AN ORDINANCE APPROVING AND AUTHORIZING A RENEWAL AND EXTENSION OF THE WATER SERVICE AGREEMENT BETWEEN THE CITY OF LA PORTE AND DSI TRANSPORT, INC., FOR A TERM COMMENCING UPON THE EFFECTIVE DATE OF PASSAGE AND APPROVAL OF THIS ORDINANCE AND EXPIRING ON DECEMBER 31, 2007; FINDING COMPLAINCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCn. OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by this reference. The Mayor is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been opened to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof Section 3. and it is so ordered. Water Service Agreement Extension Budgeted Item: _YES ..x....NO SUMMARY & RECOMMENDATION Summary: The City is in the process of reviewing current utility service agreements with its industrial district customers to detennine wbich agreements bave expired or are due to expire within the coming months. DSI Transports, Inc. has an Industrial District Agreement (IDA) with the City that is valid through December 31,2007. However, the term of its current Water Service Agreement (WSA) with the City expires on June 10, 2004. It is the City's desire to create concurrent tenns for both of the agreements. In order to acbieve this, renewal of Lubrizol's WSA will be considered at the time of its IDA renewal in Janwuy of 2008. It is anticipated that each agreement will share the same seven (7) year term depending on the City's ability to continue to supply water. Staff has contacted DSI Transports, Inc. regarding extending the current term of its WSA. The company is agreeable to the extension of its current WSA through December 31, 2007. Recommendation: Staff recommends approval of an ordinance to extend the current term of DSI Transport, Inc. 's Water Service Agreement through December 31, 2007. Action ReQuired of Council: Consider approval of an ordinance authorizing the City Manager to enter into an agreement with DSI Transport, Inc. to extend the tenns of its current Water Service Agreement through December 31, 2007.
