HomeMy WebLinkAboutO-1993-1908 .y e e ORDINANCE NO. 93-~ AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND MITCHELL, CARLSON AND ASSOCIATES, INC., TO DEVELOP A BAY FRONT MASTER PLAN; APPROPRIATING $15,000.00 TO FUND SAID CONTRACT; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The city Council hereby approves and authorizes the contract, agreement or other undertaking described in the title of this ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by this reference. .The City Manager is here~y authorized to execute such document and all related documents on behalf of the City of La Porte. The City secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. City Council appropriates the sum of $l5,000.00 from the Capital Improvements Account No. Ol5-689-830-100 to fund said contract. An additional $10,000.00 grant from Southwestern Bell Telephone Company will be used to fund the total contract cost of $25,000.00. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, e . ORDINANCE NO. 93-1908 Page 2 considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. section 3. Box 1115 La Porte, Texas 77572 RE: Professional Services Contract La Porte Bayfront Master Plan Dear Chuck: Mitchell, Carlson & Associates, Inc. is pleased to submit the following proposal for Professional Planning Services in connection with your Bayfront Master Plan (Project site) located in Harris County Texas. This Agreement is by and between Mitchell, Carlson & Associates, Inc. (the Consultant), a Texas Corporation and The City of La Porte (the Client), La Porte, Texas. We understand that you will be the Project Manager on this project. The project team of Mitchell, Carlson & Associates, SLA Studio Land Inc., and Carter & Burgess will prepare a master plan as defined in its Proposal/Qualifications for Master Plan Service RFP #0052, dated March 5, 1993. The following scope is based upon our discussions regarding the primary opportunities and constraints of the site area. This proposal reflects the general planning direction which Mitchell, Carlson & Associates, Inc. and its team, SLA Studio Land Inc. and Carter & Burgess intends to follow to achieve the stated development objectives. It assumes that the scope will be completed within a two month time frame, after approval to proceed is given. ' A: APPROACH: The existing site conditions coupled with the "current" plans being developed for the hotel project by our offices offer a challenge to the planning team with regard to a number of key central issues. Development of a plan that takes into consideration the currently evolving hotel scheme 'and it's functional response to the "needs" of proposed future uses. 2. The development of a plan which created an opportunity to develop a distinctive waterfront concept incorporating private and public development. 3. Develop an implementation plan that allows functional and financial flexibility. 4. The exploration of a unique project identity through planning mechanism's such as neotraditional community elements, building placements including "build lines" and land used development options. 5. Evaluate the most beneficial vehicular circulation options to both the hotel and the surrounding uses. B: SCOPE OF SERVICES PHASE I: Project Mobilization, Site Analysis & Program Evaluation 1. After authorization to proceed, the Consultant will begin the data review process and prepare the project bases from the information provided by and collected by the Client. The necessary background studies shall include: a. Visit the project site, obtain photographic coverage and become familiar with overall physical site characteristics and the relationship of the site to the surrounding area. b. Meet with the Client and confirm the general range of development opportunities and expectations from a program, theme and quality of development perspective. Review all available existing pertinent data (provided by Client) in the form of base maps, current hotel site plan, property maps. aerial photographs. engineering information and controls, market studies, planning reports and projections, and other technical data pertinent to the site. d. Review relevant zoning and subdivision ordinances, restrictions that apply to the project area. 2. On the basis of the background studies and other information provided by the Client. the Consultant will address issues pertinent to site development opportunities such as parcel sizes, phasing, adverse site impacts and existing development conditions on and surrounding the site. 3. Analyze the program input of the Client and prepare proto-typical platting options which will provide different options for parcel depths and widths. This study will then provide a basis for estimating lot values and land use for Client pro-forma analysis. PHASE II: Master Planning And Development Concept Plan 1. On the basis of the above background information, the preliminary land use programs and Client defined market strategy, the Consultant will prepare concept plans. Subsequent to Client reviews, a Master Plan refinement process will be undertaken and which will include the following: a. Land Use Plan/Parcelization Plan defining the overall land use distribution for the site including commercial, housing product types, retail, and other potential uses yet to be defined. Statistical data and acreage density or yields will be provided. . e Mr. Chuck Harrington City of La Porte June 10,1993 Page 4 b. Circulation plah which shows overall access and circulation patterns, road hierarchy, major and secondary access points. Analyze existing road stubs and intersections for integration into the new plan. c. Illustrative sections to identify proposed ultimate R.O.W.'s, landscape character/image, and sidewalk locations. d. Consider building density and distribution around the perimeter areas to clarify the urban planning intent as well as the resultant surrounding development character. e. Explore preliminary major site pedestrian concept alternatives and evaluate them with respect to alternative land use plans. C: EXCLUSIONS TO SCOPE OF SERVICE AND ADDITIONAL SERVICES Client shall provide the following information or services as required for performance of the work. The Consultant assumes no responsibility for the accuracy of such information or services and shall not be liable for errors or omissions therein. Should the Consultant be required to provide services in obtaining or coordinating compilation of this information, such services shall be charged as Additional Services. Additional Services shall be provided on a time and material basis, unless the Client specifically requests written authorization. 1. Topography and boundary surveys. 2. Legal descriptions of property. 3. Existing site engineering and utility base information. . e Mr. Chuck Harrington City of La Porte June 10,1993 Page 5 4. Soils, Geotechnical, Structural, Electrical or Mechanical Engineering Services for analysis or design of project features, utilities, or municipal services. 5. Preparation of Preliminary or Final Plats. 6. Work requested and/or authorized by the Client not defined in the Scope of Services or revisions and charges in approved drawings and the preparation of alternated requested by the Client and not in the Scope of Services. 7. Preparation of as-built drawings or of measured drawings or existing conditions. 8. Meetings and/or formal presentations with City or County agencies or other governmental bodies to get approval of the planning documents. 9. Additional work performed due to lack of performance, default, insolvency, errors and/or omissions by other consultants retained by the Client and due to no fault of Mitchell, Carlson & Associates, Inc. and its team. 10. Work performed due to delays as a result of Client decisions or other project reasons and due to no fault of Mitchell, Carlson & Associates, Inc. and its team. 11. Production of camera ready artwork for marketing or advertising purposes. 12. Models, special renderings, promotional photography, special printing, special equipment, special printed reports or publications, maps, and documents requested by the Client. 13. Landscape design of street landscapes, entries, sign age, bridges, and open space or other areas within the project area. . e Mr. Chuck Harrington City of La Porte June 10, 1993 Page 6 14. Site development or urban development guidelines. "- 0: FEES AND PAYMENTS FOR PROFESSIONAL SERVICES 1. Fees for Professional Services and Reimbursable Costs shall be billed monthly on separate invoices. 2. Accounts are payable net thirty (15) days from dated of invoice at our offices in Houston, Texas. 3. The fee for all services summarized in Section B: Scope of Services shall not exceed $25.000.00, without additional written authorization for the Client. E: REIMBURSABLE Cost of copies of drawings, aerial photography, computer time, xerography and photographic reproduction of drawings; automobile travel at $0.30 per mile; other authorized travel, lodging, subsistence, care rental and out-of-pocket expenses for travel in connection with the work, long distance telephone and telegraph charges, and fees for additional consultant shall be reimbursed to the Consultant at cost plus ten percent (10%) and are not included in the Fees for Professional Services. F: REVOCATION This proposal shall be considered revoked if acceptance in not received within thirty (30) days of the data hereof. . .
