ORDINANCE NO. 836 AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEYS IN BLOCKS SIX HUNDRED NINETEEN (619), SIX HUNDRED FORTY-TWO (642), SIX HUNDRED FIFTY-FIVE (655), SIX HUNDRED SEVENTY-EIGHT (678), AND A PORTION OF BLOCK SIX HUNDRED NINETY-ONE (691), TOWN OF LA PORTE; AND ALSO VACATING, ABANDONING AND CLOSING THOSE PORTIONS OF WEST ADAMS STREET, WEST TYLER STREET, MADISON 'STREET, NORTH "E" STREET, AND NORTH "F" STREET, ALSO KNOWN AS CREST LANE, BETWEEN THE WEST RIGHT OF WAY LINE OF NORTH l8TH STREET AND THE EAST RIGHT OF WAY LINE OF NORTH 19TH STREET, TOWN OF LA PORTE; RESERVING EASEMENTS FOR HOUSTON NATURAL GAS CORPORATION AND' THE CITY OF LA PORTE; REQUIRING A CONTRACT BETWEEN THE CITY AND SOUTHERN PACIFIC COMPANY; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY CO~~ISSION OF THE CITY OF LA PORTE: WHEREAS, the City Commission of the City of La Porte has .' been requested by the record owners of all of the properties abutting the hereinafter described streets and alleys, to vacate, abandon, and permanently close said streets and alleys; and WHEREAS, the ~ity Commission of the City of La Porte has deter.mined,and does hereby find, determine and declare that the heJ:"einafter described streets and alleys are not suitable, needed, or beneficial to the public as public roads or streets, and" that the closi~g of the hereinafter described streets and alleys is for the protection of the public and for the publLc benefit, and that the hereinafter described .' I portions of said streets and alleys should be vacated, :abandoned, and permanently closed: Section 1. Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chap. 13, Title 28, Art. ll75, of the Revised Civil Statutes of the State of Tex~s, 1925, all of the alleys contained in Blocks Six Hundred Nineteen (619), Six Hundred Forty-two (642), Six Hundred Fifty-five (655), Six Hundred Seventy-eight (678), ..~ ~ and that portion of the alley in Block Six Hundred Ninety-one (691), situated North of the South property lines of Lot Six .<6) and Lot Twenty-seven (27), Block Six Hundred Ninety-one (691), all in the TOWN OF LA PORTE, Harris County, Texas, according to the map or pl&t thereof recorded in the office of the County Clerk of Harris County, Texas, are hereby . . Ordinance No. 836, Page 2. permanently vacated, abandoned, and closed by the City of ......... , , La Porte. Section 2. Unde~ and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chap. 13, Title 28, Art.' 1175, of the Revised Civil Statutes of the ,State of Texas, 1925, all of those portions of West Adams Street, West Tyler Street, Madison Street, North "E" Street, and North "F" Street, also known as Crest Lane, lying and being situated between the West right-of-way line of North 18th street, and the East right-of-way line of North 19th Street, TOWN OF LA PORTE, Harris County, Texas, according to e., the map or plat thereof recorded in the office of the County Clerk of Harris County, Texas, are hereby permanently vacated, abandoned, and closed by the City of La Porte. Section 3. The City of La Porte hereby reseryes, for the use and benefit of Houston Natural Gas Corporation, a right-of-way and easement over and across Crest Lane, also known as North "F" Street, for sub-surface gas pipe lines. The City of La Porte also reserves for itself, rights-of-way and easements across the aforementioned streets and alleys, for water and sewer lines, subject to the provisions of Section 4 hereof. . Section 4. This Ordinance shall not be effective until such time as the City of La Porte and the Southern Pacific Company have each approved and executed a formal contract, under the terms of which contract Southern Pacific Company shall have the following obligations, to-wit: (1) ,Southern Pacific Company shall, at its expense, install flashing lights and, gates at Spencer Highway, and on both lanes of Fainnont Parkway, and operate the same at its sole expense; said equipment to be installed not later than August 1st day of , 1970. the .', (2) When an automatic switching system has been installed by the Southern Pacific Company, the Southern Pacific Company shall erect a fence along the East, South, and . e.-. .~ ." e . Ordinance No. 836~ Page 3. North sides of its property, of a design suitable to the City of La Porte. ' (3) Southern Pacific Company shall, upon request by City, remove and replace its railroad tracks at its expense for installation of sewer and/or water line crossi~gs in its switchyard area. (4) Southern Pacific Company agrees not to charge City any fees for easements across said property for purpose of i~stalling sewer and/or water line crossings. (5) Southern Pacific Company shall allow City to choose the location of said easements for water and sewer line Qrossings, providing the same do not interfere with Southern Pacific Company's automatic switching equipment. (6) Southern Pacific Company shall, after the first two tracks ,are laid, install all future tracks in the economatic design, similar to the Beaumont, Texas, yards of Southern Pacific Company. (7) Southern Pacific Company shall install the hump . switch at the North end of its switching yard. SectionS. ~his Ordinance shall take effect and be in force (1) ninety (90),days from and after its passage and approval, and (2) upon filing in the office of the City Clerk ----- of the City of La:Porte, of a duly executed copy of a formal contract between the City of La Porte and the Southern Pacific Company, on the matters noted in the immediately preceding section hereof.
