ORDINANCE NO. 93- 19.5.9 '
AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND LA PORTE CHAPTER, BAY AREA HABITAT FOR
HUMANITY, CONCERNING PROPERTY IN BLOCK 128, TOWN OF LA PORTE,
HARRIS COUNTY, TEXAS; MAKING VARIOUS FINDINGS AND PROVISIONS
RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking descr ibed in the
title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this
reference. The City Manager is hereby authorized to execute such
document and all related documents on behalf of the City of La
Porte. The City Secretary is hereby authorized to attest to all
such signatures and to affix the seal of the City to all such
documents.
section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
ci ty for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
civil Statutes Annotated; and that this meeting has been open to
the public as required by law at all times during which this
ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.

section 3. This Ordinance shall be effective from and after its
passage and approval, and it is so ordered.

thereof recorded in Volume 58, Page 460 of the Deed
Records of Harris County, Texas.
SUBJECT TO: Grantee assumes the payment of all delinquent ad
valorem taxes on the subject property. This conveyance is
also SUBJECT TO that certain deed dated May 9, 1978, and filed
for record in the office of the county clerk of Harris County,
Texas, under Harris County clerk's, file number E591049, to La

Reservations from and Exception to Conveyance and Warranty: Taxes
for the current year have been prorated and are assumed by Grantee.
This conveyance is made subject to all and singular the
restrictions, conditions, oil, gas, and other mineral reservations,
easements, and covenants, if any, applicable to and enforceable
against the above described property as reflected by the records
of the county clerk of the aforesaid county.

and exceptions to conveyance and warranty, grants, sells, and
conveys to Grantee the property, together with all and singular the
rights and appurtenances thereto in any wise belonging, to have and
hold it to Grantee, Grantee's heirs, executors, administrators,
successors, or assigns forever. Grantor binds Grantor and
Grantor's heirs, executors, administrators, and successors to
warrant and forever defend all and singular the property to Grantee
and Grantee's heirs, executors, administrators, successors, and
assigns against every person whomsoever lawfully claiming or to
claim the same or any part thereof, except as to the reservations
from and exceptions to conveyance and warranty, by, through, or
under Grantor, but not otherwise.
When the context requires, singular nouns and pronouns include the
plural.

Dear Mr. Counts:
The La Porte Chapter, Bay Area Habitat for Humanity, has requested
the assistance of the City of La Porte in its efforts to provide
quality housing for low income families. Specifically, your
organization has requested that the City of La Porte deed to it,
the property on South 5th Street legally described as Lots 1-13,
both inclusive, Block 128, Town of La Porte, Harris County, Texas.
This is a tax title owned by the City of La Porte. The title is
subject to the claims of La Porte Land Company, by a deed dated May
9, 1978, and filed for record in the office of the county clerk of
Harris County, Texas, under county clerk's file number E591049.
The La Porte Chapter, Bay Area Habitat for Humanity, has indicated
that it will be able to obtain a deed from La Porte Land Company to
it, of the property.
In addition, the La Porte Chapter, Bay Area Habitat for Humanity,
has indicated that it will assume and pay the delinquent taxes on
the subject property.
It is the City's understanding that your organization plans to
build five or six single family residences, which would then be
sold under its usual procedures to low income families, who would
provide 350 "sweat equity" hours as a downpayment, and would then
sign interest free mortgages for the balance. The City of La Porte
agrees to convey the subject property to your organization, in
consideration of its use of the property in accordance with the
terms of this letter, with the title to any unused property to
revert to the City of La Porte in five years. The use of the
property would be strictly limited to the purposes stated in this
letter.
The City of La Porte will benefit by the activities of your
organization, in providing housing for its low income residents,
and returning this property to the tax rolls.

If the La Porte Chapter, Bay Area Habitat for Humanity, is in
agreement with the conveyance of the above described property in
accordance with the terms and provisions contained in this letter,
please note your acceptance and agreement by signing and returning
to the City a copy of this letter, retaining the original as your
copy of the agreement.
