ORDINANCE NO. /~/~ AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THAT PORTION OF THE ALLEY LYING BETWEEN LOTS FIVE (5) THROUGH SIXTEEN (16), BOTH INCLUSIVE, AND LOTS SEVENTEEN (17) THROUGH TWENTY-FIVE (25), BOTH INCLUSIVE, IN BLOCK ONE HUNDRED SIXTY-SIX (166), TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, that portion of the alley lying between Lots Five (5) though Sixteen (16), both inclusive, and Lots Seventeen (17) throught Twenty-five (25), both inclusive in Block One Hundred Sixty-six (166) of the Town of La Porte has never been opened or used as a public thoroughfare, and the public utilities now making use of such alley have all given their written consent for its closing~ and WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine and declare that the said alley is not suitable, needed, or beneficial to the public as a public alley, and should be vacated, abandoned and permanently closed, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. That the portion of the alley lying between Lots Five (5) though Sixteen (16), both inclusive, and Lots Seventeen (17) throught Twenty-five (25), both inclusive in Block One Hundred Sixty-six (166) of the Town of La Porte, Harris County, Texas, is hereby permanently vacated, abandoned and closed by the City of La Porte. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated, and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. . . ORDINANCE NO. ~ Page 2 Section 3. This Ordinance shall be effective from and after its passage and approval, and it is so ordered. Applicant shall have sixty (60) days from the effective da~e hereof to pay the City of La Porte, in certified funds the sum of $12,379.50 as consideration hereunder. The City Secretary shall not issue a certified copy of this Ordinance until such payment is made. If such payment has not been made within sixty (60) days from the effective date hereof, this ordinance shall be null and void. PASSED AND APPROVED, this 10th day of October, 1988. ", RE: Closing of alley"in Block 166 Town of La Porte, Texas Dear Mr. Westergren, This letter is to inform you of the La Porte City Council action taken last night concerning your request to close the alley in Block No. 166, City of La Porte, Texas. The La Porte City Council did approve your request. Ordinance No. 1612, which was drawn up for the closing of the alley in Block No. 166, does have a stipulation that complies with your request not to make payment for the closing of the street until closing time. Section 3 of the Ordinance states "the applicant shall have 60 days from the effective date hereof to pay the City of La Porte in certified funds in the sum of $12,379.50 as consideration hereunder." I would also make note that if the payment to the City of La Porte is not make within 60 days from the effective date, which is October 10, 1988 the Ordinance will then be null and void. A certified copy of the Ordinance will be sent to you upon receipt of funds in the amount of $12,379.00.
