WHEREAS, the City Council of the City of La Porte, passed and approved Section 82- 472 of the Code of Ordinances as amended by Ordinance #04-2700, that passed and approved on January 26, 2004, creating a Dangerous Building Inspection Board (the Board) to be composed of the Building Official or hislher duly authorized representative, the Fire Chief or hislher duly authorized representative, the Fire Marshal or his/her duly authorized representative; and WHEREAS, Section 82-474 (a) of said section as amended by Ordinance #04-2700 provides that: Whenever it shall come to the attention of the Board or any member thereof, by reason of the carrying out of the necessary duties of such member, or by reason ofa complaint of any citizen of the City or of the City Council, that a dangerous building exists, the Board shall, make a thorough inspection of such building; and WHEREAS, Section 82-474 (e) of said section as amended by Ordinance #04-2700 provides that: After the inspection provided for in this Section has been made, with or without the aid of experts, the Board shall report its conclusion in writing to each of the members of the City Council and to the City Attorney. Such report shall state the circumstances and the condition of the building upon which such conclusion was based. The report shall be filed in all cases no matter what conclusion is stated by the Board; and WHEREAS, it has heretofore come to the attention of the Board that the building located on Block 87. The nails used appear to be electro plated and if so, must be replaced with hot dipped galvanized nails. 3) Weather seal in various locations needs to be replaced. This requires removal of siding. 4) Beam at kitchen not to code. 5) No windstorm clips or bracing in building. 6) Hot water heater not accessible as per code 7) Provide workspace in front of air handler as per code. Seguin. TX 78155-3112. that a hearing as provided in Section 82-477 of said Ordinance would be held at 604 W. Fairmont Parkway, at the Council Chambers, City Hal~ City of La Porte, Texas, at which time the Council would hear evidence for and against the conclusions of the Board; WHEREAS, the City Secretary has heretofore served notice of said hearing upon said owner( s), by registered mail, return receipt requested, which return receipt indicated that said owner(s) received said notice on Certified mail returned "unclaimed" on 8-2-2004. a date more than ten (10) days before the date set for said hearing; WHEREAS, at said date, time, and place, City Council met in regular session to conduct such public hearing, at which time evidence was presented both for and against the conclusions of the Board; WHEREAS, City Council, after due deliberation" and within fifteen (15) days after the termination of the hearing, is required to make its decision in writing and enter its order; and WHEREAS, City Council entered its order on August 23. 2004 a day which is within fifteen (15) days after the termination of the hearing; NOW TIIEREFORE: BE IT ORDAINED BY THE CITY COUNCn.. This Ordinance contains the Findings of Fact , Conclusions of Law, and orders of the City Council of the City of La Porte, based upon the evidence presented at said hearing. Section 2. Based on the evidence presented at said hearing, the City Council hereby adopts the attached report of the Board, in full~ and incorporates such by reference herein as fully as though set oui herein. . Section 3. The City Council hereby finds, determines and declares such building to be a nuisance, and orders such building condemned. Section 4. The City Council hereby finds, determines and declares that Stanley D. Sherwood. who resides at 121 Lake Forrest Dr.. Seguin. TX 78155-3112 and is the record owner(s) of the property on which this building is situated, and that as such record owner(s), the said Stanley D. Sherwood has been duly and legally notified of those proceedings. Section S. The City Council hereby orders the said Stanley D. Sherwood to entirely remove or tear down such building,. and further orders the said Stanley D. Sherwood to commence such removal within ten (10) days from the effective date of this Ordinance, and to complete such removal of demolition of such building within a reasonable time. Section 6. The.City CoUncil hereby orders the Board of the City of La Porte to cause a notice of the dangerous, unsanitary condition of the building to be affixed in one or more conspicuous places on the exterior of the building, which notice or notices shall not be removed or defaced by any person, under penalty of law. Section 7. The City Council hereby orders the City Secretary to forward a certified copy of this Ordinance, to the record owner(s) of said property, the said Stanley D. Sherwood. by registered mail, return receipt requested. Section 8. Should the said Stanley D. Sherwood. not comply with the orders contained in this Ordinance relating to the removal or demolition of such building within ten (10) days after hereof, then the Board of the City of La Porte shall enter upon the said premises with such assistance as it may deem necessary, and cause the said. building to be removed or demolished without delay, and the expenses of such procedure shall be charged against the said Stanley D. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 10. A regular meeting was held July 26,2004 to review the findings of the Dangerous Building Board of Inspections and to authorize a public hearing to consider these structures. Subsequent to this meeting, as required by Article vm; Section 82-475 of the Code Ordinances and amended by Ordinance #04-2700, a notice was published twice in the Bayshore Sun. Certified letters containing public notices were mailed to the owner(s) of the buildings in question. The purpose of this public hearing is to receive property owner and citizen comments as to why each of the structures should or should not be condemned and demolished. Following the close of the hearing, Council will be asked to consider condemnation of the structures. A separate ordinance is required to condemn each of the structures. As of the prepamtion of this request, all ten (10) structures remain and a condemnation ordinance has been prepared for each one. One complete ordinance is attached for reference. As the ordinances are all in a standardized fonn, in the interest of reducing the bulkiness of the agenda packet, only cover pages and inspection reports have been included for the other ordinances. The Dangerous Building Board of Inspection (Chief Building Official, Fire Marshal and Fire Chief) unanimously recommend that all ten (10) of the substandard structures be condemned and demolished. UNDERSTANDING THE ISSUES .:A Metal connectors, anchors, and fasteners will corrode and lose load carrying 'U capacity when installed in corrosive environments or exposed to corrosive . materials. There are many environments and materials which may cause corrosion including: . Ocean Salt Air . Fire-Retardants . Fumes . Fertilizers . Preservative-Treated Wood . Dissimilar Metals The many variables present in a single building environment make it impossible to accurately predict if, or when, significant corrosion will begin or reach a critical level. This relative uncertainty makes it crucial that the specifiers be knowledgeable of the potential risks and select a product coating or metal that is suitable for the intended use. Changes in the preservative-treated wood industry have created additional concerns. Effective December 31,2003, the preservative-treated wood indus- try VOluntarily transitioned from Chromated Copper Arsenate (CCA-C) used In residential applications 10 alternative treatments. Testing has shown that certain alternative replacement treatments are generally more corrosive than CCA-C. The corrosion performance of a hot-dip galvanized product is a function of the amount of zinc on its surface. Historically the connector industry has used products manufactured with a G60 coating which means 0.60 ozlft2 01 zinc. In recent years, Simpson made the decision to increase the minimum standard amount of zinc protection to a G90 coating, 0.90 ozlll'. This represents a 50 percent increase In protection versus the industry standard and is the minimum level of galvanizing provided on all Simpson galvanized products. Simpson also offers many products with ZMAX- which is a G185 coating, 1.85 ozlft'. Testing has shown that type 304 and 316 stainless steel products corrode substantially less than other alternatives when used with the alternative wood treatments. Simpson has a number of stainless sleel products available and recommends the use 01 stainless steel products and fasteners when possible. . If the pressure treated wood you are using does nol appear by name, then we recommend you use the "Other Pressure-Treated Woods" column and use only Stainless Steel connectors and lasteners. *' SIMPSON RECOMMENDATIONS . Grandsons (Brooks and Larry Willis) inherited property. Approximately 1 year ago, Brooks Willis signed a "general warranty deed" giving property to Larry Willis. Attorney was instructed to hold deed and not have it recorded. Copy of city paperwork was mailed to each grandson. Mr. Brooks Willis did not claim his mail but Larry Willis signed for his certified mail. Information was also mailed via regular mail, neither were returned. 102 So. Lobit See Attached Report. Staff met with owner, Mr. Stan Sherwood, and discussed walk-thru of property to determine extent of house damage. Approximately one month later, owner requested the walk- thru inspection from the city. Date ofwalk-thru inspection, city issued stop work order. Owner began repairing building without city permits or authorization. Also, manufacturer nailing specs were not followed. Wrong nails (standard) were used instead of the required hot-dip galvanized or stainless steel nails. Foreclosure sale is scheduled for Sept. 7th. Ifno one outbids them, they will purchase house and plan to repair house to code so they can sell property. They are asking for additional time. New owner, Mr. Carl Gold, called staff today. He received his letter from the title company saying the previous owner had completed signing the paperwork for the sale. Mr. Gold has no objection to the condemnation and will not be at tonight's meeting. He has plans to have the mobile home removed or demolish the structure himself. See Letter & Sale Contract Attached Owner, Mr. David Glatter, is deceased. Ms. Elizabeth Hilbun is representing the family at this time. Ms. Hilbun has a "contract of sale" scheduled for closing on 09-24-04. She plans to address Council tonight and ask for additional time. She has indicated the buyers are aware of city action.
