ORDINANCE NO. 780-AAAA
AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED1 AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY Tl:IE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte
hereby finds, determines and declares that heretofore, to-wit:
on the 12th day, of May, 1983, at 7:00 P.M., a public hearing
was held before the Planning and Zoning Commission of the City

of La Porte, Texas" pursuant to due notice, to cons ider the
question of the possible re-classification of the zoning classi-
fication of the hereinafter described parcel of land.
There
is attached to this Ordinance as "Exhibit A," and incorporated
by reference herein qnd made a part hereof for all purposes, a
copy of "Notice of Public Hearingli which the Ci ty Council of
the City of La .Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet (200')
of the properties under consideration.
Sec'tion 2. The Publisher's Affidavit of Publication of

notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
Section 3. 'Subsequent to such public hearing, the City
of La Porte Planning and Zoning Commission met in special
session on May l2, 1983, to consider the changes in class i-
fication which were the subject of such public hearing. The
Ci ty Council of" the Ci ty of La Porte is in receipt of the
written recommendations of, the City of La Porte Planning and
Zoning COmmission, by ,letters dated May 16, 1983, the original
of which letter is attached hereto as ~Exhibit C," incorporated

by reference herein, and made a part hereof for all purposes.

Section 4. On the 6th day of July, 1983, at 7:00 P.M., a
publ ic hearing was held before the City Counc il of the City of
La Porte, pursuant to due notice, to consider the question of
the possible re-classification of the zoning classification of
the hereinafter described parcel of land. There is attached to
this Ordinance as Exhibit "D", and incorporated by reference

herein and made a part hereof for all purposes, a copy of
"Notice of Public Hearing" which the City Council of the City
of La Porte hereby finds was properly mailed to the owners of
all properties located wi thin two hundred feet (200') of the
properties under consideration.
Section 5. The Publisher's Affidavit of Publication of
notice of said public hearing before the City Council of the
City of La Porte is attached hereto as "Exhibit E," incorporated
by reference here in and made a part hereof for all purposes.
Section 6. Subsequent to such public hearing, the Ci ty

Council of the City of La Porte reveiwed the written recommenda-
t ions of the Ci ty of La Porte Planning and Zoning Commission,
and all of the evidence presented before it, and the City Council
of the Ci ty of La Porte hereby accepts the recommendation of
the City of La Porte Planning and Zoning Commission, and the
zoning classif ication of the hereinafter described parcel of
land, situated within the corporate limits of the City of
La Porte, is hereby changed in accordance therewi th, and the
zoning classification of said parcel of land shall hereafter be
"District C--Apartment and Commercial District." The descrip-
tion of sa id parce 1 of land re-zoned is as follows, to-wit:

Section 7. The Ci ty Council off icially finds, determines,
recites and declares that. a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated 1 and that this meeting has been
4It open to the public as required by law at all times during which
this ordinance.anQ the subject matter thereof has been discussed,
considered and formally acted upon.
The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 8. This Ordinance shall be in effect from and
after its passage and approval.
PASSED AND: APPROVED this 6th day of July, 1983.

Rezoning. of --Out lots A3,9, 40, -41, 42, La Porte Outlots -
Thomas Nation
On May 12, 1983, Thomas Nation appeared before the Planning
and Zoning Commission requesting that Outlots 38, 39, 40, 41 and
42 of La Porte Outlots be rezoned from Residential to Commercial.
It was the vote of the Commission that pn~ Outlots 39, 40, 41
and 42 be rezoned to Commercial, to conform with surrounding
properties being zoned Commercial only two ('2) utlots deep.

NOTICE OF PUBLIC HEARING
In accordance with the provisions of Ordinance 780, the
Zoning Ordinance of the City of La Porte, a public hearing
will be held on July 6, 1983, at 7:00 P.M., by the La Porte
City Council, to consider rezoning Outlots 38, 39, 40, 41 and
42 of La Porte Outlots, R. Pearsall A-625, from Residential
to Commercial. The purpose of rezoning the property is to
bring it into conformity with adjacent property.
