RESOLUTZON NO. 96-~ A RESOLUTION ESTABLISHING THE POLZCY 01' THE CITY COUNCIL 01' THB CITY OF LA PORTE CONCERNING AN AGREEMENT WITH SOUTHERN PACIPIC TRANSPORTATION COMPANY; PZNDING COMPLZANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EPPECTIVE DATE HEREOP. BE IT RESOLVED BY THE CZTY COUNCIL 01' THE CITY 01' LA PORTE: Section 1. The City of La Porte (hereinafter "City") and Southern Pacific Transportation Company, a Delaware corporation (hereinafter liS. P. ") are currently in negotiations for an Agreement concerning S.P.'s 219 acre tract in the City of La Porte. A true and correct copy of a discussion draft of said Agreement is attached to this Resolution as Exhibit "A" , incorporated by reference herein, and made a part hereof for all purposes. section 2. The City Council of the City of La Porte, by the passage of this Resolution, expresses its policy and the sense of the City Council, that an ordinance approving the final version of an Agreement in substantially the form of the discussion draft of Agreement attached hereto as Exhibit "A", incorporated by reference herein, and made a part hereof for all purposes, shall be passed and approved by the City Council of the City of La Porte upon completion of negotiations between representatives of City and S.P., of a final version of said Agreement, and completion of survey and supporting documentation. section 3. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the ci ty for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required . . RESOLUTION NO. 96-~ paqe 2 by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. section 4.
