HomeMy WebLinkAboutO-2004-2751 . e ORDINANCE NO. 2004-J/7~1 AN ORDINANCE APPROVING AND AUTHORIZING A CONTRACT BETWEEN THE CITY OF LA PORTE AND METRO CITY CONSTRUCTION, LLP, FOR REPLACEMENT OF THE RUSTIC GATE AND K STREET WATERLINES, APPROPRIATING $148,824.11 PLUS A CONTINGENCY OF $ 7 , 441. 00, TO FUND SAID CONTRACT, XAJCING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, a copy of which is on file in the office of the City Secretary. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. City Council appropriates the sum of $148,824.11 plus a contingency of $7,441.00, from Fund 003 to fund said contract. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. e e Section 3. During the design of the Project, the relocation of the LP A W A line for the upcoming Fairmont Parkway Railroad Grade Separation Project was determined to be unnecessary by the County, and was removed from the project before bids were solicited. The Project, designed by Claunch & Miller, Inc., received bids on June 16,2004, with four (4) bids received, Low bid was submitted by Metro City Construction, LLP in the amount of $148,824.11. Completion date is 90 days after receipt of notice to proceed. A total of $309,693.00 was budgeted for construction of this Project. References were provided, and checked by the Engineer. The Engineer recommends award to Metro City Construction, LLP for the bid amount. Action Required by Council: Approve an Ordinance authorizing the City Manager to execute a contract with Metro City Construction, LLP in the amount of $148,824.11 for the construction of the Project.
