ORDINANCE NO. 780-UUU AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit, on the 28th day of October, 1981, at 7:00 P.M., a joint public hearing, recessed from October 21, 1981, due to a lack of a quorum of ~ the Planning and zoning Commission, was held before the Planning and Zoning Commission, and the City Council, of the City of La porte, Texas, pursuant to due notice, to consider the question of the possible re-classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located wi thin two hundred feet (200') of the properties under ~ consideration. Section 2. The Publisher's Affidavit of publication of notice of said hearing is attached hereto as "Exhibit B," incor- porated by reference herein and made a part hereof for all purposes. Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning' Commission met in special session on October 28, 1981, to consider the changes in classification which were the subject of such joint public hearing. The City Council of the City of La porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Com- mission, by letter dated October 28, 1981, the original of which . letter is attached hereto as "Exhibit C," incorporated by ref- erence herein, and made a part hereof for all purposes. . . ~ Ordinance No. 780-UUU, page 2. Section 4. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the herein- after described parcel of land, situated wi thin the corporate limits of the City of La Porte, is hereby changed in accordance therewi th, and the zoning classification of said parcel of land ~ shall hereafter be "Industrial," and with a special use permit, with use strictly limited to allow a container storage and repair yard. The description of said parcel of land re-zoned is as follows, to-wit: TRACT A That certain 7.7 acre tract of land on State Highway 146, as described by metes and bounds on the plat attached hereto as Exhibit "0", incorporated by reference herein, and made a part hereof for all purposes; TRACT B ~ That certain 8.1869 acre tract of land on State Highway 146, as described by metes and bounds on the plat attached hereto as Exhibit "E", incorporated by reference herein, and made a part hereof for all purposes. Section 5. It shall be a condition of this Special Use permi t that, at all times while the above-described property is used as a container storage and repair yard, that the West five feet (5') of said property be densely planted and continuously maintained as a "green belt" visual screen, using pine trees and shrubbery. Failure to keep and maintain such "green belt" shall cause this Special Use Permit to be subject to revocation by City Council. ~ Section 6.
