ORDINANCE NO. 780-PPPP
AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED: AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte here-
by finds, determines and declares that heretofore, to-wit: on
the 18th day of September, 1986, at 12:00 P.M., a public hearing
was held before the Planning and Zoning Commission of the City
of La Porte, Texas, pursuant to due notice, to consider the
question of the possible re-classification of the zoning classi-
fication of the hereinafter described parcel of land.
There
is attached to this Ordinance as "Exhibit A," and incorporated
by reference herein and made a part hereof for all purposes, a
copy of "Notice of Public Hearing" which the City Council of
the City of La Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet
(2001) of the properties under consideration.
Section 2. The Publisher 1 s Affidavit of Publication of
notice of said' hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session
on September 18, 1986, to consider the changes in classif-
ication which were the subject of such public hearing. The
city Council of the City of La Porte is in receipt of the
written recommendations of the City of La Porte Planning and
zoning Commission, by letter dated October 8, 1986, the original
of which letter is attached hereto as "Exhibit C," incorporated
by reference herein, and made a part hereof for all purposes.

s~ction 4. On the 13th day of October, 1986, at 6: 00
P.M., a public hearing was held before the City Council of the
Ci ty of La porte, pursuant to due notice, to consider the
question of the possible re-classification of the zoning classi-
fication of the hereinafter described parcel of land. There
is attached to this Ordinance as Exhibit "0", and incorporated
by reference herein and made a part hereof for all purposes, a
copy of "Notice of Public Hearing" which the City Council of
the City of La Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet
(200') of the properties under consideration.
Section 5. The Publisher's Affidavit of Publication of
notice of said public hearing before the City Council of the
City of La Porte is attached hereto as "Exhibit E," incorporated
by reference herein and made a part hereof for all purposes.
Section 6. Subsequent to such public hearing, the City
Council of the City of La Porte reveiwed the written recommenda-
tions of the City of La Porte Planning and Zoning Commission,
and all of the evidence presented before it, and the City Council
of the City of La Porte hereby accepts the recommendation of
the City of La Porte Planning and Zoning Commission, and the
zoning classification of the hereinafter described parcel of
land, situated within the corporate limits of the City of
La Porte, is hereby changed in accordance therewith, and the
zoning classification of said parcel of land shall hereafter be
"Industrial." The description of said parcel of land re-zoned
is as follows, to-wit:
Being l2.203 acres (531,560 square feet) of land
situated in the Richard Pearsall 1/3 League, Ab-
stract 625, Harris County, Texas, and being out of
that certain tract of land conveyed to Friendswood
Development Company by instrument recorded in
Volume 6973, Page 503, of the Harris County Deed

Records: said 12.203 acres (531,560 square feet) of
land being more particularly described by metes and
boq.nds as follows (all bearings referenced to the
the Texas Coordinate System, South Central Zone):
COMMENCING at Copperweld Rod 3264 found for the
southwest corner of that certain 2.3l9-acre tract
of land conveyed to Cajun Investment by instrument
recorded under File No. H819145 and Film Code 038-
85-l662 of the Harris County Official Public Re-
cords of Real Property and also being in the north
right-of-way line of Fairmont Parkway, based on 250
250 feet in width:
THENCE S 86 deg. 52'5411 W, 344.81 feet, with the
north right-of-way line of said Fairmont Parkway,
to a 5/8-inch iron rod set for the PLACE OF BEGIN-
NING and being the southeast corner of the herein
described tract of land:
THENCE S 86 deg. 52'5411 W, 1049.86 feet with the
north right-of-way line of said Fairmont Parkway,
to Copperweld Rod 2890 found for the southeast
corner of that certain 6.000-acre tract of land
conveyed to Browning-Ferris Industries Chemical
Services, Inc., by instrument recorded under File
NO. E515336 and Film Code 125-13-0985 of the Harris
County Official Public Records of Real Property and
being the southwest corner of this tract:
THENCE N 03 deg. l5'2911 W, 506.56 feet to Copper-
weld Rod 2889 found for the northeast corner of
said 6.000-acre tract and being the northwest cor-
ner of this tract:
THENCE N 86 deg. 56'2211 E, 105l.09 feet to a 5/8-
inch iron rod set for the northeast corner of this
tract:
THENCE S 03 deg. 07'06I1E, 505.49 feet to the PLACE
OF BEGINNING and containing 12.203-acres (531,560
square feet) of land.
Section 7. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated: and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,

considered and formally acted upon.
The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 8. This Ordinance shall be effective fourteen (14)
days after its passage and approval.
The City Secretary shall
give notice of the passage of this ordinance by causing the
caption hereof to be published in the official newspaper in the
Ci ty of La Porte at least twice wi thin ten (10) days after the
passage of this ordinance.
Section 9. The City Secretary of the City of La Porte is
hereby directed to notify the applicant of the zoning reclassifi-
cation that has been approved by the City Council of the City
of La Porte and is contained herein.
Said notification shall
specifically contain the following language:
TO THE APPLICANT:
The application for rezoning you filed with the
City of La Porte has been approved. Take notice,
however, that the City of La Porte is undergoing
a Comprehensive Plan adoption process. This Plan
adoption process includes the possibility that the
entire City of La Porte, specifically including your
property, would be rezoned.
The granting of your application in no way affects
this possible comprehensive rezoning effort by the
City of La Porte, and you should understand that
in order to insure your input as to the future
zoning classification your property might have,
you should attend the public hearings that will
be scheduled.

NOTICE OF PUBLIC HEARING
In accordance with the provisions of Ordinance 780, the
Zoning Ordinance of the City of La Porte, a public hearing will be
held by the La Porte City Council at 6:00 P.M. on the 13th day of
October, 1986, to consider rezoning a 12.203 acre tract of land
out of the Richard Pearsall Survey, abstract 625, between Pipe and
Valve, Inc., and BFI Industries on West Fairmont Parkway, from
Temporary R-1 to Industrial. The proposed use for the property to
be rezoned is a medical waste disposal site, which will require a
Special Use Permit from the La Porte Zoning Board of Adjustment.
This hearing will be conducted in the Council Chambers of the
La Porte City Hall, 604 West Fairmont Parkway. Letters concerning
this matter should be addressed to the City Secretary, P.O. Box
1115, La Porte, Texas, 77571. Those wishing to address this
matter pro or con during the meeting will be required to sign in
before the meeting is convened.

The City of La Porte Planning and Zoning Commission met at 12:13 P.M.
on September 18, 1986 for the purpose of having a Public Hearing on
the above mentioned property.
After discussion it was the unanimous decision of the Planning and
Zoning Commission to recommend the rezoning of this tract from its
current temporary "R-1" Residential status to an "I" Industrial zoning
classification.

Porte has been approved. Take notice, however, that the City of
La Porte is undergoing a Comprehensive Plan ,adoption process.
This Plan adoption process includes the possibility that the
entire City of La Porte, specifically including your property,
would be rezoned.
The granting of your application in no way affects this
possible comprehensive rezoning effort by the City of La Porte,
and you should understand that in order to insure your input as to
the future zoning classification your property might have, you
should attend the public hearings that will be scheduled.
