ORDINANCE NO. 93-1931
AB ORDXNABCE CALLING A SPECIAL ELECTION OF THE CITY OF LA PORTE;
DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR THE
USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR
METHOD AND DATES OF EARLY VOTING; PROVIDING FOR AB EARLY VOTING
BALLOT BOARD; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID
ELECTION; PROVXDING FOR NOTICE; PROVIDING A SAVXNGS CLAUSE; FINDXNG
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. A special election shall be held within the
corporate limits of the City of La Porte, Texas, on the 2nd day of
November, 1993, such day being the first Tuesday after the first
Monday of November, 1993, between seven o'clock (7:00) A.M. and
seven o'clock (7:00) P.M.. The wording of the proposition that is
to appear on the ballot shall be as follows:
"OFFICIAL BALLOT
FOR The sale of that portion of Little Cedar
Bayou Park situated east of Old Highway 146,
with the proceeds of the sale to be used only
AGAINST to acquire and improve public park property."
section 2. Said election shall be held at each of the
following voting places within said City, and the following named
persons are hereby appointed as officers of said election, to-wit:

section 3. Voting at said election, including early voting,
shall be by the use of voting machines, and the ballots of said
election shall conform to the Texas Election Code, as amended.
section 4. An Early Voting Ballot Board is hereby created to

Voting Ballot Board. At least two (2) other members of the Early
Voting Ballot Board shall be appointed by the Presiding Judge, in
the same manner as the precinct election clerks.
Early Voting by personal appearance shall begin on the 20th day
and shall continue through the 4th day preceding the day of
election.
Early Voting by mail shall begin on the 45th day preceding the
date of the election, or as soon thereafter as ballots are
available, and shall continue until seven o'clock (7:00) P.M. on
election day.
Early Voting shall be conducted by a clerk for Early Voting,
namely,
Cherie Black
, and the place at which the Early
Voting shall be conducted is designated as the La Porte City Hall,
604 West Fairmont Parkway, La Porte, Texas, to which address ballot
applications and ballots voted by mail may be mailed. Early Voting
by personal appearance shall be conducted on the weekdays of the
early voting period and during the hours that the City Secretary's
main business office is regularly open for business.
section 5. The council Conference Room of the La Porte City
Hall is hereby designated as the Central Counting station to receive
all ballots cast at said election, and Sue Lenes is hereby appointed
the Presiding Judge for said Central Counting Station. Said Judge
shall appoint any clerks necessary to assist in receiving ballots
and other records and in performing the other duties of said Judge
in this regard. The City Manager is hereby authorized and directed
to obtain, or cause to be obtained, the necessary electronic
tabulating equipment, to arrange for the testing thereof as provided
by law and to employ a duly qualified manager and a duly qualified
tabulation supervisor to perform the duties respectively imposed on

them by law with respect to the processing and tabulation of ballots
at the Central Counting station.
section 6. That all election materials including notice of the
election, ballots, instruction cards, affidavits and other forms
which voters may be required to sign and all early voting materials
shall be printed in both English and Spanish, or Spanish
translations thereof shall be made available in the circumstances
permitted and in the manner required by law.
section 7. The City Secretary of the City of La Porte shall
forthwith issue Notice of said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE SUN,
which is hereby found and declared to be a newspaper of general
circulation in said City, not less than ten (10) days nor more than
thirty (30) days prior to the date of the said election.
Section 8. said election shall be held in accordance with the
provisions of the City Charter of the City of La Porte, and the
general election laws of the state of Texas governing general and
municipal elections, so far as same may be applicable thereto.
section 9. Immediately after said election, the officers
holding the same shall make and deliver the returns of the results
thereof and the acoompanying records for use in the official canvass
to the City Council of the city of La Porte, and the City council
shall canvass said returns at the earliest practicable time, and
shall, immediately after canvassing the returns, declare the results
of the election.
section 10. Each and every provision, paragraph, sentence and
clause of this Ordinance has been separately considered and passed
by the City Council of the City of La Porte, Texas, and each said
provision would have been separately passed without any other

provision, and if any provision hereof shall be ineffective, invalid
or unconstitutional, for any cause, it shall not impair or affect
the remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 11. This Ordinance shall be in effect immediately upon
its passage and approval.
Section 12. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
civil statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.

seccion 7. EI Secretario de la Ciudad de La Porte emitira
enseguida un aviso de dicha eleccion al hacer que una copia verdadera
de este Decreto sean publicadas una vez en el BAY SHORE SUN, el cual se
ha encontrado y confirmado ser un periodico de circulacion general de
dicha Ciudad, no menos de diez (10) dias 0 mas de trienta (30) dias
antes de la fecha de dicha eleccion.
seccion 8'. Dicha eleccion sera llevada a cabo de acuerdo con las
proviciones de la carta constitucional de La Ciudad de La Porte, y las
leyes de las elecciones generales del Estado de Texas de gobernando

provision, y si alguna provision de aqui en adelante no sea efectiva,
invalida inconstitucional, por cualguier motivo, no impedira 0
afectara el resto de la provicion, 0 ninguna otra parte, pero la parte
valida sera enforzada como si hubiese sido aprovada separadamente.
Seccion 11. Este Decreto estara en efecto inmediatamente al ser
aprovado.
seccion 12. EI Consejo Municipal encuentra, determina, recita, y
declara que un aviso por escrito con la fecha, hora, lugar y objeto de
esta reunion del consejo municipal, fue puesta en un luqar conveniente
para el publico en la Municipalidad de la Ciudad con el tiempo
requerido por la ley precediendo esta reunion, como lo es requerido
por la Ley de Asamblea de Libre Acceso, Articulo 6252 -17, anotado por
la Revicion de Estatutos Civiles de Texas, y que esta asamblea ha sido
abierta al publico todo el tiempo que es requerido por la ley durante
el cual este decreto y cualquier otro asunto haya sido discutido,
considerado y formalmente aceptado. EI Consejo Municipal ratifica,
aprueba, y confirma dichos avisos por escrito y el contenido de

Re: Submission of City of La Porte, Texas, Concerning a Special
Election to be Held November 2, 1993, in Harris county, Texas.
Dear Sir:
Pursuant to Texas Local Government Code section 253.001, which
requires that land owned, held or claimed as a public square or
park by a city may not be sold unless the issue of the sale is
submitted to the qualified voters of the municipality at an
election and is approved by a majority of the votes received at the
election, the City of La Porte, Texas, has called a special
election for Tuesday, November 2, 1993. A copy of Texas Local
Government Code section 253.001, and a copy of Ordinance No. 93-
1931, is attached to this submission.
Pursuant to the requirements of 28 C.F.R. S 51.27, the following
information is submitted with respect to the election:
(a) & (b) Orders or enactments. A copy of Ordinance 93-1931,
calling a special election on the proposition "The sale of
that portion of Little Cedar Bayou Park situated east of Old
Highway 146, with the proceeds of the sale to be used only to
acquire and improve public park property," is enclosed
herewith.
(c) Chanaes. The effect of the Ordinance will be to call a
special election on November 2, 1993, in the City of La Porte.
This is a Texas uniform election date. Also being separately
held on the same date, will be a state of Texas election for
submission of several proposed constitutional amendments to
the voters of the state of Texas.
As described in the Ordinance calling the election, the City
will use the same precinct lines and polling places on
election day that have been previously approved by the u.S.
Department of Justice, in previous submissions by the City.
The City will also establish the location and hours for early
voting as precleared in said previous submissions.

The proposition appearing on the ballot is as follows:
"The sale of that portion of Little Cedar Bayou Park situated
east of Old Highway 146, with the proceeds of the sale to be
used only to acquire and improve public park property."
If this proposition passes, the effect of the change will be
to authorize the City Council of the City of La Porte to sell
that portion of Little Cedar Bayou Park situated east of Old
Highway 146 in La Porte, with the proceeds of the sale to be
used only to acquire and improve public park property, as
required by Texas state law. The change does not involve
changes in territorial boundaries, or any further election
related changes.
(d) Person makina submission. The submitting authority is the
city Council of the City of La Porte. The City may be reached

pursuant to Texas Local Government Code, section 253.001.
(i) Date of adoption. The Ordinance was passed by the City
Council of the City of La Porte on September 27, 1993, by a
unanimous vote.
(j) Date of effect. The election will take place on November 2,
1993, and the changes will take effect immediately.
(k) ImDlementation. The provisions of this Ordinance have not
been implemented, and will not be implemented until approved
by a majority of the electorate participating in the election,
and until pre-cleared by the united States Department of
Justice.

(I) SCODe. These procedures will affect the City of La Porte,

(m) Reason. The reason for the changes provided for in the
Ordinance is to comply wi th Texas Local Government Code
section 253.001, to authorize the sale of a portion of Little
Cedar Bayou Park, with the proceeds of the sale to be used for
purchase of another park site.
(n) Impact. The Ordinance does not affect members of any racial
or linguistic minority differently from the way the general
public is affected. The Ordinance does not have the intent

i 253.001. Sale of Park Land, Municipal Building Site, or Abandoned
Roadway
(a) Except as provided by Subsection (b), the governing body of a munici-
pality may sell and convey land or an interest in land that the municipality
owns, holds, or claims as a public square, park, or site for the city hall or
other municipal building or that is an abandoned part of a street or alley. A
sale under this section may include the improvements on the property.
\,\\ (b) Land owned, held, or claimed as a public square or park may not be
'\ sold unless the issue of the sale is submitted to the qualified voters of the
municipality at an election and is approved by a majority of the votes received
at the election. . .
(c) To effect the sale, the governing body shall adopt an ordinance directing
the municipality's mayor or city manager to execute the conveyance.
(d) The proceeds of the sale may be used only to acquire and improve
property for the purposes for which the sold property was used. Failure to so
use the proceeds, however, does not impair the title to the sold property
acquired. by a purchaser for a valuable consideration.

Revisor's Note
At the time of their inclusion in the 1925 revision of civil statutes, V.A.C.S.
Articles 1017 and 1020 both limited the application of the source law to
certain municipalities. In 1947, however, the legislature amended Article
1017 to apply to municipalities "however incorporated," thus rendering the
population limitations remaining in Article 1020 meaningless insofar as the
source law for this section is concerned.

If a city has authority to sell its parks, the
sellers of land to the city for park purposes
have no vested right in the maintenance of a
park on the land. City of Beaumont v. Mat-
thew Cartwright Land & Improvement Co.
