ORDINANCE NO. 1711
AN ORDINANCE VACATING, ABANDONING, AND CLOSING A DRAINAGE EASEMENT,
16 FEET WIDE, ACROSS A PORTION OF TEXAS AVENUE IN THE CITY OF LA
PORTEJ FINDING COMPLIANCE WITH THE OPEN MEETINGS LAWJ AND PROVIDING
AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte, on
December 17, 1980, passed and approved Ordinance No. 1242, an
ordinance vacating, abandoning, and closing a portion of Texas
Avenue in the City of La Porte. Ordinance No. 1242 retained, on
behalf of the City of La Porte, a drainage easement, 16 feet wide,
across that portion of Texas Avenue described by metes and bounds on
Exhibit nAn attached hereto, incorporated by reference herein, and
made a part hereof for all purposes.
Section 2. The City Council of the City of La Porte finds,
determines, and declares that the 16 foot drainage easement,
heretofore retained, is no longer suitable, needed, or beneficial to
the public as a drainage easement, and that the closing of the
hereinafter described 16 foot drainage easement on said portion of
Texas Avenue in the City of La Porte, is for the protection of the
public and for the public interest and benefit, and the hereinafter
described 16 foot drainage easement is hereby permanently vacated,
abandoned, and closed by the City of La Porte.
Section 3.
The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes AnnotatedJ and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 4. This Ordinance shall be effective from and after.
its passage and approval, and it is so ordered.

by metes and bounds as follows:
BEGINNING at the northwest corner of block 1120 of the Town of La Porte, said
point being in the south right-of-way line of "K" Street;
THENCE West with the south right-of-way line of IlK" Street a distance of 60 feet
to the northeast corner of Block 1122 of the Town of La Porte;
THENCE continuing West with the south right-of-way line of IIK" Street and the
north line of Block 1122 a distance of 56 feet;
THENCE South over and across Block 1122 a distance of 400 feet to the
north line of "L" Street;

THAT ROY D. KAYLOR, hereinafter called the Grantor, for and in
consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration, cash to us in hand paid by the CITY OF LA
PORTE, a municipality, the receipt and sufficiency of which is
hereby acknowledged and confessed, have this day GRANTED, BARGAINED,
SOLD AND CONVEYED and by these presents do GRANT, SELL AND CONVEY
unto said CITY OF LA PORTE, TEXAS, and to its successors and assigns
the perpetual right, privilege and easement, with appropriate rights
of ingress and egress and reasonable working area for construction
and maintenance, to enter upon and construct, reconstruct, maintain,
operate, inspect, replace, repair and remove water and wastewater
facilities, together with all necessary improvements over, across,
through and under those certain tracts or parcels of land lying and
being situated in Harris County, Texas and being more particularly
described on Exhibit "A" attached hereto and made a part hereof for
all purposes.
TO HAVE AND TO HOLD the above described easement, together with all
and singular the rights and appurtenances thereto in anywise
belonging unto said CITY OF LA PORTE, TEXAS, its successors or
assigns, in accordance with the terms and conditions hereinabove set
forth. The GRANTOR does hereby bind itself, its successors or
assigns to WARRANT AND FOREVER DEFEND, all'and singular the said
easement unto the said CITY OF LA PORTE, TEXAS, its successors or
assigns, against every person whomsoever lawfully claiming or to
claim the same or any part thereof.
