ORDINANCE NO. 2004- J. '11'0
AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND CENTERPOINT ENERGY, TO PROVIDE RELOCATION OF
OVERHEAD ELECTRICAL FACILITIES FOR THE CANADA ROAD PROJECT,
APPROPRIATING THE SO NOT TO EXCEED $56,500.00, TO FUND SAID
CONTRACT, MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, a copy of which is on file in the office
of the City Secretary. The City Manager is hereby authorized to
execute such document and all related documents on behalf of the
City of La Porte.
The City Secretary is hereby authorized to
attest to all such signatures and to affix the seal of the City to
all such documents.
City Council appropriates the sum not to
exceed $56,500.00 from City of La Porte Project No. GEN 902, to
fund said contract.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

Mr. Gillett:
Per your request, CenterPoint Energy has reviewed and is providing an estimate of cost
for the relocation of its overhead electrical facilities. In CenterPoint Energy's review it
was found that the existing overhead facilities are in an acquired easement. The area in
question is from Fainnont Pkwy. to Carlow Ln. adjacent to the west side of Canada Rd.
The estimated cost the city is responsible for is $56,500.00.
This cost covers all materials, labor, and overheads to relocate our main feeder circuit.
This amount will be toward the cost of construction, which is not subject to refund.
If this is in accordance with your request, please sign and return this letter to me with the
payment in the above stated amount. CenterPoint Energy must receive full payment
before the job can be placed on our construction schedule.

SUMMARY & RECOMMENDATION
The upcoming construction of Canada Road and Utilities will require relocation of overhead electrical
facilities to accommodate the widened right of way from Carlow to Fairmont Parkway. CenterPoint
Energy has estimated the cost at $56,500.00.
The City has recently acquired all rights of way in the southern portion of the Project, and has identified
funding sources, including participation by Harris County. Although Harris County has agreed, in
principal, to participate in the Project, there is no agreement at this time. The Agreement requires that the
City pay the full amount before work can begin.
Action Required bv Council: Approve ordinance authorizing the City Manager to execute a Letter
Agreement with CenterPoint Energy in the amount of $56,500.00 for the relocation of overhead electrical
facilities on Canada Road.
