AN ORDINANCE AUTHORIZING AND APPROVING A CONTRACTUAL AGREEMENT
BETWEEN THE CITY OF LA PORTE AND NBG CONSTRUCTORS, INC. TO PROVIDE
AND INSTALL PILINGS, ABUTMENTS, AND OTHER RELATED COMPONENTS FOR
INSTALLATION OF A PREFABRICATED STEEL PEDESTRIAN BRIDGE OVER LITTLE
CEDAR BAYOU; APPROPRIATING $82,066.00 TO FUND SAID AGREEMENT; MAKING
VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes the contract, agreement, or
other undertaking described in the title of this ordinance, in substantially the form as shown in the
document which is attached hereto and incorporated herein by this reference. The Acting City
Manager is hereby authorized to execute such document and all related documents on behalf of the
City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix
the seal of the City to all such documents. The City Council appropriates the sum not to exceed
$25,000.00 for the project identified herein, from the FY 2002-2003 CJP account 015-9892-873, and
$57,066 from the FY 2002-2003 CJP Contingency Fund 015, to fund the City's share of said
Agreement, with reimbursement to Contingency Fund by Harris County Department of Housing and
Economic Development, subject to Commissioner's Court and City Council approval ofan Amended
Agreement with Harris County, also requiring approval by Council at a future Council meeting.
Section 2. The City Council officially finds, determines, recites, and declares that a sufficient
written notice ofthe date, hour, place, and subject of this meeting of the City Council was posted at a
place convenient to the public at the City Hall of the City for the time required by law preceding this
meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this
meeting has been open to the public as required by law at all times during which this ordinance and
the subject matter thereofhas been discussed, considered and formally acted upon. The City Council
further ratifies, approves, and confirms such written notice and the contents and posting thereof

Section 3. This Ordinance shall be effective from and after its passage and approval, and it is
so ordered.

SUMMARY & RECOMMENDATION
As you may recall, the City of La Porte, in conjunction with Harris County Deparbnent of Housing and
Economic Development agreed to place a pedestrian bridge over Little Cedar Bayou at its intersection with S. 3rd
Street right-of-way. The bridge has been purchased, the design of abutments, and specifications for installation
have been accomplished. The City issued a Request for Bids for Construction of the Abutments and Installation
of the Bridge, receiving 4 qualified bids from reputable contractors. The bids were submitted with a Base Bid
and six Alternate Bids for specific portions of the project. Low bid for this project, including the Base Bid and 6
Alternate Bids, was $82,066 submitted by NBG Constructors, Inc. This project came in substantially over the
estimated budget for 2 reasons: I) after soil samples were taken, it was determined that 4 ea. 14" X 30' concrete
pilings must be installed to stabilize the abutments, and 2) the remote site of the bridge installation requires
moving the bridge from Fairmont Parkway on the unimproved 3rd Street right-of-way. These factors resulted in
an increased overall cost of the project of$45,000 over the budgeted amount.
In the current C.I.P. budget, the City Council approved $25,000 for new play equipment at Little Cedar
Bayou Park. You may also recall that Harris County has agreed to fund $100,000 for a new playground to be
installed at Little Cedar Bayou. Thus, the funds originally eannarked for play equipment are available to be used
toward the bridge project, should Council approve. In addition, Harris County representatives, by letter, have
agreed to present an amended budget to Harris County Commissioners requesting an additional $20,000 for the
bridge project. With the City's participation and Harris County's additional funding, there are enough funds to
complete this project.
Upon Council approval, funding for this Agreement will be provided by C.I.P. Account 015-9892~
873-1100 in the amount of $25,000 and the Contingency Fund 015 of the City of La Porte in the amount of
$57,066, with reimbursement by Harris County Department of Housing and Economic Development, subject
to Commissioner's Court and City Council approval of an Amended Agreement with Harris County, also
requiring approval by Council at an upcoming Council meeting. Should Commissioner's Court or City
Council not approve the proposed Amended Agreement, the additional cost for the project would be borne
by the City through the C.I.P. Contingency Fund. The bridge is expected to be completed by April 30th, the
deadline for expenditures for Harris County Department of Housing and Economic Development. Huitt-
Zollars, Inc., the engineering firm for this project, recommends award to NBG Constructors, Inc. as low
bidder meeting specifications.
