ORDINANCE NO. /61)3 AN ORDINANCE REGULATING THE ANNUAL LA PORTE MAIN STREET FAIR, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW 7 AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. In order to preserve the public order, health, and safety during the annual Main Street Fair in La Porte, the City Council of the City of La Porte deems it necessary and expedient that all Main Street Fair activities be coordinated by and through one local organization committed to spending the time and effort required to carry out the endeavor successfully. Accordingly, the City Council of the City of La Porte hereby designates the La Porte Main Street Association, a Texas non-profit corporation, as the coordinating organization. Section 2. The La porte Main Street Fair shall be held on a Saturday during the month of October each year. The exact date will be coordinated between the City Manager and the La Porte Main Street Association. The La Porte Main Street Fair shall be held in 1988 on Saturday, October 29, 1988. Section 3. That portion of the public right-of-way between the curb lines of Main Street in the City of La Porte, from the West right-of-way line of North Broadway, to the East right-of-way line of 8th Street, shall be closed to traffic between the hours of 7:00 A.M. and 7:00 P.M., each year on the date of the Main Street Fair, upon thirty (30) days written notice from the La Porte Main Street Association to the City of La Porte. Section 4. The La Porte Main Street Association, the coordinating organization, shall adopt reasonable rules and regulations, a copy of which shall be filed with the City Manager, governing activities at the annual La Porte Main Street Fair. The La Porte Main Street Association, as the coordinating organization, shall be the responsible party having jurisdiction of the event, and shall have the right and responsibility to organize the Fair activities, lease booth space, and oversee the Fair activities. The La Porte Main Street Association shall coordinate security, fire and e . ORDINANCE NO. /'08 Page 2 safety, and health precautions with appropriate City of La Porte and Harris County officials. Existing City of La Porte electrical connections on utility poles along the Main Street right-of-way, may be used during the Fair by the La Porte Main Street Association and its lessees, provided, however all electrical connections shall comply with all City of La Porte codes, and shall be approved by the City of La Porte Building Official, or his designee. The La Porte Main Street Association shall reimburse the City of La Porte for its costs of electric power consumed. Section 5. Appropriate banners publicizing the Main Street Fair, may be installed at a location over Fairmont Parkway, and at a location over Main Street, for a period not exceeding twenty (20) days before the Fair date. Section 6. The La Porte Main Street Association, as the coordinating organization, shall obtain and file with the City Manager, a certificate of insurance, evidencing $1,000,000.00 liability insurance coverage for the Main Street Fair, which coverage shall include damage to persons and property, including provisions as to food service and liquor liability, which certificate of insurance shall reflect the City of La Porte as an additional named insured. Section 7. The La Porte Main Street Association, the coordinating organization, shall file with the City Manager, at least fifteen (15) business days before the Fair, a plan of police and fire protection, trash and debris cleanup, electric wiring, emergency vehicle routes, sanitation facilities, and other details of planning for the Fair, which shall be subject to his approval. Section 8. The La Porte Main Street Association, the coordinating organization, shall take care that entrances to buildings facing on Main Street, intersecting street rights-of-waY1 and sidewalks and driveways, shall not be unduly obstructed by Fair activities. Section 9. All booth lessees shall be required to obtain and display Texas State Sales Tax Permits, and, in the case of booths e e ORDINANCE NO. 1(P(J8 Page 3 serving food, appropriate food permits. Section 10. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 11. This Ordinance shall be effective from and after its passage and approval, and it is so ordered. PASSED AND APPROVED, this 26th day of September, 1988. MAm STREET FAIR RIJLES AND REXiULATICNS I. Vendor Participants The minimum age of persons participating as a vendor will be 18, unless approval has been received prior to the event. No vendor parti- cipant shall pour, toss, handout or otherwise distribute any noxious OI,' offensive substance. II. Permits , All vendors shall be subj ect to the' following regulations: " a. Requirement of Permit - no vendor will be , 'allowed a space without first applying for and obtaining a pennit from the Main street Associa- tion or event coordinator. No pennit has been accepted u.nt:i.l written notice has been recieved by the vendOr indicating an exact location of a booth. Any vendor who has not paid for a space will be closed do~. b. All vendors are responsible for obtaining health and tax pennits. The Association is not liable for any vendor who has not complied. c. If the vendor does not show up at the festival and has not requested in writing prior to the eVent~ a refund, no refund will be made. d. All vendors will pay the fee according to the space they require. e. Alcoholic beverages and soft drinks on the street will be exclusively sold by the ...Main street Association, with the exception' of lemonade, coffee, tea and hot chocolate. Any organization selling alcoholic beverages in conjunction with the fair will need to provide the Association with proof of a currently effective liability policy for the day of the fair in the amount of at least five hundred thou~and dollars. This includes any business on Main street or temp- orary vendor for the day. The Association has the right to close any vendor down ~ho does not comply. Safety Precautions a. Fire EXtinguishers - every vendor who has an open flame will need to have a fire extinguisher within their booth. This' includes 'electric, charcoal or gas. Extension Cords - all vendors must make sure the cords are secured in a non obstructive area and the cords may not be frayed. IV. Stands All stands and structures must be removed by 9 p.m. the evening of the fair. Any stand or structure not so removed may be removed by the City at the owner's or c:p:!tatcr's expense. And, all trash accumulated will need to be C1;~ of properly by the vendor. V. Obstruction of the street No vendor will be allowed in the middle of the street unless they were allocated the space there. It will be unlawful for any vendor to exceed the one street lane closest to the street. VI. T-Shirts The Main street Association has complete rights to sell the "Official" Main street Fair T-shirt. No other vendor will be allowed to sell the official shirt. VII. MAIN STREET FAm ORDrnANCE Description of Section 7 I. Police and Fire Protection 5 on duty officers 5 off duty officers as per Elaine Bonner will be on the Main Street from 10 a.m. to close. Fire Department will be down at the fair checking for hazard and offering "ladder" rides. Signs will be lit at the Spooky Cinema indicating "EXIT". II. Trash and Debris BFI is suppling 36 trash cans and liners to be placed 6 per block. 2 large dumpsters will be placed at 2nd Street and 5th Street alleys. 2 Boy Scout groups will be on hand all day for clean-up. Electric Wiring City to provide drop cords at various street corners. IV. Emergency Vehicle Routes All thoroughfares will be open to allow emergency vehicles entry and exit. Police at the fair will be on-hand to assist should an emergency occur . v. Other Details a. The Neighborhood Centers (United Way) will be running the haunted house. b. La Petite Academy will be manning 2 lost and found booths. c. 288 helium h=llla::ns to be posted on all street lights and poles to decorate. d. 2 - 20 x 20 stages 1 - 16 x 20 stage 3 live bands 1 stage to have continuous local performers. e.
