ORDINANCE NO. l168-A AN ORDINANCE AMENDING ORDINANCE NO. 1168, AN ORDINANCE REGULATING THE DRILLING OF WATER WELLS WITHIN THE CITY~ REGULATING THE USE AND SALE OF WATER WITHIN THE CITY~ PROVIDING EXCEPTIONS~ PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00): CONTAINING A SEVERABILITY CLAUSE ~ FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section L From and after the effective date hereof, it shall be unlawful for any person to drill a water well to provide water for human consumption, or for residential or commercial purposes within the City 9f La Porte. Section 2. From and after the effective date hereof, it shall be unlawful for any person to use, sell, barter, give away or offer for sale, offer to barter, or offer to give away, for human consumption, or for' residential or commercial purposes, water originating from any source other than the Water Department of the City of La Porte, to any other person within the City of La Porte, except such City. Section 3. The provisions of this Ordinance shall not be appJ.icable to the sale of distilled water, or other bottled water approved for human consumption, by the Texas Department 01; Health. ~n addition, the provisions of this Ordinance shall not be appli- cable to the collection of rain water for use to water vegetation. Section 4. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. Section 5. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reason, be held invalid, such invalidity . . Ordinance No. IlG8-A, Page 2. shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Commission to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sen- tence, phrase or clause, or part thereof, may be declared invalid. Section 6. Any person, as defined in S~ction 1.07(27), Texas Penal Code, who shall violate any provision of this ordi- nance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Each day any violation of this ordinance shall con- tinue shall constitute a separate violation. Section 7. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the pUblic as required by law at all times during which this ordinance and the subject matt-er' thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. PASSED AND APPROVED this the 18th day of April, 1984. Cummings, Supervising Engineer RE: ACME Trucking Attached are the cost estimates you requested. I ran the cost estimates f~ur basic ways: 1) The most direct route and city installed. This would require the purchase of easements and allow for no reimbursement availability. 2) The most direct route installed by a contractor which would require the purchase of easements and allow for no reimbursement availability. 3) Going down the existing 60 V.E. which would not require easements to be purchased but would be a longer run, would allow for three other businesses to tie onto the lines and allow for reimbursement. Cost estimate #3 is based on the City installing the lines. 4) Going down the existing 60 V.E. which would not require easements to be purchased but would be a longer run, would allow for three other businesses to tie onto the lines and allow for reimbursement. Cost estimate #4 is based on a private contractor installing everything. All of these were scenarios were run under the assumption that gravity flow could be achieved. They were subsequently run using a force main and lift station. When boring under a railroad bed, the railroad requires that a dry bore be used. Dry boring is always much more expensive than wet boring and will require the use of casing at least 6-inches in diameter larger than the service pipe. Taking the utilities the long way would be the best scenario even if it would be the most expensive as that would allow at least three other businesses to tie on. Given that the City of La Porte has an ordinance against the use of wells, it is recommended that at least the water line should be taken the long way. Given the great importance on arresting subsidence in the greater Houston area, there is no scenario in which I could recommend the allowance of a water well. K:\laportefairmontsignals AGREEMENT THE ST ATE OF TEXAS ~ ~ COUNTY OF HARRIS ~ This Agreement is made and entered into by and between Harris County, a body corporate and politic under the laws of the State of Texas, hereinafter called "County," and the City of La Porte, a body corporate and politic under the laws of the State of Texas, hereinafter called "City"; RECITALS: 1. It is to the mutual benefit of County and City to construct left turn lanes and traffic signal modifications at the intersections of Fairmont Parkway and Brookwood Drive, Fairmont Parkway and Farrington Boulevard, and Fairmont Parkway and Wilmont Drive,' hereinafter called the "Project." 2. The County is willing to contribute up to $200,500 toward 50% of all costs of the Project and to administer the design and construction of the Project, provided that City will contribute 50% of all costs of the Project up to $200,500. All costs attributable to the cost of the Project, including costs of engineering, construction and construction support services will sometimes be called the "Project Costs." 3. No additional right-of-way will be required for the Project. 'i =a. NOW, THEREFORE, for and in consideration of the mutual covenants, agreements and benefits to the parties herein named, it is agreed as follows: TERMS: 1. Within ninety (90) days after execution of this Agreement, the County shall endeavor to prepare, or cause to be prepared, drawings and specifications for the Project and deliver copies of same to the City for written approval by the Mayor of the City, or his designee. 2. Within sixty (60) days after approval of drawings and specifications for the Project in accordance with Section 1, the County will advertise for and receive bids for the construction of the Project in accordance with the approved drawings and specifications in the manner similar to that of other like County projects. 3 Upon receipt and tabulation of the bids for the Project, County will determine the lowest responsible bidder for the construction of the Project. The County Engineer shall then estimate the projected Project Costs. 4. In the event the estimated Project Costs are equal to or less than the sum of $401,000, the County Engineer shall notify the City of the estimated Project Costs. The City shall transmit to the
