HomeMy WebLinkAboutO-2005-1501-T4 large lot district ~ e <>10 e ORDINANCE NO. 1501 n AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY AMENDING ARTICLE I, SECTION 106-1, "DEFINITIONS"; BY AMENDING ARTICLE III, DIVISION I, SECTION 106-309, "LAND USE DISTRICTS"; BY AMENDING CHAPTER 106, ARTICLE III, DIVISION 2, SECTION 106-331, TABLE A, "RESIDENTIAL USES"; BY AMENDING CHAPTER 106, ARTICLE III, DIVISION 2, TO ADD A NEW SUBDIVISION VI "LL LARGE LOT DISTRICT" AND SECTION 1 06-416, "SPECIAL REGULATIONS"; BY AMENDING ARTICLE II, DIVISION 6, SECTION 106-191, "SPECIAL EXCEPTIONS", AND BY AMENDING CHAPTER 106, ARTICLE V, DIVISION 2, SECTION 106-741 "GENERAL PROVISIONS"; BY CHANGING THE ZONING CLASSIFICATION FROM LOW DENSITY RESIDENTIAL AND MEDIUM DENSITY RESIDENTIAL TO LARGE LOT, INCLUDING AREA GENERALLY BEING DESCRIBED AS BOUNDED TO THE WEST BY UNDERWOOD ROAD, NORTH BY SH 225, EAST BY SENS ROAD, AND SOUTH BY SPENCER HIGHWAY; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: "Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit, on the 15th day of September 2005, at 6:00 p.m. a Public Hearing was held before the Planning and Zoning Commission of the City of La Porte, Texas, pursuant to due notice as required by the Open Meetings Law, Chapter 551, Texas Government Code, to consider the question and the possible reclassification of the zoning classification of the hereinafter described parcels of land. There is attached to this Ordinance as Exhibit "A", and incorporated by reference herein and made a part hereof for all purposes, a copy of Notice of Public Hearing which the City Council of the City of La Porte hereby finds was properly mailed to all owners of all properties located within two hundred feet (200') of the properties under consideration. The publisher's affidavit of publication of notice of said hearing is attached hereto as Exhibit "B", incorporated by reference herein and made a part hereof for all purposes. "Section 3. Immediately following such public hearing on September 15, 2005, the Planning and Zoning Commission of the City of La Porte met in regular session to consider changes in classification, which were the subject of such public hearing. The City Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Commission, by letter dated September 30,2005, a true copy of which letter is attached hereto as Exhibit "C", incorporated by reference herein and made a part hereof for all purposes. "Section 4. Subsequent to receipt of the recommendation of the City of La Porte Planning and Zoning Commission, the City Council of the City of La Porte called a public hearing on the proposed classification changes and the recommendation of the Planning and Zoning Commission on the 24th day of October, 2005, at 6:00 p.m., and pursuant to due notice, to consider the recommendation of the Planning and Zoning Commission regarding the possible reclassification of the zoning classification of the hereinafter described parcels of land. There is attached to this Ordinance as Exhibit "on, incorporated by reference herein and made a part hereof for all purposes, a copy of the notice of public hearing. "Section 5. The publisher's affidavit of publication of notice of said hearing is attached hereto as Exhibit "En, and incorporated by reference herein and made a part hereof for all purposes. "Section 6. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission by amending Article I, Section 106-1, Definitions, by amending Section 106-309, Division I, Land Use ORDINANCE NO. 150~ Page 3 e Districts; by amending Chapter 106, Article III, Districts, Division 2, Section 106-331, Table A, Residential Uses; by adding a new Section 106-416, Special Regulations, and by amending Chapter 106, Article V, Division 2, Section 106-741 to read in accordance with Exhibit "F", attached hereto and incorporated by reference herein as if set forth verbatim. "Section 7. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, by changing the zoning classification of the hereinafter described parcels of land, situated within the corporate limits of the City of La Porte, from Low-Density Residential (R-1) and Medium Density Residential (R-2) to Large Lot Residential District (LL). The description of said parcels of land rezoned is as follows, to-wit. "An area generally being described as bounded to the West by Underwood Road, to the North by SH 225, to the East by Sens Road, and to the South by Spencer Highway, as more particularly set forth on the map attached hereto as Exhibit "G". "Section 8. The City Council of the City of La Porte hereby finds, determines, and declares that all prerequisites of law have been satisfied and hereby determines and declares that the amendments to the City of La Porte Zoning Map and Classification contained in this Ordinance as amendments thereto are desirable and in furtherance of the goals and objectives stated in the City of La Porte's Comprehensive Plan. "Section 9. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the .. . . The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. "Section 10. After a careful consideration, the Planning and Zoning Commission, by a vote of 5-1, recommended approval for creation of large Ipt district (minimum lot size I-acre) and additional 'regulations. The opposing vote was in favor of creating the district with a minimum ~ acre lot. In addition, the motion to adopt boundaries and the motion to rezone from R-l and R-2 to LL were unanimous (6-0) votes. Such industrialized house or building must bear a T.D.L.R. approved decal or insignia permanently affixed to each transportable section or component of each industrialized house or building to indicate compliance with the state standards. An industrialized house or building is not a mobile or manufactured home as defined herein. Landscaped means adorned or improved by contouring land and placing thereon live flowers, shrubs, trees, grass, wood, stone, and ponds or streams. Light truck means any truck, as defined in this chapter, with a limited manufacturers rated carrying capacity. This definition is intended to include those trucks with such rated carrying capacity being not in excess of one ton, panel delivery trucks and carryall trucks. Loading berth means a parking area provided for commercial motor vehicles, designed for the receipt or distribution by such vehicles of materials or merchandise to or from the use to which such parking area is accessory. Lot area per dwelling unit means the lot area required for each dwelling unit located on a building lot. Lot, corner means a building lot situated at the intersection of two existing or proposed street rights-of-way, the interior angle of such intersection not exceeding 135 degrees. Lot coverage means the area under roof on any given lot. Lot, depth means the mean hOlizontal distance between the front lot line and the rear lot line ofthe building lot measured within the lot boundary. Lot, interior means a building lot other than a corner lot. Lot line means a boundary of a building lot. Lot line,front means that boundary of a building lot which is the line of an existing or dedicated street. Upon comer lots either street line may be selected as the front lot line providing a front and rear yard are provided adjacent and opposite, respectively to the front lot line. Lot line, rear means that boundary of a building lot which is most distant from and is, or is most nearly parallel to the front lot line. Lot line, side means any boundary of a building lot which is not a front lot line or a rear lot line. . Lot of record means an area of land designated as a lot on a plat of a subdi vision recorded pursuant to statutes of the state with the county clerk or an area of land held in single ownership described by metes and bounds upon a deed recorded or registered with the county clerk. Lot, residential large means a homesite for a single-family home that is comprised of at least one acre (43,560 square feet). Minimunl10t width shall be 90 feet. FOR PROPOSED LOMAX (ONE ACRE MINIMUM) The establishment of large lots (one acre) would be a relatively simply task if starting from completely undeveloped land. The implementation of new lot minimums on land that has been surveyed out and developed for nearly a century would be a daunting and costly task. Major Problems: 1) The one (1) acre minimum lot size would severely limit the potential for growth in the Loma.:y; area. 2) It would cause a greater strain on the City of LaPorte tax base. t. I e e Background 1) Lomax annexation a) The agreement with City of Deer Park The tax base for the city of Lomax would only support a bond issue for one (1) million dollars. This was only sufficient capital to install the water and sewer lines, not the water well and sewer treatment plant. The entices of Lomax and Deer Park entered into an agreement to use the Federal grant monies granted to Lomax to lay water and sewer trunk lines from Underwood road to Luella Street in Deer Park. In turn, Deer Park would supply water and treatment services to the City of Lomax. After one year of service, Deer Park gave Lomax a ninety day notice of termination of services. Lomax did not have the tax base to support an additional bond issue. b) Failed understanding Brought on by a failed understanding between Cities of Deer Park and Lom~ ;rhe City of LaPorte annexed Lomax to provide water and sewer services. This rescued Lomax from a financial quagmire. Lomax did not have the tax base to be self- sufficient as a City. Even after 25 years of growth the tax base still cannot support the level of services provided by the City of LaPorte. The residents of Lomax are being subsidized to this day. e e 2) Negative affects of the Large Lot Proposal. Growth Retardation Due to the street configuration and platted land dimension, the establishment ofa minimum one (1) acre lot size with one hundred (100) foot minimum street frontage would severely retard the growth potential of the Lomax area. Further, the establishment of the one (1) acre would force out lot land owners to develop these lots in two (2) acre lot~ This is due to the street frontage being from 270 feet to 484 feet wid~ g.epending on the location of the lots. It can be readily deciphered that a land owner would be forced to divide the out lots in from two (2) to four (4) lots to meet the one hundred (100) foot street frontage requirements. This puts the landowner in the position to where he is forced to develop not one acre lot size but in (2) two plus acre lot sizes. This further diminishes the marketability of this property. 3) Legal Implication a) This Proposal ofminimum one acre lot size infringes on the Inherent property rights of individuals as guaranteed by the state and Federal constitutions. The landowner should be permitted to - develop property in compliance with ordinances passed and administered by and for the entire city of LaPorte, not for a selected portion of the city. b) The Proposal ofminimum one acre lot size discriminates against the property owner by preventing owners from building houses for parents or offspring, denying productive land uses, or sub dividing IJpd disposal of property upon retirement. It also disenfranchises by not allowing the development of property in the same manner as the rest of LaPorte. e e 4) Environmental and Community Safety A large portion .of undeveloped land in Lomax is plated in out Lots from 270- 484 feet wide to 450 feet deep with several placed back to back. The proposed development of 100 feet wide by 900 feet deep lots would create problems in environmental and community safety as follows a) No or limited access for fire protection of buildings or grass fires. b) Would create large dead spaces behind homes that could not be developed. Not every home owner may want to keep large animals.. c) Unmaintained dead spaces could lead to infestation of varmints and insects. 5) Financial Discrimination LaPorte is an attractive community with good schools, low crime, a variety of community services for the young and old. With the expansion of Underwood and Sens (Bay area Boulevard) roads zoned commercial, the possibility of L Street being 4 laned, more business and prospective home owners will be attracted to this area. The one acre lot size could be discriminatory to future property owners. These owners may not be able to afford or qualify for loans. The cost of taxation from a lot these sizes would be higher vs. that of a half or third acre. e e 6) Economics - tax base The proposal of one acre minimum lots results in the area of the city of LaPorte where there are numerous houses located on SOfeet xl 00 feet lot~ to continue to subsidize the Lomax area. Infracrstructure costs -fire protection; police protection; street lighting, maintenance and upgrade of roads, water and sewer lines and pump stations. There is a significant difference in the tax base of one house on one acre lot vs. 2 houses on half acre lot or 3 houses on third acre lots. 7) Summary The exercise of the property right restrictions in the Lomax Large Lot Proposal is the same as taking land by eminent domain. There are no public use issues in this proposal. The City of LaPorte ordinances currently are sufficient to permit the development of large plots of land in the Lomax area. Land owners in the Lomax area should not be forced to develop their land into large lots. In turn (ALL LAND OWNERS) in the City of LaPorte should be governed by the same ordinances. 8) Recommendations a) Submit the proposal of one acre with I 00 feet width minimum to the Texas Attorney Generalfor a rendering on the rights of property owners. b) Let present policy of City of LaPorte remain in force. I am in FAVOR of granting this request for the following reasons: I teach agriculture in a local school district where I also serve as the FFA advisor. This community is a lot like La Porte. There are several neighborhoods, a few local businesses, a couple of grocery stores, and an area that resembles Lomax where houses are built on acreage and house livestock animals. This is only my second year to teach here and since I still reside in Lomax, I am not completely familiar with the history of the community, but my students are always talking about the growth they have, seen take place just since they were in Kindergarten. Because of the growth that has taken place in , this small city, many of my students will not get the opportunity to raise livestock through FFA as they wanted to do. Why? Many of them used to live in an area where , they were surrounded by land and used to be able to have whatever animals they wanted. Land owners have since built houses, moved into the area and complained about the animals. Because of the change in their community, my students were forced to give up the life that they were familiar with in order to' pacify their new neighbors. Now that they are in high school and a member of our FF A chapter, they would love to get involved in livestock again but they don't have that opportunity because it was taken from them several years ago. I would hate to see the students of our community one day miss out on the opportunities of raising livestock because the land has been taken away from them. I have been blessed to have been raised in Lomax where I was able to raise livestock through the La Porte FF A and 4-H all throughout my school years. My parents used these livestock as tools to help me develop into the person I am today. I have learned compassion for the sick and old. I have learned patience with the young and stubborn. I have learned to take responsibility for the animals that rely on me for their every health need. I have learned the cycle of life and that sometimes the cycle is all too short. I pray that I will be given the opportunity to raise my children in the Lomax that I know today and that they too will have the chance to learn the life lessons that I have learned through livestock. V1A ~~ trkd-:J /r'y f ~jJ~1 ~ ;: e e September 30, 2005 Large Lot Concerns: The Large Lot Proposal has been submitted as a method to "keep Lomax rural," and as a protection against losing the privilege to own and keep large animals. Also, there is the fear that 4-H club activities would be lost or curtailed as a normal residential development proceeds. Currently,large lots are permitted by ordinances in the City of La Porte. There has never been a movement to stop citizens from owning and keeping large animals in the Lomax area. Conversely, this privilege has been supported throughout the existence of Lomax. The proposal to keep Lomax "rural" is nothing more than a euphemism to stop or curtail development in the Lomax area. If the Large Lot proposal is passed into an ordinance, that purpose will be accomplished. Sixteen percent (16%) ofthe City of La Porte's land area that can be developed is located in the Lomax area. This Large Lot proposal would prevent development in eighty percent (80%) of the available land for development in the Lomax area. This can be explained by the fact that present ordinances permit five to one (5 to 1) residential roof top density per acre as opposed to one (1) residential rooftop density per acre in the Large Lot proposal. This eighty percent (80%) reduction in potential development translates into a twelve point eight percent (12.8%) reduction in the potential development of the City of La Porte. If the City of La Porte experienced this kind of a reduction (12.8%) in growth potential, i.e. industrial plant dosings with resulting population and tax base reduction, City officials would be holding special meetings to try to alleviate this kind of reduction to the City. The method used to plot Lomax and the divisions of these plots since the original survey is not conducive to the development of large sub-divisions. Any new ordinance should be written to permit three (3) to four (4) residential rooftops per acre. One example of how to develop the outlots and still maintain the rural atmosphere is the development of Laura Lane located off L Street in Lomax (see Attachment 1). This kind of development would enhance the Lomax tax base. As written, the Large Lot proposal for the Lomax area severely impacts land owners with ten (10) acres or less, and also has a negative impact on the City of La Porte and La Porte Independent School District tax base. An alternative proposal of three (3) to four (4) residential roof tops per acre would be a better solution. Request to City Council: In the event the Large Lot proposal is put into effect, property impacted by the La Porte Thoroughfare Plan, as outlined in Chapter Five of the La Porte Comprehensive Master Development Plan, should be exempted. Public Responses Amount Requested: Budgeted Item: SUMMARY & RECOMMENDATION The City of La Porte Comprehensive plan 2000-2020 establishes Objective 9.2a to create a Large Lot Residential Land Use Designation (District). On August 3, 2004, a town hall meeting was hosted by the Planning and Zoning Commission and City Staff at the Lomax City Hall. All citizens were invited to attend. The Commission heard input by residents interested in creating a large lot, large acreage, and suburban/rural type of development district. Hearing overwhelming support, the Planning and Zoning Commission directed that a Committee be fonned to study issues with creating the District and start a review of zoning regulations of the area. The Large Lot Committee met monthly from September 2004 to March 2005. Meetings were open to the public and residents attended throughout the process. Flyers and other informative letters were sent to property owners within the proposed District. Input throughout the process was considered. On March 5, 2005, the Committee reached a 70% consensus to fonnally recommend regulations, boundaries and a zoning change to create the Large Lot District zoning classification. The Planning and Zoning Commission heard the matter in a workshop on April 21, 2005, and taking the Committee's recommendation, directed Staff to conduct another public meeting to present the recommendations to the public. This hearing was completed on June 9, 2005. On July 21,2005, the Planning and Zoning Commission held a workshop for the proposed Large Lot Zoning District, and discussed citizen's input gathered during the Town Hall Meeting on June 9,2005, at the Lomax Elementary School. The Commission, after a review of citizen input from the June 9th hearing, had reservations about some of the recommendations made by the Large Lot Committee (Citizen Comment Summary enclosed at exhibit 4). The Commission directed staff to assess and make suggestions for the following issues: . Minimum lot width of 100' . 45' height proposed for accessory buildings . No control proposed for outside equipment or exterior storage . Rules for Grazing An imals . Allowances for FF A/4H type of programs As directed by the Planning and Zoning Commission, Staff conducted a workshop for the above considerations at the August 18, 2005, meeting. All input considered, the Large Lot Committee presented the majority's final recommendation together with the City Staff modifications at the September 15,2005, meeting. Mr. Sid Grant, a member of the Large Lot Committee and representing the three (3) dissenting votes, presented the minority opinion opposing the creation of the District. (Minority Report enclosed at exhibit 5). The Planning and Zoning Commission, during their September 15, 2005 meeting, held a public hearing to receive citizen comments regarding creation of a Large Lot District and consider additional regulations for the district, adopt the boundaries, and rezoning from Low-Density Residential (R-l) and Medium Density Residential (R-2) to Large Lot District (LL). ~( , e e As required by ordinance, 854 notices of public hearing were mailed to property owners within and around the District. After careful consideration, the Planning and Zoning Commission forwarded the Large Lot Committee's recommendations to City Council for approval. The final votes for the three motions were as follows: Create the District with additional regulations (5-1 with the dissenting vote in regard to the I acre minimum), Adopt boundaries (6-0), and Rezone from Low-Density Residential & Medium Density Residential to Large Lot District (6-0). The Commission forwards the recommendation to Council with the additional consideration that th~ ~lanning Department and the City Attorney also add a Section to the Ordinance outlining the procedures for a VariancelO~ther mechanism to allow relief from the regulations governing the Large Lot District for consideration during possiblWeliberations by the Zoning Board of Adjustment. (q() Staff will present a detailed briefing on the proposed changes during the Public Hearing portion of the October 24, 2005, Council Meeting. A summary of the final proposed changes from the Committee is attached at exhibit 2. Given that there are several economic issues associated with the proposed change, Council should review the attached Information Paper, dated October 7, 2004, (exhibit 6) that was considered by the Large Lot Committee concerning comparative developmental cost and tax base analysis between a Large Lot Development and a standard 6000 SF, single family detached development currently allowed by the Zoning Ordinance. Per the request by the Planning and Zoning Commission, Staff coordinated with the City Attorney and determined that possible applications to the ZBOA for relief from the provisions governing the propose Large Lot District would fall under Section 106-191, Special Exceptions. In order to answer the Commission's concerns, Staff recommends that the City Council, upon consideration of approval for creating the District and associated regulations, that the following wording, for a special exception be included within the amendments to Chapter 106, Section 106-191, Special Exceptions., (b) (4): (4) To deviate from the minimum lot size or width requirements for property wit/,in the Large Lot District, where the Board finds that all of the following conditions are shown: a. that one or more lots located in the same block as the subject property are not uniform in terms of shape and/or size so t/,at any further subdivision oflhe subject property cannot be in accordance with the regulations governing the District; b. it can be demonstrated that the subdivision will not circumvent the spirit of the District regulations, or particularly, the rural character of tl,e District; and, c. granting the special exception will not be injurious to the value or enjoyment of adjacent properties within the District.
