ORDINANCE NO. 2004-~qf
AN ORDINANCE AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED TO
EMERY FARKAS, INDIVIDUALLY AND AS TRUSTEE, OF A PORTION OF LOTS 17
THROUGH 24, BOTH INCLUSIVE, BLOCK 120, TOWN OF LA PORTE, BARRIS
COUNTY, TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. A Tax Resale Deed to the City of La Porte, dated
October 3, 2001, and recorded under Harris County Clerk's File No.
V405564, contains an erroneous legal description as to the real
property described on the attached Quit Claim Deed, which was
included in such Tax Resale Deed by mistake.
Section 2. The City Manager is authorized to execute, and the
City Secretary is authorized to attest the execution, of a Quit
Claim Deed to Emery Farkas, Individually and as Trustee, the true
record owner of the property described on said Quit Claim Deed,
which is attached hereto as Exhibit "A", incorporated by reference
herein, and made a part hereof for all purposes.
Section 3. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon.
The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

Section 4. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

SUMMARY & RECOMMENDATION
A Tax Resale Deed to the City of La Porte (dated October 3, 2001 and recorded under Harris
County Clerk's Pile No. V405564) contains an erroneous legal description that includes the
property owned by Mr. Emery Parkas and described on the attached Quit Claim Deed (See Exhibit
2).
In order to remedy this mistake, the City Council may authorize the City Manager to execute the
Quit Claim Deed to Mr. Emery Parkas, Individually and as Trustee, the true record owner of the
property in question.
Recommendation:
Authorize the City Manager to execute a Quit Claim Deed to Mr. Emery Parkas to the subject
property for which he is the owner of record.
Action Required of Council:
Consider approval of an ordinance authorizing the City Manager to execute the attached Quit
Claim Deed to Mr. Emery Parkas for a tract of land out of Lots 17 - 24, Block 120, Town of La
Porte being further described in Exhibit "~' to said deed.
