ORDINANCE NO. 1676 AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PORTE: CALLING A RUN-OFF ELECTION, IF NECESSARY: CALLING A CHARTER AMENDMENT ELECTION: DESIGNATING ELECTION PRECINCTS AND POLLING PLACES: PROVIDING FOR THE USE OF VOTING MACHINES: APPOINTING ELECTION OFFICIALS: PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING: PROVIDING FOR AN ABSENTEE BALLOT BOARD: PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION: PROVID,ING FOR NOTICE: PROVIDING FOR FILING DEADLINE AND FILING FEES FOR CANDIDATES: PROVIDING A SAVINGS CLAUSE: FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW: AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE ,CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. An election shall be held within the corporate limits of the City of La Porte, Texas! on the 5th day of May, 1990, such day being the first Saturday in May, 1990, between seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M., for the purpose of electing the following City officials: Councilperson-at-Large--position B, for a 3 year term Councilperson--District 1, for a 3 year term Councilperson--District 6, for a 3 year term A run-off election, if necessary, shall be held on May 19, 1990, between the same hours. Section lA. An election shall be held within the corporate limits of the'City of ' La Porte, Texas, on the 5th day of May, 1990, at which election there shall be submitted to the resident qualified electors of the City of La Porte, for their acceptance or rejection, the following amendment to the Home Rule Charter of the City of La Porte, Texas, to-wit: Section 5.02, "Purchase Procedure," of the Home Rule Charter of the City of La Porte, 'Texas, shall be amended so that the same shall hereafter read as follows: "5.02. Purchase Procedure All purchases made and contracts executed by the city shall be pursuant to a requisition from the head of the office, department or agency whose appropriation will be charged, and no contract or order shall be binding upon the city unless and until the city manager or his designee approves the same and certifies that there is to the credit of such office, department or agency a sufficient unencumbered appropriation and allotment balance to pay for the supplies, materials, equipment or contractual services for which the contract or order is to be issued. Before the city may enter into a contract that requires an expenditure of more than $5,000.00, the City must comply with the procedure prescribed by Chapter 252, Texas Local Government Code, for competitive sealed bidding or competitive sealed proposals. The city may use the competitive sealed proposals procedure only for high technology procurements. Council may by ordinance confer upon the city manager general authority to contract for expenditures without . . ORDINANCE NO. 1676 Page 2 further approval of council for budgeted items not exceeding $5,000.00. All contracts for expenditures involving more than $5,000.00 must be expressly approved in advance by council. If the competitive sealed bidding requirement applys to the contract, the contract must be awarded to the lowest responsible bidder. Councilor the city manager, in such cases as he is authorized to contract for the city, may reject any and all bids. If the competitive sealed proposals requirement applys to the contract, the contract must be awarded to the responsible offeror whose proposal is determined to be the most advantageous to the city considering the relative importance of price and the other evaluation factors included in the request for proposals. Council by ordinance may increase the $5,000.00 limitation herein provided to conform to subsequent increases authorized by state law. Contracts for professional services for which bidding is prohibited by state law shall not be let on competitive bids. Procurement of architectural or engineering services shall be in accordance with the Professional Services Procurement Act. In the event of conflict between any provision of this section and state law, state law shall prevail." The ballot for said charter amendment election shall conform to Section 52.072 and Section 52.073, TexaS Election Code. The wording of the proposition that is to appear on the ballot shall be "THE AMENDMENT OF SECTION 5.02, 'PURCHASE PROCEDURE,' OF THE HOME RULE CHARTER OF THE CITY OF LAPORTE." The words "FOR" and, below it, "AGAINST" s~all be printed on the ballot to the left of the proposition. Section 2. Election Officials: Barbara Moser , Presiding Judge Theresa Sabin , Alternate Presiding Judge Absentee Polling Place: La Porte City Hall 604 West Fairmont Parkway La Porte, Texas 77571 Section 3. Voting at said election, including absentee voting, shall be by the use' of voting machines, and the ballots of said election shall conform to the Texas Election Code, as amended. Section 4. An Absentee Ballot Board is hereby created to process Absentee Voting results for the election and the runoff election, if necessary. Charlotte Boudreaux is appointed Presiding Judge of the Absentee Ballot Board. At least two (2) other members of the Absentee Ballot Board shall be appointed by the Presiding Judge, in the same manner as the precinct election clerks. Absentee voting by personal appearance shall begin on the 20th day and shall continue, through the 4th day preceding the day of election. Except as authorized herein, the clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk's office, and under no circumstances shall he permit anyone to vote absentee by personal appearance at any time when his office is not open to the public. Absentee voting by mail shall begin on the 20th day preceding the date of the election and shall continue until seven o'clock (7:00) P.M. on election day. Absentee voting shall be conducted by a clerk for absentee voting, namely, Paula Rizzuto , and the place at which the absentee voting shall be conducted is designated as the La Porte City Hall, 604 West Fairmont Parkway, La Porte, Texas, to which e e ORDINANCE NO. 1676 Page 8 address ballot applications and ballots voted by mail may be mailed. Said clerk shall keep said office open for absentee voting during his regular working hours and in any event for at least eight (8) hours on each day which is not a Saturday, a Sunday, or an official State holiday. Section 5. The Council Conference Room of the La Porte City Hall is hereby designated as the Central Counting Station to receive all ballots cast at said election, and Cherie Black is hereby appointed the presiding Judge for said Central Counting Station. Said Judge shall appoint any clerks necessary to assist in receiving ballots and other records and in performing the other duties of said Judge in this 'regard. The City Manager is hereby authorized and directed to obtain, or cause to be obtained, the necessary electronic tabulating equipment, to arrange for the testing thereof as provided by law and to employ a duly qualified manager and a duly qualified tabulation supervisor to perform the duties respectively imposed on them by law with respect to the processing and tabulation of ballots at the Central Counting Station. Section 6. That all election materials including notice of the election, ballots, instruction cards, affidavits and other forms which voters may be required to sign and all absentee voting materials shall be printed in both English and Spanish, or Spanish translations thereof shall be made available in the circumstances permitted and in the manner required by law. Section 7. The City Secretary of the City of La Porte shall forthwith issue Notice of said election by causing a substantial copy of this Ordinance to be published on the same day in each of two successive weeks, in the BAYSHORE SON, which is hereby found and declared to be a newspaper of general circulation in said City, not less than fourteen (14) days nor more than thirty (30) days prior to the date of the said election. Section 8. Upon a candidate tendering his application on the form prescribed, the City Secretary shall furnish to such candidate all information relative to the qualifications for the office being e e ORDINANCE NO. 1676 Page 9 sought; the method of placing the candidate's name on the ballot; the amount of the required filing fee; and any other pertinent information concerning said election. Section 9. Each candidate for the office of Councilperson must be a resident elector of the City. Each candidate for the office of District Councilperson must also be a resident of the district for which he files. Section 10. The deadline for a candidate to make application to have his name appear upon the ballot for such election, is hereby designated and established as 5:00 o'clock P.M., Wednesday March 21, 1990. No application shall be accepted for filing prior to February 19, 1990. The filing fee for each candidate for the office of Councilperson is hereby established as Fifty Dollars ($50.00). The filing fees shall be used to defray the cost of the election, and said fees shall be prorated and any surplus shall be refunded to said candidates. As an alternative to paying a filing fee, a candidate may obtain a place on the ballot by filing a petition as provided for in City of La Porte Home Rule Charter, Article 2.04 c.3. Section ll. Said election shall be held in accordance with the provisions of the City Charter of the City of La Porte, and the general election laws of the State of Texas governing general and municipal elections, so far as same may be applicable thereto. Section 12. Immediately after said election, the officers holding the same shall make and deliver the returns of the results thereof and the accompanying records for use in the official canvass to the City Council of the City of La Porte, and the City Council shall canvass said returns at the earliest practicable time, and shall, immediately after canvassing the returns, declare the results of the election. The Mayor shall immediately thereafter deliver to the candidate for whom the majority of votes has been polled for each respective office, a certificate of election. Such elected officials shall assume their duties within ten (10) days thereafter, Sundays, excluded, upon their taking the oath of office. e e ORDINANCE NO. 1676 P ag e 10 Section 13. Each and every provision, paragraph, sentence and clause of this Ordinance has been separately considered and passed by the City Council of the City of La Porte, Texas, and each said provision would have been separately passed without any other provision, and if any provision hereof shall be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, or any part thereof, but the valid portion shall be in force just as if it had been passed alone. Section 14. This Ordinance shall be in effect immediately upon its passage and approval. Sectionl5. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance .and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. PASSED AND APPROVED this the 12th day of February, 1990. Antes que la cuidad pueda obligarse a un contrato en el cual se gastara mas de $5,000.00 la cuidad tiene que cumplir con la demanda del titulo 252, Codigo Local del Gobierno de Texas, para la oferta competativa cerrada, 0 proposicion competativa cerrada. La cuidad puede usar la proposicion competativa cerrada solo para la obtencion de alta tecnologia. El Concilio puede otorgar al gerente general de la cuidad la autoridad de contra tar los gastos sin aprobacion mas del concilio para 10s articulos presupuestos que no excedan los $5,' 000.00. Todos los contratos de gastos excediendo mas de $5,000.00 tienen que ser expresamente aprovados con anticipacion por el concilio. si se requiere . e Ordenanza Num. 1676, Page 2 la oferta competativa cerrada, el contrato se le dara a la oferta mas baja y responsable. El concilio 0 el gerente de la cuidad en tal caso como sera autorizado a cotratar para la cuidad, puede rechazar cualquier 0 todas las ofertas. si se requiere la proposicion competativa cerrada, el contrato se dara al ofertador responsable del cual la proposicion es determinada ser la mas ventajosa a la cuidad considerando la importancia de precio, otros evaluativos incluyendo los requisitos para las proposiciones. El Concilio por ordenanza puede aumentar subsiguientes autorizados por la ley del estado, contratos de servicio profesionales por los cual no se permite ocupar por oferta por la ley del estado, no se permi tiran. Obtencion de servicios de arqui tectura 0 de engenieria seran de acuerdo con el Acto de Obtener Servicios Profesionales. En el evento que haya conflicto con este provicio de esta seccion y la ley del estado, la ley del estado prevalecera. El escrutino de tal eleccion de enmienda conformara a la seccion 52.072 y seccion 52.073, Codigo de elecciones de Texas. La fraselogia de la proposicion que aparecera en el escrutino sera "La enmienda de la seccion 5.02, "procedimiento de Compras" del titulo de Regla de casa de la cuidad de La Porte las palabras "POR" y debajo "ENCONTRA" seran imprimidas en el escrutino a la izquierda del la proposicion. Excepto como autorizado por esto, el dependiente no dejara que nadie vote en ausencia por aparecer personalmente durante un dia que sea dia de trabajo regular en la oficina del dependiente, y bajo ningunas circunstancias pueda alguien votar cuando la oficina esta cerrada al publico. La votacion en ausencia por medio del correo comenzara el dia 20 antes de la fecha de la eleccion, y seguira hasta las siete (7:00) P.M. de la tarde durante el dia de la eleccion. Dicho dependiente guardara abierta su oficina para este proposito durante las horas regulares de trabajo, y en todo caso, por 10 menos 8 horas cada dia que no sea sabado, domingo, 0 dia de vacacion oficial del estado. seccion 5: El cuarto de conferencia de la Ciudad de La Porte sera designado como la estacion central que recibe todos las balotas de dicha eleccion, y Cherie Black sera el juez prinicpal en esta estacion central. Dicha j euz puedra nombrar asi tentes para ayudar en recibir balotas y otros documentas y en asistiendo en otras hobras de la juez. El City Manager esta autorizado y direjido a obtener la maquinaria. El City Manager tambien nombrara un manager y un supervisor en cargo de tabulacion para hacer los cargos como designado por la ley y con respecto al proceso y tabulacion de balotas en la estacion centra. seccion 6: Que todas los materiales de la eleccion inclusive noticias de la eleccion, balotas, tarj etas instructi vas, atestaciones y otras formas que necesiten los votantes para firmar y todos los materiales de la votacion en ausencia se escriben en espanol e ingles, 0 sea que traducciones espanolas esten disponibles baj 0 las circunstancias permi tidas y de la manera requerida por la ley. Seccion 7: La secretaria de la ciudad de La Porte pronto dara noticias de dicha eleccion por causar que una porcion substanciel de esta ordenanza sea publicada en el mismo dia de dos semanas sucesivas en al Bayshore Sun, 10 cual por esto se halla y se declara un periodico de circulacion general en dicha cuidad, no menos de catbrce (14) dias ni mas de trenta (30) dias antes de la fecha de la eleccion. seccion 8: Al ofrecer un candidato su aplicacion en la forma requerida, la secretaria municipal dara a tal candidato toda la informacion tocante alas calificaciones referentes a la oficina deseada; el metoda de poner el nombre sobre la balota, cuanto cuesta para hacerse candidato, y otra informacion pertinente. seccion 9: Cada candidato para la oficina de alcalde 0 consejero tiene que ser residente que pueda votar de la ciudad. Cada candidato en busca de la oficina de consejero de distrito tambien tiene que vivir en ese distrito. Seccion 10: La feccha maS tarde en la que un candidato puede dar su aplicaqion para que aparezca su nombre en la balota para tal eleccion por esto se disigno y se establece come las 5 de la tarde, miercoles, el 21 de marzo, 1990. No se puede hacer aplicacion antes del 19 de febrero, 1990. El gasto para cada candidato deseando hacerse consejero por esto se establece como cincuenta dol ares ($50.00). Estos gastos se usaran para disminuir el coste de la eleccion, y dicho gastos se usaran de forma prorrata y si quede algo de los gastos, este de devolvera a dichos candidatos. En rez de pagar dicho cargo, un candidato puede podra obtener una e e Ordenanza Num 1676, Page 8 posicion en el boleto con la presentacion de una peticion como escrito en el Home Rule Charter de la Ciudad de La Porte, Article 2.04 c.3. Seccion 11: Oicha eleccion se celebrara conforme las provisiones de la carta municipal de la ciudad de La Porte, y las leyes generales electorales del estado de Tejas que gobiernan las elecciones generales y municipales, tanto que estas se aplican. seccion 12: Inmediatamente despues de dicha eleccion, los oficiales contaran y entregaran los resultados y records acompanantes de uso en el cuente oficial al ayuntamiento de la ciudad de La Porte, y el ayuntamiento contara estos resultados tan pronto posible, entonces inmediatamente declarara los resultados de la eleccion. Entonces el alcalde inmediatamente dara al candidato que gano la mayoria de la votacion en cada lugar de votacion un certificado de eleccion. Tales oficiales eligidos tomaran sus tareas dentro de diez (10) dias, no inclusive los domingos, al tomar su juramiento de oficina. seccion 13: Cada y toda provision, parrafo, oracion, y clausula de esta ordenanza ha sido seperadamente considerado y pasado por el ayuntamiento de la ciudad de La Porte, Tejas, y cada dicha provision hubiera sido pasada seperadamente sin otra provision cualqUiera, y si una provision de esta resulte inefecti va, inval ida, 0 contra la consti tucion, no importa la causa, esto no danara 0 afectara la porcion que queda, ni ninguna otra parte, sino la porcion valida quedara en vigor como si la hubieran pasado por si sola. seccion 14: Esta ordenanza estara efectiva inmediatamente despues de ser y pasada aprobada. Seccion 15: El ayuntamiento oficialmente halla, determina, recita, y declara que noticias escritas suficientes de la fecha, la hora, el lugar, y el sujeto de esta reunion del ayuntamiento fueron puestas en un lugar conveniente al publico en la casa del ayuntamiento de la ciudad durante tiempo requerido por la ley antes de esta reunion, como requerido por la ley de las sessiones abiertas, articulo 6252-17, las leyes tejanas civiles revisadas anotadas: y que esta session ha estado abierto al publico todo el tiempo cuando esta ordenanza y otras coas tocante a esta han sido discutidas, consideradas, 0 cuando se han tomado acciones oficiales tocante a esta, como requerido por la ley.
