HomeMy WebLinkAboutO-2004-2753 e tt ORDINANCE NO. 04- {) 11 5-3 AN ORDINANCE AUTHORIZING AND APPROVING A LANDSCAPE cosr SHARING AGREEMENT BETWEEN THE CITY OF LA PORTE AND THE TEXAS DEPARTMENT OF TRANSPORTAnON FOR THREE MONUMENT SIGNAGE AND LANDSCAPE PROJECTS TO BE LOCATED ON SH146 AND SH225 RESPEcrIVELY; MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEmNGS LAW; PROVIDING AN EFFEcrIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by this reference. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place, and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the publiC as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves, and confirms such written notice and the contents and posting thereof. e e Section 3. As a separate activity, staff has negotiated a Landscape Cost Sharing Agreement with TxDOT to reimburse the City for plant materials for the signage project, that are to be planted on State rights-of-way at three locations; SH225 @ Underwood, SH225 @ SH146, and SH146 just north of Shoreacres Boulevard. The state will reimburse the City up to $80,000 for plant materials at the three sites and the City will pay for installation of the plant material. Depending on the bids for the entire monument signage project, there may be a need to temporarily use contingency funds to cover the costs of these materials until a reimbursement is made by the state. Under terms of the agreement, the City will pay for plant material and installation and, upon inspection and approval by the state, the state will reimburse for the actual cost of the plant material for the three sites. As with the other two sites (Fairmont Parkway @ Luella, and Spencer Highway @ Luella) the City will be responsible for utilities and maintenance of the completed project. Approval of the agreement will result in substantial savings to the City because the state will share the cost of materials. Staff recommends approval of the agreement.
