ORDINANCE NO.1726
AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BY AND BETWEEN THE
CITY OF LA PORTE AND EDWARDS PARKING LOT & MAINTENANCE, FOR
APPLICATION OF SEAL COAT, CRACK SEALER, AND STRIPING, TO PARKING
LOTS AT CITY HALL AND FAIRMONT PARK RECREATION AREA, FOR ESTIMATED
CONTRACT AMOUNT OF $13,262.40; MAKING VARIOUS FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement or other undertaking described in the title of
this ordinance, in substantially the form as shown in the document
which is attached hereto and incorporated herein by this reference.
The Mayor is hereby authorized to execute such document and all
related documents on behalf of the City of La Porte. The City
Secretary is hereby authorized to attest to all such signatures and
to affix the seal of the City to all such documents.
Section 2.
The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Proposal of Elmer EdwarQs (hereinafter called
"Bidderl,_) * a corporation, organized and existing under the laws
of the state of. Texas ,* a partnership, or an individual
doing business as Edwards Parking Lot Maintenance. To the
City of La Porte (hereinafter called "Owner").
Gentlemen:
The Bidder, in compliance with your invitation for bids for the
slurry seal of the City Hall & Fairmont Park Parking Lots. Having
examined the plans and specifications with related documents and
the site of the proposed work, and being familiar with all of the
conditions surrounding the construction of the proposed project
including the availability of materials and labor, hereby proposes
to furnish all labor, materials, and supplies, and to construct the
project in aqcordance with the contract documents, within the time
set forth therein, and at the prices stated below. These prices
are to cover all expenses incurred in performing the work required
under the contract documents, of which this proposal is a part.
Bidder hereby agrees to commence work under this contract on a
before a date to be specified in written "Notice to Proceed" of the
Owner andtQ fully complete the project within 15 calendar days
thereafter as stipulated in the Special Conditions. Bidder further
agrees to pay as liquidated damages, the sum of $100.00 for each
consecutive calendar day thereinafter as hereinafter provided in
the General Conditions.

To whom it may concern;
This is a alterant bid for project 90-2203
We propose to use a cold tar emulsion asphalt sealer that
will meet goverment specifcations with sand and tuff coat added.
The price for this will be 12~ a square foot. All stripping
and crack filler will be at no charge_

The foregoing unit prices shall include all labor, materials,
equipment, bailing, shoring, removal; overhead, profit, insurance,
etc., to cover the finished work.
Bidder understands that the Owner reserves the right to reject any
or all bids and to waive any informalities in the bidding.
The bidder agrees that this bid shall be good and may not be
withdrawn for a period of 30 calendar days after the scheduled
closing time for receiving bids.
Upon receipt of written notice of the acceptance of this bid,
bidder will execute the formal contract attached within 10 days and
deliver a Surety Bond or Bonds as required by the General
Conditions. The bid security attached in the sum of
($663.00.' ) is to become the property of the Owner in the
event the contract is not executed within the time above set forth,
as liquidated damages for the delay and additional expense to the
Owner caused thereby.

CERTIFICATE FOR ORDINANCE

I' We, the undersigned being the duly acting Mayor and City Secretary of the City of
La ~oi'le, Texas (the "City"), hereby certify as follows:
1. The City Council of the City (the "Council") convened in regular session, opcn to the
public, on September 27, 1990, at the mceting place designated in the notice (the "Meeting"). and
the roll was called of the members, to wit: Norman Malone, Mayor, and the following City
Councilmembers: Deotis Gay, B. Don Skelton, Ed Matuszak, Guy Southerland, Alton Porter,
Edward G. Clarke, Michael Cooper, and Bob McLaughlin. All members of the Council were
present, except Matuszak. Cooper, and McLaughlin , thus
constituting a quorum. Whereupon among other business, the following was transacted at the
Meeting a written ordinance, entitled: ORDINANCE AUTHORIZING THE ISSUANCE OF
$1,500,000 CITY OF LA PORTE, TEXAS, GENERAL OBLIGATION BONDS, SERIES 1990;
EXECUTION OF A PAYING AGENTIREGISTRAR AGREEMENT; AND ALL OTHER
MAlTERS RELATED TIIERETO, INCLUDING IMMEDIATE EFFECfIVENESS (the
"Ordinance") was duly introduced for the consideration of the Council and read in full. It was then
duly moved by Councilmember Skelton and seconded by Councilmember Gay
that the Ordinance be finally passed and adopted and become immediately effective; and, after due
discussion, such motion, carrying with it the adoption of the Ordinance prevailed and carried by
the following vote:

2. A true, full, and correct copy of the Ordinance adopted at the Meeting is attached to
and follows this Certificate; the Ordinance has been duly recorded in the Council's minutes of the
Meeting; the above and foregoing paragraph is a true, full, and correct excerpt from the Council's
minutes of the Meeting pertaining to the adoption of the Ordinance; the persons namcd in the
above and foregoing paragraph are duly chosen, qualified, and acting officers and members of the
Council as indicated therein; each of the officers and members of the Council was duly and
sufficiently notified officially and personally, in advance, of the time, place, and purpose of the
Meeting, and that the Ordinance would be introduced and considered for adoption at the Meeting
and each of such officers and members consented, in advance, to the holding of the Meeting for
such purpose; and the Meeting was open to the public, and public notice of the time, place,
purpose of the Meeting was given, all as required by Article 6252-17, Vernon's Texas Civil Statutes,
as amended.
3. Cherie Black is the duly appointed and acting City Secretary of the City.
