ORDINANCE NO.
AN ORDINANCE PROVIDING FOR THE DESTRUCTION OF CERTAIN ORIGINAL
PUBLIC RECORDS~ DIRECTING THE CITY SECRETARY OF THE CITY OF LA
PORTE TO NOTIFY THE STATE LIBRARIAN OR STATE ARCHIVIST OF THE
PROPOSED DESTRUCTION OF SAID RECORDS~ MAKING CERTAIN FINDINGS OF
FACT PERTINENT TO THE DESTRUCTION OF SAID RECORDS~ AND FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW AND PROVIDING FOR AN
EFFECTIVE DATE~
WHEREAS, the City of La Porte is in possession of public
records outlined on Exhibit "A", attached to this Ordinance and
incorporated by reference herein~ and
WHEREAS, the City Council of the City of La Porte hereby
finds that the records outlined on Exhibit "A" are worthless, and
are not public records that pertain to matters in litigation~ and
WHEREAS, the City Council of the City of La Porte deems it
to be a wasteful practice to maintain and house said worthless
public records~ and
WHEREAS, Vernon Texas Codes Annotated, Local Government
Code, Chapter 181, Section 181.005 provides for the destruction
of original public records that are deemed worthless by the City
Council~
BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
adopts and ratifies the above stated findings of fact as true.
Section 2.
The City Secretary of the City of La Porte is
directed to notify the State Librarian that the original public
records outlined on Exhibit "A", attached to this ordinance are
proposed to be destroyed by the City of La Porte.
The City
Secretary of the City of La Porte is directed to obtain the
consent of the State Librarian prior to the destruction of any of
said original public records, and is further directed to transfer
to the State Librarian or State Archivists any records that are
deemed by said State Librarian or State Archivists to be of a
historic nature.
Section 3. Upon receipt of the consent from the State
Librarian for the destruction of said original public records,
the City Secretary of the City of La Porte is directed to provide

for the destruction of said original public records outlined on
Exhibit "A" attached to this ordinance.
Section 4. That the City Council officially finds, deter-
mines, recites and declares that a sufficient written notice of
the date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding this
meeting, as required by the Open Meetings Law, Article 6252-17,
Texas Revised Civil Statutes Annotated; and that this meeting has
been open to the public as required by l~w at all times during
~hich this ordinance and the subject matter thereof has been
discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and
the contents and posting thereof.
Section 5.
That this Ordinance shall take effect and be in
full force immediately upon and after its adoption.

EXHIBIT "A"
Selected records including commercial and residential building permits,
drawings and specifications that are at least three (3) years old and
have no historic value, and are not involved in any litigation.
