ORDINANCE NO. 780-BBBB AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY ALLOWING A DUPLEX TO BE LOCATED ON THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED, SAID LAND BEING ZONED R-I RESIDENTIAL: AND PROVIDING AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section I. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, on the 6th day of October, 1983, at 7:00 o'clock P.M., a public hearing was held before the Planning and Zoning Commission of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible reclassification of the zoning classification of the hereinafter described parcel of land. Said possible reclassification, if granted, would permit a duplex to be placed upon the hereinafter described parcel of land, said land be ing zoned R-I . Residential. There is attached to this ordinance as Exhibit "A", and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing", which the City Council of the City of La Porte hereby finds was properly mailed to the. owners of all properties located within two hundred feet (200') of the properties under consideration. Section 2. The Publisher's Affidavit of Publication of notice of said hearing is attached as Exhibit "B", incorporated by reference herein and made a part hereof for all purposes. Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning Commission met in special session on October 6, 1983, to consider the permitting of a duplex within an R-I Residential classification, which were the subject of such public hearing. The City Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte e . Ordinance No. 780- BBBB, Page 2 Planning and Zoning Commission, by letters dated October 7 , 1983, the original of which letter is attached hereto as Exhibit "CD, incorporated by reference herein and made a part hereof for all purposes. Section 4. On the 2nd day of November, 1983, at 7:00 o'clock P.M., public hearing was held before the City Council of the City of La Porte~ Texas, pursuant to due notice, to consider the question of the permitting of a duplex to be located on the herein- after described parcel of land, said land being located on an R-I Residential zoning classification. There is attached to this ordinance as Exhibi t "0", and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing", which the City Council of the City of La Porte hereby finds, was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under considera- tion. Section 5. The Publisher's Affidavit of Publication of notice of said public hearing before the City Council of the City of La Porte is attached hereto as Exhibit "E", incorporated by reference herein and made a part hereof for all purposes. Section 6. Subsequent to such public hearing, the City Council of the City of La Porte reviewed the written recommenda- tions of the City of La Porte Planning and Zoning Commission, and all the evidence presented before it, and the City Council of the City of La Porte hereby accepts the recommendation of the Ci ty of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the corporate limits of the City of La Porte, it is hereby changed in accordance therewi th, and the zon ing ~e . Ordinance No. 780-BBBB Page 3 classification of said parcel of land shall hereinafter be "District R-I-Res idential" . Further, pursuant to Section 13-201 (2), the City Council of the City of La Porte hereby permits the location of a duplex upon said residentially zoned tract, the legal description of said parcel of land rezoned to penni t said duplex is as follows, to-wit: Block 760, Lots 21 and 22, in the CITY OF LA PORTE, Harris County, Texas, also being known as 322 South IS Street, La Porte, Texas. Section 7. The City Council officially finds, determines, reci tes and declares that a sufficient wri tten notice of the date, hour, place and subject of this meeting of the City Council was posted at a plaqe convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated: and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, cons ide red and formally acted upon. The City Council further ratifies, approves. and confirms such written notice and the contents and posting thereof. Section 8.
