A 1/1I ~ pe 11 l"o{ AN ORDINANCE RENAMING CANADA ROAD TO EAST BOULEVARD; CONNECTING WITH EAST BOULEVARD IN DEER PARK; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPENS MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby renames Canada Road to East Boulevard throughout the City limits of the City of La Porte. The Public Works Department is directed to prepare and install appropriate signage reflecting said name change. Section 2. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this Ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, it is hereby declared to be the intention of the City of Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase, or clause, or part thereof, may be declared invalid. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Texas Open Meetings Act, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof . e has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. During May 20, 2004, the Planning and Zoning Commission held a public hearing to consider the name change of Canada Road to East Boulevard. By a 6-0 vote, the Commission forwarded recommendation that City Council approves the proposed renaming of Canada Road to East Boulevard. Once the name change is approved, the affected properties along Canada Road would be re- addressed accordingly and would correspond to the addressing sequence in Deer Park. Utility Companies, property owners, neighboring cities and the post office have been notified of the proposed change. At the June 14, 2004 meeting, City Council held a public hearing and tabled the item until further information to be gathered by the City Attorney's office. The residents of Canada Road spoke against the name change at the meeting. Action Reauired bv Council: 1. Exhibits: Ordinance Aerial Map Area Map Mail Out Responses SUMMARY & RECOMMENDATION During recent meetings, City Council asked the Planning and Zoning Commission for input regarding a draft resolution renaming of Canada Road to East Boulevard. This request was made in conjunction with the proposed widening of Canada Road and the alignment with East Boulevard in the City of Deer Park. The name change would unify the entire road through La Porte and on into Pasadena. Should the name change be approved, the affected properties (ten tracts) along Canada Road would be re-addressed accordingly and would correspond to the addressing sequence in Deer Park and Pasadena. Utility Companies, property owners, neighboring cities and the Post Office have been notified of the proposed change. The Post Office stated verbally this is no problem. For one year, they will keep dual address. A courtesy mail out was made to the owners of above properties affected by the proposed name change. Two responses were received, both against the proposed name change. There were two speakers at the meeting. One voiced against the name change due to its historical background. While, the pastor of a church at Carlow Street voiced in favor of the move as it will unify the street and it will be much easier for the visitors. On May 20, 2004, the Commission held a public hearing considering this name change of Canada Road to East Boulevard. By a 6-0 vote, the Commission forwards a recommendation that City Council approves the proposed renaming of Canada Road to East Boulevard. Action Reauired bv Council: 1. Hold public hearing. 2.
