AN ORDINANCE MAKING IT UNLAWFUL ,TO PARK:, STORE, LEAVE OR ACCUMULATE ANY LICENSED OR UNLICENSED MOTOR VEHICLE, OR PART THEREOF, IN A RUSTED, WRECKED ,JUNKED', OR ABANDONED CONDITION, WHETHER ATTENDED OR NOT, UPON ANY ,PUBLIC ,OR PRIVATE PROPERTY ~ITHIN THE CITY ,LIMITS OF TaE CITY OF LA PORTE, FOR A PERIOD OF TIME IN EXCESS OF THIRTY (30) DAYS:, UNLESS SAME .,ARE COMPLETELY ,ENCLOSED WITHIN A BUILDING, , OR UNLESS !N CONNECTION WITH A REGULAR USED CAR LOT OR LAWFULLY OPERATED JUNKYARD; MAKING IT UNLAWFUL TO STORE, LEAVE OR ACCUMULATE ANY HOUSEHOLD APPLIANCES, FURNITURE, BEDDING, OR OTHER DEBRIS, WHETHER ATTENDED OR NOT" UPON ANY ,PUBLIC OR PRIVATE PROPERTY ,WITHIN THE CITY LIMITS OF THE CITY OF LA PORTE, FOR A PERIOD OF TIME IN EXCESS OF THIRTY, (30) DAYS" 'UNLESS COMPLETELY ,ENCLOSED WITHIN A BUILDING; DECLARING SUCH ACCUMULATION AND STORAGE TO BE A NUISANCE; IMPOSING A DUTY U~ON THE OWNER OF SUCH VEHICLE OR MATERIALS, THE OWNER OF ANY PRIVATE PROPERTY, OR LESSEE, OR OTHER PERSON IN POSSESSION OF PRIVATE PROPERTY" TO REMOVE THE SAME FROM SUCH PROPERTY" OR TO HOUSE Tf,IE SAME IN A BUILDING WHERE SAID VEHICLES AND MATERIALS WILL NOT BE,VISIBLE FROM THE STREET OR FROM OTHER PRIVATE PROPERTY;. PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE ,SHALL BE DEEMED GUILTY ,OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT LESS THAN TWENTY-FIVE DOLLARS ($25.00)NOR MORE THAN TWO HUNDRED DOLLARS ($200.00'), AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING A SAVING CLAUSE. BE IT ORDAINED BY THE C~TY COMMISSION OF THE CITY ,OF LA PORTE, , TE'XAS, THAT: Secti'on 1. It' shall be unlawful to park, ,st'ore or leave or to permit the parki!lg, ,stori!lg, ,leavi!lg or accwnulati!lg of any licensed or unlicensed motor vehicle of any kind, ,or part thereof, which is in a rusted, wrecked, junked, partially dismantled, inoperative or abandoned condition, ,whether attended or not, upon any public or private property within the City of La Porte, for a period of time in excess of thirty. (30), days, unles's such vehicle or parts thereof are completely enclosed within a buildi!lg or are stored in.connection with a r~gularused car lot or' junkayrd area lawfully established in the city. Se'cti:on 4~ Any owner, ,les-see, or occupant, ,whe,ther a . natural person or a corporation, ,or any ~gerit, off'icer, :servant, representative,' ,or enipl,oyee: 'of any such owner, ,les,see, ,'Or occupant,- includi!lg any person havi!lg ownership,. occupancy, ,or control of any lots or pa'r.cel of real estate 'or any part thereo'f, ,or interest therein, ,situated within the City, on which there 'exists any nuisance as defined in this Ordinance, ,or any owner of such vehicle or vehicles, or m~terials, who shall allow ,or permit any such nuisance to be created or to remain arid continue if created and established, shall be deemed, guilty of a misdemeanor and upon conviction sha~l be fined in any Sum not less than Twenty-five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00), ,and - each day of such violation shall be deemed a separate offense. Section 5~ If any section, par~graph, clause, or sentence shall be declared void and unenforceable or unconstitutional, it is hereby declar,ed to be the intention of the Commission that the remainder of such Ordin~nce shall remain in full force and effect. ~:ection 6,. This Ordinance shall take effect and be in force from and after its pass~ge, approval and publication as required by law.
