HomeMy WebLinkAboutO-1984-780-FFFF . e, ORDINANC.E NO. 780- F F F= J= AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL. OF LAND aEREIN DESCRIBED~ AND PROVIDING AN EFFECTIVE DATE HEREOF. B.E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 6th day of September, 1984, at 7:00 P.M., a public hearing was held before the Planning and Zoning Commission of the City of La Porte, Texas,' pursuant to due notice, to consider the question of the possible re-classification of the zoning classi- fication of the hereinafter described parcel of land. There is attached to this 6rdinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte. hereby finds was properly mailed to the owners of all properties located within two hundred feet (200l) of the properties under consideration. Section 2. The .Publisherls Affidavit of Publication of notice of said hearing is attached hereto as "Exhibit B," incorporated by reference herein, and made a part hereof for all purposes. Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning Commission met in special session on September 6, 1984, to consider the changes in class if- ication which were 'the subject of such public hearing. The Ci ty Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Commission, by letter dated September 7, 1984, the original of which letter is attached hereto as "Exhibit C," incorporated by reference herein, and made a part hereof for all purposes. . . Ordinance No. 780-~, Page 2. Section 4. On the 3rd day of October, 1984, at 7:00 P.M., a,public hearing was held before the City Council of the City of La Porte, pursuant to due notice, to consider the question of the possible re-classification of the zoning classi- fication of the hereinafter described parcel of land. There is attached to this O~dinance as Exhibit "D", and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Section 5. The Publisher's Affidavit of Publication of notice of said public. hearing before the City Council of the City of La Porte is attached hereto as "Exhibit E," incorporated by reference herein and made, a part hereof for all purposes. Section 6. Subsequent to such public hearing, the Ci ty Council of the City of La Porte reveiwed the written recommenda- tions of the City of La Porte Planning and Zoning Commission, and all of the evidence presented before it, and the City Council of the City of La Porte hereby accepts the recommendation of the Ci ty of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the cor~~rate limits of the City of La Porte, is hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "Industrial." The description of said parcel of land re-zoned is as follows, to-wit: Lot Eighteen (18) and Nineteen (19), inclusive Block One (1) of Spenwick Place, Section One (I), an Addition ih La forte, Harris County, Texas. . . The City Council officially finds, determines, reci tes and declares that a sufficient written notice of the date, hour, place. and ~ubject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes 'Annotated~ and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, cons idered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 8. This Ordinance shall-be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. Section 9. ~he City Secretary of the City of La Porte is hereby directed to notify the applicant of the zoning reclassifi- cation that has been approved by the City Council of the City of La Porte and is contained herein. Said notification shall specifically contain th~ following language: TO THE APPLICANT: The application for rezoning you filed with the City of La Porte has been approved. Take notice, however, that the City of La Porte is undergoing a Comprehensive Plan adoption process. This Plan adoption process includes the possibility that the entire City of La Porte, specifically including your property, would be rezoned. The granting .of your application in no way affects this possible comprehensive rezoning effort by the City of La Porte, and you should understand that e . Ordinance No. 780--FFf-F-, Page 4. in order to. insure your input as to the future zoning classification your property might have, you should attend the public hearings that will be scheduled. ':. ....:1 " e . e MEMORANDUM CITY OF LA PORTE TO: Mayor and City Council FROM: Planning and Zoning Commission SUBJECT: Request of James Alexander to rezone Lots 18 and 19, Block 1, of Spenwick Place, Section I from Residential to Commercial DATE: September 7, 1984 Mr. James Alexander met with the Planning and Zoning Commission in public hearing on September 6, 1984, to request the rezoning of Lots 18 and 19 of Spenwick Place, Section I from residential to commercial to allow the development of a commercial rental business. This rezoning would be in line with the other established businesses in the area. The Planning and Zoning Commission recommends that the request be approved as submitted. Section 17-101 of Ordinance No. 780 reads as follows, to-wit: "17-101 Public Hearing Before the City Planning and Zoning Commission. Before taking any action to any trOposed amendment, supplement, change, or modi- ication, the City Commission shall submit the same to the City Planning and Zoning Commission which shall make a preliminary report and hold a public hearing hereon before submitting its final report to the City Commission." This may be accomplished as a joint pUblic hearing before the Planning and Zoning Cpmmission and the City Council, as under our previous practice, or, in the alternative, with a public hearing first before the Planning and Zoning Commission, and another pUblic hearing at a later date~before the City Council, at your election. ' As in the case of changes of zoning classifications, Ordinance No. 780, and also, Article 1011d, Revised Civil Statutes, requires at least fifteen (15) days notice of the time and place of the public hearing be published in the official newspaper of the City of La Porte. Armstrong, Assistant City Attorney CITY OF LA PORTE RE: City of La Porte Ordinance No. 780 Chronological Ad Hoc Zoning Reclassification Process (1) Owner of any affected property files written application, stating existing zoning" requested reclassification, legal description of property, street address (if available), size of tract by dimension and area, accompanied by $100.00 application fee. Application is filed with City Secretary of City of La Porte. (2) Upon receipt of application, City Secretary ascertains whether form of application is proper, and notifies Director of Engineer- ing Department and Zoning Officer (currently the head of the code enforcement division). (3) Director of Eng ineering and Zoning Officer prepare a written report within fifteen. (15) days of receipt of application by city Secretary. Said report should include all information required in the application mentioned above, such as: e . City of La Porte La Porte, Texas Page 2 11/23/82 1. Physical. characteristics of the tract under consider- ation, including drainage~ 2. Natural resources of the tract and surrounding tracts~ 3. Soil type and whether said soil type is conducive to development ~ ' 4. Flood plain elevation~ 5. Impact of proposed rezoning on surrounding areas, including adjacent land uses and collation of proposed use or adjacent uses, adjacent zoning configurations, and effect of change upon said adjacent areas~ 6. Cost benefit of proposed use, including availability of utilities and cost of bringing utilities to said property~ 7. Impact on traffic and roadways~ 8. Added cost of police protection, etc.~ 9. Relation of proposed use to community goals, such as relation of proposed rezoning to comprehensive plan, any particular social, economic, or environmental problems presented by the use~ and 10. Whether the development is equivalent to the highest and best use of sUbject property. (4) Upon initial determination by the ~oning Officer that the proposed use of the subject tract requires zoning reclassification, the City Secretary shall establish the proposed reclassification as an agenda item at a regularly scheduled meeting of the Planning and Zoning Commission of the City of La Porte. It is recommended that the City Secretary consult with the chairperson of the Planning and Zoning Commission to ascertain and resolve scheduling conflicts, if any. Care should be taken to allow sufficient time for the city'staff, to prepare the factual report contemplated above. As indicated, city staff advises that fifteen (15) days is sufficient time within which to complete said report. (5) Planning and Zoning Commission meets, and considers initially proposed zoning reclassification in open meeting, reviewing the staff report contemplated above, requesting any additional needed information, ascertaining any potential legal problems, and setting a date for the public hearing. City of La Porte La Porte, Texas Page 3 11/23/82 take place at a regularly scheduled me,eting of the Planning and Zoning Commission, i.e. on the first or third Thursday of each month at. 7:00 o'clock P.M. in the City Council Chambers, or they may be call~d specially. (6) Notice of public hearing - (Ordinance No. 780, Section 17-102). The City Secretary is charged, with sending written notice to all owners of real property lying within two hundred (200) feet of the property on which the change in classification is proposed, such notice to be given not less than ten (10) days before the date set before the public hearing. Notice is to be given to all owners of property wi thin two hundred (200) feet who have rendered their property for city taxes ,. as the ownership appears on the last approved city tax rendition roll. It is sufficient to send letters postage prepaid, and properly addressed (as said addresses appear on the tax rendition roll) in the regular United States mail. Legal counsel further recommends publication of notice of said public hearing in the La Porte-Bayshore Sun, said notice to appear at least fifteen (15) days prior to the time and place of such hearing. All notices should include: 1. Date of the hearing~ 2. Time of the hearing~ 3. Place of. the hearing~ 4. Purpose of the hearing, including present zoning dis- trict, proposed zoning district, and use to which :applicant plans to put the rezoned property~ and 5. Legal description of the land, general address or description of the location, including size of the tract and area of the tract. (7) Procedure at public hearing: 1. :Call meeting to order, establish a quorum~ 2. Chairperson will re~d the request for rezoning, as well as .'pointing out any information attendant to the request for rezoning, including but not limited to, correspondence received by the commission on the proposed rezoning request~ e e City of La Porte La Porte, Texas Page 4 11/23/82 3. ,The Director of Engineering (or his designated repre- sentative) and the Zoning Officer (or his designated representative) shall present a factual summary relative to the proposed rezoning~. 4. Chairperson shall call on persons wishing to speak as to the proposed rezoning, including: (a) The applicant' or his representative~ (b) Persons in support of the request~ (c) Those persons in opposition to the request~ (d) Opportunity for rebuttal is provided~ and (e) The commission shall ask any further questions of the applicant, his repre- sentative, or others with knowledge of the proposed rezoing. (8) The City Secretary (or ,his designated representative) shall attend all regularly scheduled meetings and public hearings of the Planning and Zoning Commission of the City of La Porte, and record all proceedings thereof. (9) Motion is made by a member of the commission to either recommend rezoning to the City Council, to deny a recommendation of rezoning to the City Council, or to modify the application and recommend the modified rezoning scheme to the City Council. In order to recommend rezoning to the City Council (either as applied for, or as modified by the Planning and Zoning Commission of the City of La Porte), four (4) affirmative votes are necessary. (10) The Planning and Zoning Commission shall submit its decision on the proposed rezoning in writing to the City Council, by trans- mitting same to the City Secretary. Any dissenting votes on the commission shall be recorded in writing and transmitted along with the commissionls decision to the City Council, along with any dissenting written opinions the Planning and Zoning Commission of the City of La Porte may wish to include with its recommendation. (11) The City Council shall schedule a public hearing, subsequent to at least fifteen (15) days notice by publication in the La Porte- Bayshore Sun, said notice to include all the information contem- plated in paragraph (6) above. Said public hearing shall be an open meeting. The public hearing before City Council should follow substantially the same format as the public hearing before the Planning and Zoning Commission of the City of La e e City of La Porte La Porte, Texas Page 5 11/23/82 Porte, except that the recommendation o,f the Planning and Zoning Commission shall be read initially, along with the information regarding the proposed rezoning as provided in paragraph (7) above. The public hearing shall then be closed. (12) Council may vote to either accept the proposed rezoning, reject it, or modify Planning and Zoning Commission's recommendation. Said vote may be taken at a regularly scheduled meeting of the City Council, held on the same night as the public hearing, or a t a subsequent, regularly scheduled meeting of City Council. No rezoning is effective until an ordinance has been passed by Ci ty Council. In the' case of a recommendation of rezoning by the City Planning and Zoning Commission, the City Council may pass the rezoning ordinance by a simple majority. In the case of a recommendation by the Planning and Zoning Commission of the City of La porte against rezoning the subject property, seven (7) council member votes in favor of the proposed rezoning are needed to pass the rezoning ordinance. Regardless of Planning and Zoning Commission's recommendation, in the case of a written protest by twenty per cent (20%), or more, either of the area of the lots or land included in such proposed change, or of the lots or land immediately adjoining the area affected by the proposed change and extending two hundred (200) feet therefrom, seven (7) council member votes in favor of the proposed rezoning ordinance are required in order to pass the proposed rezoning ordinance. (Vernon's Annotated Texas Statutes, Article 1011e(a). (a) It shall be the duty of the City Secretary, in the case of a written protest, to ascertain from the city tax rendition rolls mentioned above, the owners of twenty per cent (20%), or more, either of the area of the lots or land included in such proposed change, or of the lots or land immediately adjoining the land included in the proposed change. (b) The form of protest shall contain the following information, or its substantial equivalent: 1. Name of the protestant; 2. Address of the protestant; 3. General address or description of the location of the land of the protestant, including size of the tract and area of the tract; and 5. Nature of the protest. (c) A written protest may be filed either individually, or in conjunction with other owners of property adjoining the tract that is to be rezoned. (13) If rezoning is approved, the City Engineer shall note the zoning change on the city zoning map. (14) To begin construction of the proposed uses on the rezoned property, the property owner or his designated representative must follow all applicable city codes or ordinances.
