ORDINANCE NO. 780-GGGG AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED: AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PO.RTE: Section 1. The. City 'Councilof the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 30th day of October, 1984, at 7:00 P.M., a public hearing wa~ held before the Planning and Zoning Commission of the City of La Porte, Tex.as, pursuant to due not ice, to cons ider the question of the possible re-classification of the zoning classi- fication of the hereinafter described parcel:, of "land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a cop.y of "Notice of Public Hearing" which the City Council of the City of La Porte hereby f :i;nds was properly mai led to the owners of all properties located within two hundred feet (200') of the propertie~ un~er consideration_ Section 2. The Publisher's Affidavit of Publication of notice of said hearing is attached hereto as "Exhibit B," incorporated by reference herein and made a part hereof for all purposes. Section 3. Subsequent to such public he:aring, the City of La Porte Planning and Zoning Commission met in special session on October 30, 1984, to consider the changes in classi- fication which were" the subject of such public hearing. The City Council of the, City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Commission, by letters dated Novemebr 20, 1984, the original of which letter is attached 'hereto as "Exhibit C," incorporated by reference herein, and made a part hereof for all purposes. . e Ordinance No_ 780-GGGG, Page 2. Section 4. On the 19th day of December 1984, at 7:00 P.M., a public hearing was held before the City Council of the City of La Porte, pursuant to due notice, to consider the question of the possible re-classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as Exhibit "0", and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located wi thin two hundred feet (200') of the properties under consideration. Section 5. The Publisher's Affidavit of Publication of notice of said public hearing before the City Council of the City of La Porte is attached hereto as "Exhibit E," incorporated by reference herein and made a part hereof for all purpo::;es. Section 6. Subsequent to such public hearing, the City Council of the City of La Porte reveiwed the written recommenda- t ions of the City of La Porte Planning and Zoning Commission, and all of the evidence presented before it, and the City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the corporate limits of the City of La Porte, is hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "District I--Industrial" with use strictly limited to marshalling and preparation of new automobiles. The description of said parcel of land re-zoned is as follows, to-wit: That particular 5.019 acre tract of land on the East Side of State Highway 146, at the State Highway 225 inter- section, more particularly described on "Exhibit F", attached hereto and fully incorporated by reference here- in. e. e Ordinance No. 780-GGGG, Page 3. Section 7 _ The City Council off icially finds, determines, recites and declares that a sufficient written notice of the date, hourI place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated~ and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 8. This Ordinance shall be in effect from and after its passage and approval. Section 9. The City Secretary of the City of La Porte is hereby directed to notify the applicant of the zoning reclassifi- cation that has been approved by the City Council of the City of La Porte and is contained herein. Said notification shall specifically contain the following language: TO THE APPLICANT: The application for rezoning you filed with the City of La Porte has been approved. Take notice, however, that the City of La Porte is undergoing a Comprehensive Plan adoption process. This Plan adoption process includes the possibility that the entire City of La Porte, specifically including your property, would be rezoned. 'I e e MEMORANDUM CITY OF LA PORTE TO: Mayor Cline and Councilpersons FROM: Planning and Zoning Commission SUBJECT: Request of Winston DeBlanc to rezone 5.019 acre tract of land on the east side of Highway 146 at the Highway 225 intersection from commercial' to industrial DATE: November 20, ,1984 Mr. Winston DeBlanc met with the Planning and Zoning Commission in public hearing on October 30, 1984, to request the rezoning of a 5.019 acre tract of land on the east side of Highway 146 at the Highway 225 intersection from commercial to industrial to accommodate additional space for new auto storage. This rezoning would be in line with the other established business in the area and in line with the Comprehensive, Master Plan. Being 5.019 acres out of the easterly part of that certain tract of land located in Lot 13, Staashen Subdivision, Enoch Brinson Survey, A-5, Harris County, Texas, as described in Volume I, Page 22 of the Map Records of Harris County, Texas, and by deed to Wm. B.
