City of La Porte, Texas Ordinance No. 93- 1 956 AN ORDINANCE FINDING AND DETERMINING THAT PUBliC CONVENIENCE AND NECESSITY NO LONGER REQUIRE THE CONTINUED USE OF CERTAIN DRAINAGE AND/OR UTILITY EASEMENTS LOCATED IN A FORTY FOOT WIDE STRIP OF LAND IN HARRIS COUNTY, TEXAS, SAID STRIP OF LAND BEING MORE FUlLY DESCRIBED IN THE BODY OF TIllS ORDINANCE; VACATING AND ABANDONING SAID EASEMENTS TO HARRIS COUNTY, THE ABUTfING PROPERTY OWNER, IN CONSIDERATION OF HARRIS COUNTY'S RELOCATING THE CITY OF LA PORTE'S UTILITY LINES; CONTAINING VARIOUS FINDINGS AND OTHER PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EMERGENCY. * * * * * * * WHEREAS, Harris County (the "County") has acquired a strip of land approximately forty feet wide adjoining the east side of Underwood Road from Spencer Highway to approximately 3300 feet North of Pasadena Boulevard; and //' WHEREAS, the County contemplates using said forty foot strip of land for the widening of Underwood Road; and WHEREAS, the City of La Porte, Texas (the "City") owns various utility and/or drainage easements within said forty foot strip of land; and WHEREAS, the widening of Underwood Road from 13th Street to Spencer Highway will be a mutual benefit to the City and County; and WHEREAS, the City desires to cooperate with the County in such widening; and WHEREAS, the County has requested that the City vacate and abandon the City's drainage and/or utility easements; and WHEREAS, the City is willing to vacate and abandon the said drainage and/or utility easements, upon the County's relocation of the City's utility lines; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1. The City Council hereby adopts the findings set out in the preamble hereof and finds and determines that public convenience and necessity no longer require the continued use of the drainage and/or utility easements located in a forty foot wide strip of land described by metes and bounds in Exhibit "A", attached hereto and made a part hereof; and said drainage and/or utility easements are hereby vacated and abandoned in consideration of the County's relocating the City's utility lines in the Underwood Road right- of-way according to the plans and specifications for Harris County Job # PIN Ordinance 93-1956~ e Page 2 B/I02/1'}2,7/017 prepared by Sparks and Barlow, inc., such vacation and abandonment being effective upon the County's relocation of the City's utility lines. Section 2. The City Council hereby abandons any and all drainage and/or utility easements owned by the City and located within the said forty foot wide strip of land, described by metes and bounds in Exhibit "A", attached hereto and made a part hereof for all purposes. Section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter therof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. It is ORDERED that the City Secretary cause a certified copy of this Ordinance to be filed in the Official Public Records of Real Property of Harris County and do any and all things necessary or convenient to record said Ordinance.
