ORDINANCE NO. 2004 - ;J../1 it; , AN ORDINANCE APPROVING AND AUTHORIZING CHANGE ORDBR NO. 2 BBTWEEN THE CITY OF LA PORTE AND CRAIG, SHEFFIBLD & AUSTIN, INC., FOR THE LITTLE CBDAR BAYOU WASTEWATBR TREATMENT PLANT SOLIDS HANDLING IMPROVEMENT PROJBCT, APPROPRIATING THE SUM NOT TO BXCEED $33,053.00, TO FUND SAID CONTRACT, MAICING VARIOUS FINDINGS AND PROVISIONS RELATING TO THB SUBJECT, FINDING COMPLIANCB WITH THE OPEN MEBTINGS LAW, AND PROVIDING AN EFFECTIVE DATE HERBOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, a copy of which is on file in the office of the City Secretary. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. City Council appropriates the sum not to exceed $33,053.00 from City of La Porte Fund 43, Project No. 882, to fund said contract. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. , . Section 3. Change Order # I previously adjusted the contract approved by an additional $4,788 for replacement of electrical conduit previously specified to be reused, and the addition of an eye wash and safety shower in the dewatering building. During final start-up of major equipment, it was discovered that the Engineer had specified the wrong pumps and motors for the polymer system for the new belt filter presses. The COITect equipment was identified and ordered, and has recently been installed and tested. The Engineer has prepared Change Order #2 in the amount of$33,053.00 to replace two (2) previously installed polymer feed pumps, piping and associated controls and electrical modifications. These changes are necessary to allow the two (2) new belt filter presses to properly function. The City is contractually bound to pay the Contractor for the new installation. However, we will be meeting with the Engineer to establish the value of the original installation, looking to the Engineer to reimburse the City for these costs, as design eITor is at fault.
