ORDINANCE NO. l608-A AN ORDINANCE AMENDING ORDINANCE NO. 1608, AN ORDINANCE REGULATING THE ANNUAL LA PORTE MAIN STREET FAIR~ FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. In order to preserve the public order, health, and safety during the annual Main Street Fair in La Porte, the City Council of the City of La Porte deems it necessary and expedient that all Main Street Fair activities be coordinated by and through one local organization committed to spending the time and effort required to carry out the endeavor successfully. Accordingly, the City Council of the City of La Porte hereby designates the La Porte Main Street Association, a Texas non-prOfit corporation, as the coordinating organization. Section 2. The La Porte Main Street Fair shall be held on a Saturday during the month of October each year. The exact date will be coordinated between the City Manager and the La Porte Main Street Association. Section 3. That portion of the public right-Of-way between the curb lines of Main Street in the City of La Porte, from the West right-Of-way line of North Broadway, to the East right-of-way line of 8th Street, shall be closed to traffic between the hours of 7:00 A.M. and 7:00 P.M., each year on the date of the Main Street Fair, upon thirty (30) days written notice from the La Porte Main Street Association to the City of La Porte. Section 4. The La Porte Main Street Association, the coordinating organization, shall adopt reasonable rules and regulations, a copy of which shall be filed with the City Manager, governing activities at the annual La Porte Main Street Fair. The La Porte Main Street Association, as the coordinating organization, shall be the responsible party having jurisdiction of the event, and shall have the right and responsibility to organize the Fair activities, lease booth space, and oversee the Fair activities. The La Porte Main Street Association shall coordinate security, fire and . e ORDINANCE NO. 1608-A Page 2 safety, and health precautions with appropriate City of La Porte and Harris County officials. Existing City of La Porte electrical connections on utility poles along the Main Street right-of-way, may be used during the Fair by the La Porte Main Street Association and its lessees; provided, however all electrical connections shall comply with all City of La Porte codes, and shall be approved by the City of La Porte Building Official, or his designee. The La Porte Main Street Association shall reimburse the City of La Porte for its costs of electric power consumed. Section 5. Appropriate banners publicizing the Main Street Fair, may be installed at a location over Fairmont Parkway, and at a location over Main Street, for a period not exceeding twenty (20) days before the Fair date. Section 6. The La Porte Main Street Association, as the coordinating organization, shall obtain and file with the City Manager, a certificate of insurance, evidencing $1,000,000.00 liability insurance coverage for the Main Street Fair, which coverage shall include damage to persons and property, including provisions as to food service and liquor liability, which certificate of insurance shall reflect the City of La Porte as an additional named insured. In the event that the La Porte Main Street Association does not provide food or alcoholic beverage service, the amount of such insurance may be reduced to $500,000.00. La Porte Main Street Association shall require its alcoholic beverage vendors to provide evidence of $500,000.00 liability coverage, with the La Porte Main Street Association and the City of La Porte named as additional named insureds. For purposes of this Ordinance, "vendor" and "booth lessees" shall mean anyone selling in conjunction with the Main Street Fair, including any business that moves outside to the street, sidewalk, parking lot, or other public right-of-way. Section 7. The La Porte Main Street Association, the coordinating organization, shall file with the City Manager, at least fifteen (15) business days before the Fair, a plan of police . e ORDINANCE NO. l608-A Page 3 and fire protection, trash and debris cleanup, electric wiring, emergency vehicle routes, sanitation facilities, and other details of planning for the Fair, which shall be subject to his approval. Section 8. The La Porte Main Street Association, the coordinating organization, shall take care that entrances to buildings facing on Main Street; intersecting street rights-of-way; and sidewalks and driveways, shall not be unduly obstructed by Fair activities. No pets, no glass containers, no bicycles, skate boards, and skates, shall be permitted in the designated Main Street Fair area. Section 9. All booth lessees shall be required to obtain and display Texas State Sales Tax Permits, and, in the case of booths serving food, appropriate food permits. Section 10. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 11.
