RESOLUTION NO. 94-04
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE REQUESTING
HARRIS COUNTY COMMISSIONERS COURT TO COLLECT AN ADDITIONAL FEE ON
EVERY ADMISSION TO THE SAM HOUSTON RACE TRACK; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the Texas Racing Act states that "if [a] racetrack is
not located within an incorporated town, the [county commissioners]
court may collect an additional [admission] fee not to exceed
fifteen cents ($0.15) if requested to do so by the governing bodies
of a majority of the incorporated cities and towns in the county."
Tex. Rev. civ. Stat. Ann. art. 17ge 56.17 (Vernon 1993); and
WHEREAS, such additional fee will be allocated based upon the
population within the county of the cities or towns; and
WHEREAS, the Sam Houston Race Track is a licensed racetrack
that is located in Harris County, Texas and lies outside the
incorporated limits of any city or town; and
WHEREAS, the City of La Porte is located, in Harris County,
Texas, and
WHEREAS, the City Council of the City of La Porte desires to
request the Harris County Commissioners Court to collect the
additional fee as allowed by law on its behalf.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE, TEXAS;
section 1: That the City Council of City of La Porte hereby
requests the Commissioners Court of Harris County, Texas, to
collect an additional fee, not to exceed fifteen cents ($0.15), for
admission into the' Sam Houston Race Track pursuant to the Section
6.17 of Texas Racing Act. Tex. Rev. civ. Stat. Ann. art. 17ge S6.17
(Vernon 1993).
section 2: This resolution shall take effect immediately from
and after its passage by the City of La Porte.
PASSED AND APPROVED this 13th day of June, 1994.

Dear Mayor Malone:
A month or so ago, I received requests from a number of area
mayors that Harris County adopt an order placing a fifteen-cent
fee on each admission to Sam Houston Racetrack Park for the
benefit of the incorporated cities and towns of Harris County.
As I told you at that time, the revenue from this fee is not
anticipated to be significant. Forecasts of expected revenue
received from the County Auditor's office show that the amounts
produced from this fee will vary considerably depending on the
population of the city or town.
To move forward on this project, I have placed an item on the
Commissioners Court agenda for Tuesday, August 30, 1994, asking
the Court to adopt an order imposing this fee. The effective
date of this order will be September l, 1994. However, in order.
to reduce administrative costs as much as possible, I have asked
that the order be prepared so that the County will allocate the
fees received every quarter~rather than every 30 days.
