HomeMy WebLinkAboutR-1994-09 -- e - RESOLUTION NO. 94- 09 ( A RESOLUTION REQUBSTING PRIME CABLE, THE CITY'S pRANCHISED CABLE TELEVISION OPBRATOR, TO RECONSIDER ITS DECISION TO DELETE C-SPAN AND CNBC FROM ITS PROGRAMMING TO ITS LA PORTE SUBSCRIBERS; FINDING COMPLIANCE WITH THE OPEN 'MEETINGS LAW; AND PROVIDING AN EppECTIVE DATE HEREOF. BE IT RESOLVED BY THE CITY COUNCIL 01' THE CITY 01' LA PORTE; Section 1. Prime Cable offers cable television programming to subscribers in the City of La Porte under franchise from the City of La Porte. On September 9, 1994, Prime Cable dropped C- SPAN, a cable television channel offering public affairs programming and coverage of the Uni ted States House of Representatives; and CNBC, a financial and public affairs programming cable network; from its programming for its subscribers in the City of La Porte, to make room for local stations whose signals Prime Cable is required to carry by federal law. However, the choice of channels to be deleted to accommodate the local stations, was a policy decision made by Prime Cable, in its sole discretion. Section 2. Although the City of La Porte does not have legal jurisdiction to control the programming offered by Prime Cable, the City of La Porte nevertheless respectfully requests and urges Prime Cable to reconsider its decision to drop C-SPAN and CNBC. The City of La Porte has received communications from many of its citizens who are subscribers to Prime cable, complaining of the actions of Prime Cable in dropping C-SPAN and CNBC from its cable lineup, rather than other programming. Section 3. In view of the overwhelming response from Prime Cable subscribers, the City Council of the City of La Porte . e RESOLUTION NO. 94-09 PAGE 2 respectfully urges Prime Cable to reconsider its decision, and to reinstate C-SPAN and CNBC to its cable lineup in the City of La Porte. section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5.
