AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY
OF LA PORTE, TEXAS, ON' THE QUESTION OF THE ADOPTION OF A ONE
PER CENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY; DESIGNATING
THE DAY .OF THE 'ELECTION AND THE POLLING PLACE; APPOINTING ELECTION
OFFICIALS THEREFOR; PROVIDING THAT ALL DULY QUALIFIED RESIDENT
ELECTORS SHALL BE QUALIFIED TO VOTE; PRESCRIBING FORM OF BALLOT;
PROVIDING FOR NOTICE OF ELECTION; CONTAINING OTHER PROVISIONS
RELATING TO SAID ELECTION; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, Article 1066c, Vernon's Texas Civil Statutes
(Acts 1967, 60th L~gislature, ,R~gular Session, Chapter 36, ,P~ge
62) auth~rizes the, go~erni~g body of any city, town or vill~ge
in Texas to call an election for the purpose of adopti~g a local
sales and use tax, within such city, town or vill~ge;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF LA PORTE, TEXAS, THAT:
Secti'on' 1. That a special election shall be held in
and thro~ghout the City of La Porte, Texas, on the "7th day of
September, 1968, "at wh.:i:'6h election there shall be submitted to
the resident qualified voters of said City, for their action
thereupon, the followi~g propositions:
"FOR adoption of a one per. cent (1%) local sales and
use tax within the city."
"AGAINST adoption of a one per cent (1%) local sales
and use tax within the city."
Section 2. The City Commission of the City of La Porte
hereby des~gn~tes and establishes all of the area encompassed
e" within the corporate limits of the City of Lc~t',Porte, as one
election precinct, for this election, and the City Hall of the
City of La Porte is des~gnated as the 'one polling place for such
election. Voting"machines shall be used in the conduct of such
election.
Section 3.
Mrs. ArbeLa RaLston
is hereby ,
appointed Presidi~g Judge of said election, and Mrs. Fern Arthur
is hereby appointed Alternate Presidi~g Judge
of said election. The maximum number of clerks which may be
appointed to serve at said election is three (3), who shall be
selected by the Presiding Judge or the Alternate Presiding

Section' 4. Absentee voti~g by personal appearance
shall begin on the ~Oth day antlshall continue thro~gh the 4th
day preceding the day of the election. Absentee voting shall be
conducted by the City Clerk at the same place as provided in
Section 2 hereof. Voti~g machines shall be used for the casting
of absentee votes, at such election. The City Clerk shall not
permit anyone to vote absentee by personal appearance on any day
which is not a r~gular worki~g day for the Clerk's office, or at
any time when the Clerk's office is not open to the public. The
City Clerk of the City ,of La Porte is hereby authorized and
directed to appoint deputy absentee balloti~g clerks, as
necessary.
Section, 5. ~hat said election shall be held in
accordance with the Constitution and laws of the State of Texas,
and all duly qualified resident electors of the City of La Porte,
Texas, shall be qualified to vote.
Section 6. That the ballots of said election shall
conform to the requirements of Section 2, Subsection G, of
Article 1066c, Vernon's Texas Civil Statutes (Acts 1967, 60th
Legislature, R~gular Session, Chapter 36, P~ge 62), and to the
requirements of Chapter 6 of the Election Code of the State of
Texas, as amended, and the langu~ge to be printed thereon shall
include the following:
"FOR adoption of a one per cent (1%) local sales
and use tax within the city."

Section 7~ Notice of said election shall be given by
publication on the same' day of two successive weeks in a news-
paper of general circulation published within $a;i;d:City of
La Porte, the date of the first publication to be at least
twenty-one (21) days prior to the date 'set herein for such
electioniand further notice of said election shall be given by
posti~g a copy of this Ordinance,' t?gether with a copy of the

Notice of Election, at the 'City Hall of the City of La Porte,
not less than twenty-(20) days prior to the date set herein for
such election. It is hereby found and determined that the La Porte-
Bayshore Sun is a newspaper published within the City of La POrte,
Texas, and it is a newspaper of, general circulation within said
City of La Porte, Texas, ,and has heretofore been appointed by
the City Commission of, the, City of La Porte as the official
newspaper of the City for publication of legal notices.
Section 8. Each and every provision, ,par~graph,
sentence and clause of this Ordinance has been separately con-
sidered and passed by the City Conunission of the City of La Porte,
Texas, ,and each said provision would have been separately passed
wi thout any other provision, ,and if any provision hereof shall
be ineffective, ,invalid or unconstitutional, for any cause, ,it
shall not impair or a-fect the remaini~g portion, ,or any part
thereof, ,but the 'valid portion shall be in force just as if it
had been passed alone.

diately upon its pass~ge and approval.
