AN ORDINANCE PROVIDING FOR THE EXPERIMENTAL' USE OF REFUSE BAGS
IN THAT PORTION OF THE CITY OF LA PORTE SI,TUATED WEST OF BROADWAY
STREET, FROM JUNE 1, 1968 THROUGH AUGUST 31, ,1968; PROVIDING THAT
THE CITY SHALL NOT COLLECT GARBAGE FROM ANY DWELLING UNIT SITUATED
WEST OF BROADWAY ST~ET, DURING SUCH EXPERIMENTAL PERIOD, UNLESS
CONTAINED IN APPROVED REFUSE BAGS; pROVIDING THAT ANY PERSON
VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEME9 'GUILTY ,OF A
MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT
LESS THAN TWENTY-FIVE ($25.00,) DOLLARS NOR MORE THAN TWO HUNDRED
. ($200.00) DOLLARS, AND EACH DAY OF VIOLATION SHALL BE DEEMED A
SEPARATE OFFENSE; ,AND PROVIDING 'A SAVING CLAUSE.
Garba'ge. The term ,"garb~ge" shall be held to mean all
. animal and v~getable matters, such as waste material and refuse
from kitchens,. grocery stores, and res'taurants, includi~g such
items as meat scraps, bread, bones, fruit and v~g'etable peeli!lgs,
and similar wastes.
Trash. The 'b~rm "trash" sha;ll mean rubbish, such as

feathers', . pq.per, ,tin cans, ,r~gs" glass, .broken dishes, boxes, old
clothes and shoes; aiso, grass trimmi~gs, .tree 'leaves',' he~ge 'trim-
mi!lgs and tree limbs not to :ex.ceed three (3) inches in diameter
and cut in le!lgths not exceedi~g four (4) feet.
Premi's'es. The 'word "preniises'" shall be 'taken to mean
business houses, roomi~g houses, .boardi~ghouses, ,offi.ces, theaters,
hotels, motels, inns, restaurants, ,cafes, eati~g houses, trailer
courts, tourist courts, tourist camps, ,apartments, sanitariums,
schools, private residences, vacant lots and all other places
within the city where, garb~ge, trash or rubbish accumulates in
ordinary quantities.'
Hotel, inn, motel" rooming houses and boardinghouses are
defined as a plac~ where the purpose is to furnish food and

Section.. 2. The purpose of this Ordinance -is to provide
for the experimental use of refuse b~gs, for the period b~ginni!lg
June 1, 1968, and en,di!lg August 31, 1968, ,in that portion of the

To effectuate the purposes of this Ordinance, from and
after June 1, 1968, each owner, occupant, tenant, and lessee of
each'dwelling designed for occupancy by one, two or three families,
lying and being situated West of Broadway Street, shall provide or
cause to be provided for each dwelling unit or residence disposable
, ,
refuse bags, which shall be furnished or approved by the City of
La Porte, acting through its Director of Public Works. Only such
,refuse bags as may be furnished by the City or approved by the
City, for'use as garbage containers shall be used for such purpose
in such area of the City hereinabove designated, during such
experimental period. The City shall not collect garbage, after
'tit June 1, 1968, from any dwelling unit of such dwellings designed
for use by less, than four families, unless contained in such
approved refuse bags. Only such refuse bags as are manufactured
for use as garbage containers shall be approved by the City~
The City shall furnish to each such dwelling unit of
'dwellings designed for less"than four families two (2) approved
bags per week.
Approved disposable refuse bags may be used by larger

multi-unit dwellings, such as apartment houses, hotels and motels
upon a finding by the Director of Public Works that such use is
practicable. Such bags may likewise be used for, garbage and
trash disposal by churches, schools,'offices, or any other
establishment if the Director of Public Works shall find such
use to be practicable, 'sanitary and not detrimental to the
collection of such waste by the City~
The City may,provide to, apartment houses and trailer
parks seventy-five per cent (75%) of such bags at the rate of two
(2) bags per week per trailer or per apartment, where the use of
such bags is practicable, without additional charge. The City
may provide additional refuse bags to any resident of La Porte
at no charge.

requirements as to containers for garb~ge shall apply to trash,
except that trash, as defined in Section 1 of this Ordinance, may
be deposited in dispos~ble boxes or other disposable containers
for collection; and la~ge cartons and boxes, tree limbs and other
large and bulky tr~sh ~ay be broken down and tied in bundles
instead of bei~g place~ in ~ontainers; Bundles and containers so
placed fOr collection shall not exceed fifty (50) pounds in we~ght.
Section 4. Penalty. Any violation of any of the terms
of this Ordinance, whether herein denominated as unlawful or not,
shall be deemed a misdemeanor; and any person convicted of any
such violation shall be fined in a sum not to exceed Two Hundred
Dollars ($200.00); each day of the continuance of such violation
shall be considered a separate offense and be punished separately;
and any person, ,~gent or emplo,yee e~g~ged in any such violation
shall on conviction be.so punished therefor.
Section 5. This Ordinance shall take 'effect and be in
force from and after its pass~ge, ,approval and publication as
required by law, provided, however, that in no event shall this
Ordinance be effective ,before June 1, 1968, ,and, ,provided, that
this Ordinance shall expire and terminate at m~dn~ght, ,A~gust 31,
1968.
