ORDINANCE NO. 1285-Q
AN ORDINANCE AMENDING ORDINANCE No. 1285, "AN ORDINANCE IMPLEMENTING
POLICEMAN'S CrvIL SERVICE; ESTABLISHING CLASSIFICATIONS; NUMBER OF AUTHORIZED
POSITIONS IN EACH CLASSIFICATION; ESTABLISHING PAY SCHEDULES"; CONTAINING A
SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
Section 1 of Ordinance 1285 is herby amended and shall
hereafter read as follows, to-wit:
"Section One.
This ordinance is enacted pursuant to the adoption of
the policemans Civil Service Act (V.A.T.S. 1269m), recodified as Texas Local
Government Code Chapter 143, Municipal Civil Service, by the citizens of La
Porte in a referendum election on April 4, 1981. The provisions of said Act
are to the fully implemented upon the effective date of this ordinance."
Section 2.
Section 2 of Ordinance 1285 is herby amended and shall
hereafter read as follows, to-wit:
"Section 2. There are hereby created the following classifications of
employees within the La Porte Police Department which shall be subject to the
provisions of V.T.C.A. Texas Local Government Code, Chapter 143, Municipal
Civil Service, to-wit:
Patrolman, Sergeant, Lieutenant, and Assistant
Chief."
Section 3.
Section 4 is hereby added to Ordinance 1285 and shall
hereafter read as follows, to-wit:
"Section 4.
As authorized by V.T.C.A. Texas Local Government Code,
Chapter 143, Section 143.014, the City Council hereby provides that the Chief
of Police may appoint the person occupying the position in the classification
immediately below that of Chief of Police and that the person appointed to
this position serves at the pleasure of the Chief of Police."
Section 4. Except as hereby specifically amended, Ordinance No. 1285
and amendments thereto shall remain in full force and effect.

Section 5. If any section, sentence, phrase, clause, or any part of any
section, sentence, phrase, or clause, of this Ordinance shall, for any reason,
be held invalid, such invalidity shall not affect the remaining portions of
this Ordinance, it is hereby declared to be the intention of the City of
Council to have passed each section, sentence, phrase, or clause, or part
thereof, irrespective of the fact that any other section, sentence, phrase, or
clause, or part thereof, may be declared invalid.
Section 6.
The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place and subject
of this meeting of the City Council was posted at a place convenient to the
public at the City Hall of the city for the time required by law preceding this
meeting, as required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required by law at
all times during which this ordinance and the subject matter thereof has been
discussed, considered and formally acted upon.
The City Council further
ratifies, approves and confirms such written notice and the contents and
posting thereof.
Section 7. This Ordinance shall take effect and be in force as of June
13, 2005.

SUMMARY & RECOMMENDATION
On the 16th of September, 1981, the City Council adopted Ordinance 1285 implementing
Policeman Civil Service under V.A.T.S. 1269m; which has since been codified into V.A.T.S.
Local Government Code Chapter 143.
This amendment to Ordinance 1285 will confirm the classifications of Civil Service positions
and add Section 4, which had been repealed in Ordinance 1285 J on the 25th of October, 1993, to
comply with the requirements of Chapter 143.014 of the Local Government Code. The new
section 4 will authorize the Chief of Police to appoint the person to occupy the position
immediately below him and that he person appointed serves at the pleasure of the Chief of
Police.

Recommend that the Council approve this update, Ordinance 1285 Q to the Civil Service
Ordinance.
