Section I: That Chapter 82, "Buildings and Building Regulations," Article II,
"Building Code," and Section 82-32 and 82-33 "Amendments," of the Code of Ordinances, La
Porte, Texas, is hereby amended to read as follows:
CHAPTER 82. BUILDINGS AND BUILDING REGULATIONS
ARTICLE IT, BUILDING CODES
Sec. 82-32. Residential Code Amendments.
The residential building code adopted in Section 82-31 shall be amended as follows:
Section RI01.1 is amended to read as follows:
RI01.1 Title. These provisions shall be known as the Residential Code for One-and
Two-Family Dwellings of the City of La Porte, and shall be cited as such and will be
referred to herein as "this code".
Section RIOI.2 "Exception" is hereby deleted:
RI01,2 Scope, Exception is deleted.
Section R103.1 is amended to read as follows:
Rl 03.1 Creation of Enforcement Agency, The Inspection Services Division, of the
City's Planning Department, shall enforce the building and construction codes of the city.
The Chief Building Official shall be known as the code official.
Section RI05.2 is amended to read as follows:
R105.2 Work Exempt from Permit. Deletion of Building Permit Exemptions #1, #2, #3
and #5.
Section Rl12 is hereby deleted:

Sec. 82-33. Building Code Amendments.
The building code adopted in Section 82-31 shall be amended as follows:
Section 101.1 is amended to read as follows:
101.1 Title, These regulations shall be known as the Building Code of the City of La
Porte, hereinafter referred to as "this code",
Section 103.1 is amended to read as follows:
103.1 Creation of Enforcement Agency. The Inspection Services Division, of the City's
Planning Department, shall enforce the building and construction codes of the city. The
Chief Building Official shall be known as the code official.
Section 105.2 is amended to read as follows:

Section 82-103 is hereby deleted:

Division 2, Licenses and Certificates. Subdivisions I thru V (Sections 82-151 thru 82-
259) are deleted in its entirety,
Section 82-282 is amended to read as follows:
82-282 Application and Issuance, Section (a) is amended as shown and Section (f) is
added. Sections (b) and (c) are deleted in their entirety.
a) The application for a permit shall describe the work to be done and shall be made
in writing by a master electrician or his company representative. The permit,
when issued, shall be issued to such applicant to cover such work as described
and detailed, Any changes or additions must be covered by additional permits at
the time changes are made. The application shall be accompanied by such plans,
specifications and schedules as may be necessary to determine whether the
installations, as described, will be in conformity with the requirements of this
article,
f) Before a permit is issued, fees shall be paid to the city in amounts listed in
Appendix A of the City's Code of Ordinances.
Section 82-283 is hereby deleted:
82-283, Display, Sections [82-283(a) and (b)] are deleted in their entirety.
Section 82-284 is amended to read as follows:
82-284 Insurance requirements.
a) No permit shall be issued until the master electrician shall have arranged to carry the
following insurance:
b) Evidence of compliance with the insurance requirements of subsection (a) of this
section shall be considered as having been met when a certificate of insurance has
been filed with and approved by the City, Such policy shall include an
endorsement thereon that the city will be notified at least ten days in advance in
the event of the policy being cancelled.

Section 82-307 is amended to read as follows:
82-307 Entry upon private property. The inspector shall have the right from 7:30 a.m, to
5:30 p.m. (Monday-Friday) or in emergency situations, to enter any building in the
discharge of his official duties or for the purpose of making any inspection, reinspection
or test of the installation of electrical wiring, apparatus, devices, appliances, fixtures and
electrical equipment contained therein, and shall have the authority to cause the turning
off of all electrical currents and to cut or disconnect in cases of emergency any wire
where such electrical currents are dangerous to life and property, or where such wires
may interfere with the work of the fire department. The inspector is hereby empowered
in emergencies to disconnect and to order the discontinuance of electrical service to any
electric wiring, apparatus, device, appliance, fixture or equipment found to be dangerous
to life or property because of its being defective or defectively installed or otherwise not
in conformity with the provisions of this article until such wiring, apparatus, device,
appliance, fixture and equipment and their installation have been made safe as directed by
him/her in conformity with this article,
Section 82-308 is amended to read as follows:
82-308 Installations to be Concealed, When any part of a wiring installation is to be
concealed by the permanent placement of parts of a building, the master electrician to
whom the permit has been issued shall notify the inspector, provided that on such
installation as the concealment of parts of the wiring must, in the discretion of the
inspector, necessarily proceed continuously, the master electrician to whom the permit
has been issued shall give the inspector due notice, and inspection shall be made
periodically during the progress of the work. Where, in the discretion of the inspector, it
is necessary, he shall post notice upon the premises stating that work is approved and
may be covered, or is not approved and may not be covered, until such further inspection
as is necessary has been made, Any person destroying, altering or defacing such notice
without the consent of the inspector, shall be deemed guilty of an offense under this
section, and any work described in the notice shall be stayed pending the further
necessary inspection. Upon the completion of the work which has been authorized by the
issuance of a permit, it shall be the duty of the master electrician to whom the permit has
been issued to immediately notify the inspector, who shall inspect such installations
within three days, exclusive of weekends and holidays, ofthe time such notice is given.
Section 82-312 is hereby deleted:

Section 82-342 is amended to read as follows:
82-342 Wiring within Buildings, Section (a) is amended as shown. Section (b) is deleted
in its entirety.
(a) Nonmetallic sheathed cable shall be used only for residential work and apartment
houses. Conductors in or on all tile and masonry walls of such buildings shall be encased
in rigid conduit, flexible conduit, PVC conduit or electrical metallic tubing, Minimum
size nonmetallic sheathed cable shall be limited to No, 12 A WG.
Section 82-345 is amended to read as follows:
82-345 Feeders. All services, except residential and interior feeders, shall be installed in
rigid metal conduit, electric metallic tubing or approved busways, except that
underground services and feeders may be installed in approved ducts or plastic conduit.
Overhead services or feeders between two buildings less than six feet apart shall be
installed in rigid metal conduit, electric metallic tubing, approved busways or duct.
Where wiring is installed in approved nonmetallic duct or conduit, a continuous ground
wire, sized in accordance with the National Electrical Code, shall be installed within the
duct to ensure continuity of ground, and the entire wiring system must be installed in a
manner approved by the city, Where approved underground duct is used, it shall in no
case be smaller than two inches inside diameter, buried at least 18 inches below the
ground surface. The portion of the service ahead of the meter cabinet shall not be run
through attic spaces. Where conduit fittings are used ahead of meter cabinets, such
fittings shall be of sealable type and shall be plainly visible. Subfeeders in residential
(single and multiple) buildings may be nonmetallic sheathed cable, grounded type.
Section 82-349 is amended to read as follows:
82-349 Suspension of Approval of Materials, The city may, for good and justifiable
reasons, suspend or revoke the approval of certain materials or wiring, Such suspension
or revocation of approval shall not become effective until thirty (30) days after the date of
such notice,

hereby amended to read as follows:

Sec. 82-413. Amendments.
The energy conservation code adopted in Section 82-412 shall be amended as follows:
Section 101.1 is amended to read as follows:
101,1 Title. This code shown be known as the Energy Conservation Code of the City of
La Porte, and shall be cited as such. It is referred to herein as "this code",
Section 104.3 is added and shall read as follows:
1 04.3 Certification. Plan/permit submittals to the City shall include all necessary energy
certification documents. Certification documents shall be completed by an approved
agency or individual.
Section 105.1 is amended to read as follows:
105.1 General. Construction or work for which a permit is required shall be subject to all
required inspections. Inspections shall be performed by a certified and/or licensed party.
Section 105 is amended as follows:
105.2 thru 105.4, - Sections are deleted in their entirety.
Section 6: That Chapter 82, "Buildings and Building Regulations," Article VII,
"Mechanical Code," Section 82-442 "Amendments," of the Code of Ordinances, La Porte,
Texas, is hereby amended to read as follows:

Sec. 82-442. Amendments.
The mechanical code adopted in Section 82-441 shall be amended as follows:
Section 10 1.1 is amended to read as follows:
101,1 Title. These regulations shall be known as the Mechanical Code of the City of La
Porte, hereinafter referred to as "this code",
Section 103.1 is amended to read as follows:
1 03.1 General. The City's Inspection Services Division shall serve as the Department of
Inspection. The Chief Building Official thereof shall be known as the code official.
1 03.2 Appointment. Section is deleted in its entirety.
Section 106.5.3 is amended to read as follows:

Section 7: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 8. Any person, as defined in Section 1,07 (27), Texas Penal Code, who shall
violate any provision of the ordinance, shall be deemed guilty of a misdemeanor and upon
conviction shall be punished by a fine not to exceed TWO THOUSAND DOLLARS
($2,000.00).

Section 9, This Ordinance shall be effective fourteen (14) days after its passage and
approval. The City Secretary shall give notice of the passage of this ordinance by causing
the caption hereof to be published in the official newspaper of the City of La Porte at least
twice within ten (10) days after the passage of this ordinance.
Section 10, The City Council officially finds, determines, recites and declares that a
sufficient written notice of the date, hour, place and subject of this meeting of the City Council is
posted at a place convenient to the public at the City Hall of the city for the time required by law
preceding this meeting, as required by the Chapter 551, Tx. Gov't Code; and that this meeting
has been open to the public as required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally acted upon. The City Council
further ratifies, approves and confirms such written notice and the contents and posting thereof.

Section R112 Board of Appeals is a proposed deletion since the city is developing a
codes appeal board for this purpose.

based on data on our area.

fee does not occur until the review is complete plus typically the plumbing review portion

Section 82-282 Application and Issuance (Permits) Section (a) is a proposed amendment,
Section (f) is a proposed addition and Sections (b) and (c) are proposed deletions.
Proposed amendment allows a master's company representative to apply for a permit.
Proposed addition references fees to be in accordance with Appendix A. Proposed
deletions eliminate requirement for master license number to be shown on the permit and
submittal of an electric public utility service outlet location document along with the
permit submittal.
Section 82-283 Displav is a proposed deletion to eliminate the requirement of posting the
electrical permit on the jobsite.
Section 82-284 Insurance Reauirements Section (a) is a proposed amendment that deletes
the reference to maintenance electrician or his employer having to carry insurance.
Section (b) is a proposed amendment clarifying a certi ficate of insurance provides
confirmation insurance is in effect.

entry hours to show 7:30 a,m, to 5:30 p,m. (Monday-Friday).

the section name from "Installations to be Hidden from View" to "Installations to be
Concealed" .
Section 82-312 Failure to Pay Inspection Fees is a proposed deletion since payment of

eliminates the automatic suspension of the master's license for payment failure.
Section 82-342 Wiring within Buildings Section (a) is a proposed amendment allowing
additional materials (i,e. flexible conduit, PVC conduit) to be used and deleting use of

deletion since it is already addressed in the NEC.
Section 82-345 Feeders is a proposed amendment deleting the specific Table reference
(now in accordance with NEC) for sizing of continuous ground wire and deletes

Section 101.1 Title was identified as the "Fuel Gas Code" for the city.
Section 103.1 General was amended to show the Inspection Services Division shall
enforce the building and construction codes ofthe city and the Chief Building Official
shall be known as the code official.
Section 109 Means of Appeal is a proposed deletion since the city is developing a codes
appeal board for this purpose.

shall be completed by an approved agency or individual.

Section 105 Inspections is a proposed amendment that deletes the Sections 105.2 thru

coordinating the required inspections.

SUMMARY & RECOMMENDATION
At the March 8, 2004 meeting, new construction codes were adopted, The passage of Ordinance #96-2079-B
provided a ninety (90) day implementation period, Regardless of which codes were selected, most ifnot all of these
changes would be necessary to confonn with current local amendments or state statutes, During this period staff
was able to review the various code books, consider possible conflicts, incorporate local amendments and order the
code books.
Our review was done with the understanding that changes were to be minimal since a subsequent review by the
proposed Building Codes Appeal Board will occur in the near future, Small amendments have been included to
maintain some of the local amendments currently in effect. The majority of the proposed changes deal with the
deletion of city electrical licensing regulations since licensing of electricians are now handled by the State,
The passage of this ordinance will allow staff an opportunity to provide contractors with a copy of the changes prior
to the ordinance's effective date of June 7, 2004,
