HomeMy WebLinkAboutO-2005-2843 e e ORDINANCE NO. 2005-~ AN ORDINANCE APPROVING AND AUTHORIZING A WATER SERVICE AGREEMENT BETWEEN THE CITY OF LA PORTE AND BAlCER PETROLITE CORPORATION J MAlCING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECTJ FINDING COMPLIANCE WITH THE OPEN MEETINGS LAWJ AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by the reference. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. The City Manager is hereby authorized to execute said contact, agreement, or other undertaking described in the title of this ordinance. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting ha~ been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Askins City Attorney e - ORDINANCE 2843 PASSED SEPTEMBER 12, 2005 This Ordinance was passed at the September 12, 2005 City Council meeting. The caption was correct and read correctly in the minutes. However, in the body of the ordinance it had an error stating the City Manager was authorized to attest. It should read the City Manager is authorized to execute agreement and the City Secretary shall attest. Since this change does not change any portion of the agreement. The wording was changed after approved at the meeting. The original copy and the corrected copy will be retained as a permanent record along with this letter. Area Map Budgeted Item: _YES ..K.....NO SUMMARY & RECOMMENDATION Baker Petrolite Corporation has recently approached the City to provide water service to serve its facility at 13200 Bay Park Road in the Bayport Industrial District. Council has approved a policy to provide utility services to companies located outside city limits and within the City's industrial districts. These companies are required to maintain a current Industrial District Agreement with the City. Baker Petrolite Corporation has in-place a current Industrial District Agreement and desires to pursue water service under the teRns of the aforementioned policy. Based on the company's stated demand for domestic uses, the average daily demand for water is 10,000 gallons per day. The applicant will pay one and one-half (1-%) times the City's current utility rate. The company is subject to administrative connection charges in the amount of $15,000. Additionally, Baker Petrolite is assessed a pro-rata reimbursement charge in the amount of $44,228.88 for utilization of a water main previously extended by Akzo Nobel Chemicals, Inc. under a previous Utility Extension Agreement. Payment in the total amount of $5~8.88 has been received from Baker Petro lite Corporation. The teRn of the Water Service Agreement expires on December 31, 2007, plus any renewals and extensions thereof. However, the agreements shall automatically expire at such time as there is no effective Industrial District Agreement between the parties or if the city exercises the right of teRnination. Staff recommends approval of the Water Service Agreement as submitted herein.
