<br />e <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. 780- Low' <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE <br />ZONING ORDINANCE, PASSED AND APPROVED ON FEBRUARY 5, 1968; PRO- <br />VIDING THAT INDUSTRIAL SOLID WASTE MANAGEMENT SITES ARE A USE <br />WHICH SHALL NOT BE PERMITTED WITHIN THE CITY OF LA PORTE; PRO- <br />VIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE <br />SHALL BE GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF <br />SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS <br />($ 200.00); FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PRO- <br />VIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />e <br /> <br />Section 1. Ordinance No. 780 of the City of La Porte, is <br />hereby amended to include Section 13-501a, as follows, to-wi t: <br /> <br />"13-501a Prohibited uses: The following uses <br />shall be prohibited within the City: <br /> <br />(1) Industrial solid waste disposal management <br />sites." <br /> <br />Section 2. The City Council officially finds, determines, <br /> <br />reci tes and declares that a sufficient written notice of the <br /> <br />date, hour, place and subject of this meeting of the City Council <br />was posted' at a place convenient to the public at the City Hall <br />of the City for the time required by law preceding this meeting, <br /> <br />:.a <br />..., <br /> <br />as required by the Open Meetings Law, Article 6252-17, Texas <br /> <br />Revised Civil Statutes Annotated; and that this meeting has been <br /> <br />open to the public as required by law at all times during which <br /> <br />this ordinance and the ~ubject matter thereof has been discussed, <br /> <br />considered and formally acted upon. <br /> <br />The City Council further <br /> <br />ratifies, approves and confirms such written notice and the <br /> <br />contents and posting thereof. <br /> <br />Section 3. Any person, as defined in Section 1.07(27), Texas <br />Penal Code, who shall violate any provision of this ordinance, <br />shall be d~emed guilty of a misdemeanor and upon conviction <br /> <br />shall be punished by a fine not to exceed Two Hundred Dollars <br /> <br />($200.00). Each day any violation of this ordinance shall con- <br /> <br />tinue shall constitute a separate violation. <br />
