- ORDINANCE NO. 1631
AN ORDINANCE AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND
SEWAGE DISPOSAL," OF 'THE CODE OF ORDINA,NCES OF THE CITY OF LA
PORTE; ESTABLISHING',A NEW RATE AND. FEE STRUCTURE; CONTAINING A
SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW; AND PROVIDING AN' EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Chapter 26 of the Code of Ordinances of the City
of La Porte, shall be amended to hereafter read as follows,
to-wit:
"(a.) Sec. 26-12 - Water service charges payable; discount
for early payment:
Water meters shall be read monthl~~ and ~~c~.consumer shall
be billed monthly.. All water bills shall be paya~le. in fu~l at
their net amount based upon the rates and schedules p~ovid~d in
this artic~e, on ~r be~ore fiftee~ (15) days after the date of
the mailing o~ the b~ll to the consumer. If any bill is not paid
in full within such period, there shall be added thereto ten (10)
percent of the net amount, in addition to said net amount. For
the c~nveni~nce of the consumers ~nd of those receiving the
actual payments of such pills, the amount of the bill, if paid
within fif~ee~ (15) days (i.e., the discount period) of the date
of the mai~ing of the ~ill, may ~e indica~ed.or described as the
"net" amount of the bill., and the amount payable with the
addit~on o~ the perce~tage of t~e net amoun~ .to the net amount
may be named as the "gross" am~unt of the bill.
"(b.) Sec. 26-1~ - Te~mination of water service for failure
to pay:
(a) If any person shall refuse or neglect to pay the

charges for water s~rvice (which bil~ shal~ inc~ude _~he total
charges for water service, sewer servi~e~ and garbage, service)
furnished by ~he ~i~y, .on o~ befor~ ~~ent~-f~ve(~5) days ~fter
the da~eof ~he, mailing of the bill to the.consumer, such water
se~vice shall be imme~~atelydisc~nn~cted and furth~r water
service s~all .not be ~ermi~ted, except by authorized
representatiyes of the city. ,.....
"(c.) ~ec. 26-1~(c) - Reconnect fee:
During regula~ hours.~9:00_a.m. throug~ 5:00 p.m., Monday through
Friday, exc~~t Ho~idays approye~ by the C~t~ ~o~~cil)~ the
reconnect fee shall ,~e .$25.00; after the .aforementioned hours,
the reconnect fee shall be $35.00.
"(d.) Sec. 26-1~(d) - I~ cases wher~ any person gives the
City a check.in payment of w~ter and sewer services which is not
honored by the drawee bank for any reason, an additional charge
shall be levied ag~in~t suc~ person of $15.00.
(e.) The first subparagraph of Sec. 26-14 is amended to read
as follows, to wit: ,
"Whenever a consumer desires to .establish service with the
city water department, he .shall tender to such department,. at
least one day prior to the time he desires his property to be

connected with said water services, the proper deposit. Deposits
will be refunded either upon discontinuance of service to
consumer, after all charges for water service, sewer service, and
garbage service, and any other fees, have been fully satisfied,
or after consumer has established twelve (12) months of
satisfactory payment history."
"Cf.) Sec. 26-14 - Deposit Schedule:
1. Single-family residence consumers shall place on
deposit the sum of $75.00.
2. The deposit for commercial water consumers shall be
established at the discretion .of the Director of
Finance, upon standards set forth in Sec. 26-14(c);
3. The deposit f.or multiple-family dwellings [as
defined in Sec. 26-14(d)] shall .be .set at the
discretion of the Dir-ectorof Finance, in reliance
upon the standards set forth in Sec. 26-14(c) of
Article II, Chapter. 26 of the Code of .Ordinances of
the City of La Porte.
Section 2. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this
ordinance ~hall, fo~ a~y reason, be held invalid, such invalidity
shall not af~ect the re~aining portions of this Ordina~ce, and it
is hereby de~la~ed to b~ the .intention of this City.Council to
have passed each section, sentence, phrase or clause, or part
thereof, irrespective of the fact th~t any other section,
sentence, phrase or clause, or part thereof, may be decl~red
invalid.
Section i. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the

date, hour, .plac~ a~~ subj~ct ~f this .~e~tin~ of the .City Coun~il
was posted at a place convenient to the public at the City Hall
of the City for the ~ime required by law preceding this meeting,
as required ~y the Open Meetings.Law, ~rticle 6252-17, Texas
Revised Ci~i~.~~a~u~~s ~~~otated~ ~nd ~ha~ .~his..~~e~ing ~as been
open to the p~blic as required by law at all ti~es ~~ring. which
this ordinance and the sUbject matter ,the~eof has been .~iscussed,
considered and formally acted upon. The City Council further
ra~ifies, .app~oves .~nd confirms such written notice and the
contents and posting thereo~.
Section 4. This Ordinance shall take effect and be in force
