880.23, being the 4It total of the assessments hereinabove provided to be paid to said Contractor, and which sum has been certified by the Director of Finance of the City of La Porte to be unencumbered and available funds for the purpose herein mentioned, 1s hereby appropriated out of the'City of La Porte Construction Fund for the purpose of paying the total amount of said assessments to said Contractor as hereinabove provided.
