ORDINANCE NO. 93- 1943 AN ORDINANCE DIRECTING THE CITY'S PLANNING DEPARTMENT TO PREPARE A SERVICE PLAN THAT PROVIDES FOR THE EXTENSION OF MUNICIPAL SERVICES TO THE AREA COMPRISING THE BATTLEGROUND INDUSTRIAL DISTRICT AND THE BAYPORT INDUSTRIAL DISTRICT, PROPOSED TO BE ANNEXED BY THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Pursuant to Section 43.056, Texas Local Government Code, the City Council of the City of La Porte hereby directs the City of La Porte Planning Department to prepare a service plan that provides for the extension of municipal services to the Battleground Industrial District and the Bayport Industrial District, areas proposed to be annexed to the City of La Porte. The proposed service plan shall be made available for public inspection and explained to the inhabitants of the Districts at public hearings to be held under Section 43.052, Texas Local Government Code. The proposed service plan for Bayport Industrial District shall not include the property owned by Southern Ionics, Inc. Section 2. The property of each firm which accepts the offer of the City of La Porte to enter into the City'S proposed industrial district agreement, for the seven year term beginning January 1, 1994, shall not be included in the service plan. Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the city Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised . e ORDINANCE NO. 93- 1943 PAGE 2 civil statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subj ect matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. section 4.
