ORDINANCE NO. 1846
AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY
OF LA PORTE AND ALL TEXAS DEMOLISHING, FOR DANGEROUS BUILDING
DEMOLITION1 APPROPRIATING NOT TO EXCEED $10,801.00 TO FUND SAID
CONTRACT 1 MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT1 FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW 1 AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the
contract, agreement or other undertaking described in the title of
this ordinance, in substantially the form as shown in the document
which is attached hereto and incorporated herein by this reference.
The City Manager is hereby authorized to execute such document and
all related documents on behalf of the City of La Porte. The City
Secretary is hereby authorized to attest to all such signatures and
to affix the seal of the City to all such documents. City Council
is authorized to appropriate the sum not to exceed $10,801.00, to
to fund said contract.
Section 2.
The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated1 and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

SPECIFICATIONS
DEMOLITION OF BUILDINGS
BID #0483
BID CERTIFICATIONS
In submitting this bid, I hereby certify:
That the prices in this bid have been arrived at independently,
without consultation, communication, or agreement, for the purpose
of restricting competition, as to any matter relating to such
prices with any bidder or with any other bidder or with any
competitor.
SUBCONTRACTOR/CONSULTANT
Indicate in your proposal or bid, the use of subcontractors or
consultants, if any. Describe the function, work, or services and
identify the name, address, qualifications and experience of the
subcontractor or consultant.
CASHIER'S CHECK
Contractor, concurrent with his bid, submits a cashier's check in
the amount of five hundred ($500.00) dollars made payable to the
City of La Porte. Checks of unsuccessful bidders will be returned
promptly following approval of a signed contract. Failure on the
part of the successful contractor to furnish the above referenced
documents within 30 days after approval of award may constitute
forfeiture by the contractor of the above mentioned cashier's check
and retention of the same by the City as liquidated damages. No
plea of error or mistake shall be available to the contractor as
basis for the release of his cashier's check.
PRICE
Quote your best net price for each item; Uni t price for each
(price/element/item) shall include all discounts, e.g. trade,
payment, etc.
INSURANCE CERTIFICATE
Contractor, concurrent with his bid, hereby submits Insurance
Certificate in accordance with the terms and conditions required
herein. No bid shall be considered unless accompanied by said
completed and executed certificate.
CONTRACTOR AGREES TO ALL THE TERMS AND CONDITIONS WITHIN THIS BID
INVITATION AND SUBMITS A BID FOR THE DEMOLITION OF THE FOLLOWING
SUB-STANDARD STRUCTURES.

Whi te single story fraine house. Block foundation with
concrete porch slab, transite siding.* Remove out building,
remove front fence and remove trash and debris.
3) 625 N. Broadway
White single story house. Block foundation.
4) 210 W. Polk
White single story house. Block foundation.
5) 224 N. 6th Street
Gray single story house. Block foundation.
6) 2512 Westview
Single story frame house. Block foundation. Remove accessory
building and animal cages; remove front and back fence; and
remove trash, debris and scrub growth.
7) 609 S. Utah
White single story frame house. Block foundation. Remove
concrete driveway and garage slab and remove all fencing that
is not common with adjoining properties.
8) 921 Oakgrove
Brown single story frame house. Block foundation. Remove
dead tree. Use care to prevent any debris from falling into
bayou.
9) 1039 San Jacinto
Building has been substantially demolished. Complete
demolition of brick structure. Remove all concrete slabs.
Complete any remaining site cleanup.
10) 511 Circle Drive
White single story frame duplex. Block foundation. Rem~.
concrete sidewalk. CAUTION: Active bee colony in back wall.....
of house. NOTE: Metal storage building behind house is on
adjoining property. This building is NOT to be demolished.
* 'These buildings are sided with transite siding. The
Environmental Protection Agency has designated transi te siding
as a Category II A.C.M. (Asbestos Containing Material). This
material must be removed from the building prior tQ
demolition. Siding must be wet down and kept wet during
removal. There are no special disposal requirements for
Ca tegory I I A. C . M . whi ch has been removed in the manner
specified above. .

SPECIAL TERMS AND CONDITIONS
LENGTH OF CONTRACT
The terms of the contract shall be for a period o,f sixty (60)
working days inclusive of weekends and holidays.
TERMIJlATION OF COJn'RACT
1. Should it be necessary to terminate this contract, with or
wi thout cause, for any reason, t!=!n (10) days notice by
. certified mail to the Contractor by the City of La Porte shall
constitute no~ice anq ~e~~i~atio~.
2. Should the Contractor fail to co~plete all specified work
within the sixty (60) days allocated by the contract, the City
shall require the Contractor to pay a daily penalty of fifty
dollars ($50.00). Said penalty shall be paid for each day
beyond the specified contract period necessary for job
completion. .
3. Right to Assurance. Whenever the City in good faith has
reason to question the Contractor's intent to perform, the
'City may demand that the Contractor give written assurance of
his intent to perform. In the event that a demand is made and
no assurance is given within five (5) days the City may treat
this failure as an anticipatory repudiation of this contract.
WORK TO BE PERFORMED
1. All foundations, base walls, and steps must be completely
removed, and all basements, if any, shall receive a complete
solid fill; and foundations, slabs, piers and beams must be
removed from the site. All materials, fixtures, and debris
shall be removed from the site, except as herein provided, and
the entire parcel shall be left in a clean and orderly
condition. The site shall be filled and graded as needed to
prevent water from accumulating and stagnating. Compliance
inspections will be made by the Inspection Division.
2. Notwithstanding the fact that a particular lot or parcel has
been designated for demolition and clearing operations, the
Contractor shall not enter upon or begin clearance work upon
ariy lot or parcel which appears to have been recently cleared
or is in the process of being cleared by the landowner, his
agent, employee or independent contractor; instead, Contractor
shall immediately inform the Inspection Division of such
finding and move on to the next designated lot unless
otherwise directed by same.

NOTE: Any structure where the extent of work has been reduced by
the landowner, his agent, employee, or independent contractor
shall be renegotiated, as to bid price, by the City prior to
the commencement of any demolition by the successful bidder.
DISCONNECTION OF UTILITIES
The City shall be responsible for having all utilities removed from
buildings to be demolish~d.
CONTRACTUAL PAYMENTS
1. City of La Porte agrees to pay the Contractor, in accordance
with Bid Sheet and the schedule and guidelines herein
provided, a certain sum per structure upon the execution and
completion of the work outlined and set out in this contract.
One payment shall be made wi thin two (2) weeks of the
completion of all work required by this contract. Payment
upon completion shall be made only after inspection and
approval of all work required herein by the Inspection
Division.
2. The Contractor shall report lots or parcels that have been
cleared to the Inspection Division staff at least once every
three (3) days. No property shall be reported by Contractor
as cleared until work on such lot or parcel is completed.
COMPLIANCE WITH ALL LAWS
All of the Contractor I s operations shall be performed in such
manner as to comply with all United States and State of Texas Laws,
and with all ordinances of the City of La Porte.
BOND AND INSURANCE REQUIREMENTS
1. All contractors shall furnish Public Liability Insurance to
the extent of $50,000.00 for anyone (1) accident and
$100,000.00 for anyone (1) person and also Property Damage
Insurance to the extent of $10,000.00 for each occurrence and
$100,000.00 in the aggregate.
2. All Contractor's employees used in the performance of this
agreement shall be covered by Workmen's Compensation Insurance
per statutory requirements.
4. Contractor shall furnish bond and insurance certificate( s) ..,
executed by, an insurance company authorized to do business in
Texas as proof of the requirements of above Sections 1., 2.,
and 3. and further, such certificate(s) shall provide that the
coverage required herein shall not be reduced or cancelled
without thirty (30) days advance written notice to the City
Manager or his designee.

HOLD HARMLESS
Contractor agrees to indemnify and hold harmless the City of La
Porte against any and all losses, damages, or claims arising out of
his operations, including, but not limited to, damage or injury to
realty, trees, shrubs, and wood vines.
OTHER PROVISIONS
1. No subcontracting of any or part of the Contractor's tasks
noted herein shall be performed without the express written
approval of the City Manager or his designee and Contractor
shall not assign any of the rights and privileges granted
herein without first having obtained the written consent of
the City Manager or his designee.
