HomeMy WebLinkAboutO-2004-2787 e e ORDINANCE NO. 2004-~:r~ AN ORDINANCE ACCEPTING THE RESIGNATION OF LOUIE A. DITTA AS JUDGE OF THE MUNICIPAL COURT, APPOINTING DENISE C. MITRANO AS JUDGE OF THE MUNICIPAL COURT, EFFECTIVE JANUARY 1, 2005, FOR A TERM EXPIRING AUGUST 31, 2007, OR UNTIL HER SUCCESSOR SHALL HAVE BEEN DULY APPOINTED AND QUALIFIED, PROVIDING A SEVERABILITY CLAUSE, CONTAINING A REPEALING CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1a The City Council of the City of La Porte hereby accepts the resignation of Louie A. Ditta as Judge of the Municipal Court, effective December 31, 2004. Section 2a The City Council of the City of La Porte hereby appoints Denise C. Mitrano as Judge of the Municipal Court, effective January 1, 2005, for a term expiring August 31, 2007, or until her successor shall have been duly appointed and qualified. Section 3. Judge Denise C. Mitrano shall serve at the pleasure of City Council, and shall receive compensation as may be fixed by City Council. Section 4a If any section, sentence, phrase, clause or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section Sa All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. e e Section 60 The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 7. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. Section 8. '.-~i...4 Dear Mayor Porter: In April 2002, the Mayor and Council of the City of La Porte offered me the distinct honor to serve as . the Presiding Municipal Court Judge with the challenge of bringing new ideas and greater efficiencies to the Municipal Court. As you may recall, I accepted the challenge with a specific purpose of providing an efficient and effective Court operation that is fair and accessible to everyone. During my term as Presiding Judge, the Court has experienced significant change and I am proud of the Court Staff for their ability to implement and adapt to these changes. Over the last two and a half years, we have made significant improvements in the services offered to the public including providing more information on how to take care of Court business and expanding the options available for citizens to take care of their business prior to scheduled court dates. These improvements, combined with many others, have resulted in a substantial reduction in costs for Judicial and Prosecuting services for the City of La Porte. The time I have served as Presiding Judge has been rewarding to me personally and professionally and I thank you and the entire City Council for the honor and opportunity to serve the City of La Porte in this capacity. I am proud of our achievements and what we have been able to accomplish at the Court and I sincerely believe my purpose has been fulfilled. I offer this letter as my official intent to resign from the duties as Presiding Judge to be effective December 31, 2004. I believe this will be a sufficient amount of time for the Council to name my successor and provide me adequate time to work with my successor over the next ninety days to assure a smooth transition. In response to your inquiry concerning Judge Denise Mitrano and her performance as an Associate Judge for the last several years, I have complete confidence that she possesses the knowledge, skill and integrity to be an excellent Judge for the City of La Porte and I agree with your thoughts that her service would allow for a smooth transition. I feel certain that she would continue on the path to greater efficiency within the Court and continue the program that has been put into place during my term. I will certainly miss many of the people that I have had the pleasure of working with at the City of La Porte and I remain willing to assist the City in any way that I can. c-~ Cc: City Council Debra Feazelle
