AN ORD,INANCE APPROVING AND AUTHORIZING A RENEWAL AND
EXTENSION OF THE WATER SERVICE AGREEMENT BETWEEN THE CITY OF
LA PORTE AND UNITED RENTALS :EQUlPMENT, FOR A TERM COMMENCING
UPON THE EFFECTIVE DATE OF PASSAGE AND APPROVAL OF TillS
ORDINANCE AND EXPIRING ON DECEMBER 31, 2007; FINDING COMPLAINCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the contract, agreement,
or other undertaking described in the title of this ordinance, in substantially the form as shown in
the document which is attached hereto and incorporated herein by this reference. The Mayor is
hereby authorized to execute such document and all related documents on behalf of the City of
La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the
seal ofthe City to all such documents.
Section 2. The City Council officially finds, determines, recites, and declares that a
sufficient written notice of the date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas
Government Code; and that this meeting has been opened to the public as required by law at all
times during which this ordinance and the subject matter thereof has been discussed, considered
and formally acted upon. The City Council further ratifies, approves and confrrms such written
notice and the contents and posting thereof

This ordinance shall be effective from and after its passage and approval,

SUMMARY & RECOMMENDATION
Summary:
The City is in the process of reviewing current utility service agreemwts with its industrial district customers to
determine which agreements have expired or are due to expire within the coming months.
The United Rentals Equipment Corporation has an Industrial District Agreement (IDA) with the City that is valid
through December 31, 2007. Howcver, the term of its current Water Service Agreanent (WSA) with the City expires
on July 24, 2005. '
It is the City's desire to create concurrent tenns for both of the agreements. In order to achieve this, renewal of United
Rentals WSA will be considered at the time of its lOA rcoewal in January of 2008. It is anticipated that each
agreemcnt will share the same seven (7) year tenn depending on the City's ability to continue to supply water.
Staff has contacted the United Rentals Equipment Corporation rcgarding extending the current tenll of its WSA The
United Rentals Equipment Corporation is agreeable to thc extension of its current WSA through December 31, 2007.
Recommendation:
Staff recommends approval of an ordinance to extend thc current term of United Rentals Equipment COIporation's
Water Service Agreement through Dccemba- 3 I, 2007.
Action Required of Council:
Consider approval of an ordinance authorizing the City Manager to enter into an agreement with the United Rentals
Equipment Corporation to extend the terms of its current Water Service Agreement through December 31, 2007,
