ORDINANCE NO. 826
AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PORTION OF
SOUTH NINTH (9TH) STREET LYING WITHIN THE AREA BOUNDED BY THE
SOUTH RIGHT-OF-WAY LINE OF WEST "E" STREET, AND THE NORTH
RIGHT-OF~WAY LINE OF WEST "F" STREET, AND BETWEEN BLOCK ONE
HUNDRED TWENTY-THREE (123) AND BLOCK ONE HUNDRED TWENTY-FOUR
(124) IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, AND ALSO
VACATING, ,ABANDONING ANP CLOSING THE ALLEY LYING WITH1N BLOCK
ONE HUNDRED TWENTY-FOUR (124) OF THE TOWN OF LA PORTE, HARRIS
COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE. CITY COMMISSION OF THE CITY OF LA PORTE,
TEXAS, THAT:
WHEREAS, the City Commission of the City of La Porte
has been requested by the record owner of all of the property
abutting South Ninth (9th) Street between the South right-of-
way line of West "E" Street, and the North right-of-way line
of West "F" Street, to vacate, abandon, and permapently close
that portion of South Ninth (9th) Street; and
WHEREAS, the said portion of South Ninth (9th)
Street between West "E" Street and West "F" Street has nexer
been opened or used as a pUblic road or street; and
WHEREAS, said portion of South Ninth (9th) Street
is less than one block East of and parallel to relocated State
Highway 146, which is a main traffic artery and thoroughfare
in the City of La Porte, and the said relocated State Highway
146 will in the future continue to furnish all needed access
and thoroughfare for traffic of any nature in said area; and
WHEREAS, the City Commission of the City of La Porte
has determined and does hereby find, determine and declare that
the hereinafter described portion of South Ninth (9th) Street
is not suitable, needed, or beneficial to the public as a
public road or street, and that the closing of the hereinafter
described portion o~ South Ninth (9th) Street is ~or the pro-
tection of the public and for the public benefit, and that
such portion of South Ninth (9th) Street should be vacated,
abandoned, and permanently closed; and

WHEREAS, the said Alley in said Block One Hundred
Twenty-Four, (124) Town of La'Porte, Harris County, Texas,
has never been opened or used as a public thoroughfare, and
