ORDINANCE NO. 1783-B
AN ORDINANCE AMENDING CHAPTER 50, npARKS AND RECREATIONn, ARTICLE
VI, nSYLVAN BEACHn, OF THE CODE OF ORDINANCES OF THE CITY OF LA
PORTE, AND APPENDIX A THERETO, ESTABLISHING A RENTAL FEE POLICY AND
FEE SCHEDULE FOR SYLVAN BEACH PAVILION, CONTAINING A SEVERABILITY
CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Appendix A -- Fees, Article VI, Sylvan Beach,
Division 2. Sylvan Beach Pavilion, subparagraph (b), shall be
amended, and shall hereafter read as follows:
"(b) Nonprofit organization on Tuesdays
or Wednesdays (not New Year's Eve)
or on Sunday morning from
5:00 a.m. to 9:00 a.m., when
the previous Saturday night is
not rented. . . . . . . . . . . . . . . . . , . . . . , 300.00

Section 2. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this Ordinance
shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, and it is hereby
declared to be the intention of this City Council to have passed
each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase,
or clause, or part thereof, may be declared invalid.
Section 3. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required

by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon.
The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 4. This Ordinance shall be in effect from and after
its passage and approval.

SUMMARY & RECOMMENDATION
When the City of La Porte assumed operations of Sylvan Beach Pavilion in 1986, it adopted the
existing Harris County rate schedule for rental rates. On September 23, 1991 the City increased
rental rates for Sylvan Beach Pavilion, and again on October 23, 2000 Council approved rate
changes for rental of the Pavilion. One component added to the October 2000 rental rate, was
expanding rental for non-profit organizations at a reduced rate, from Wednesdays Only, to
Tuesday as well. This proposal was to allow non-profit organizations to rent the Pavilion for a
reduced rate on days when the Pavilion was not very busy, and to allow these special events for
worthy causes. We are asking to expand the non-profit accessibility to the Pavilion on Sunday
mornings as well, when there is not a conflicting Saturday night event scheduled.
Staff recommends that the proposed change in the existing rate structure be adopted as
outlined in the accompanying Ordinance.
Action Reauired bv Council:
Consider approval of an Ordinance amendment amending the rental fee policy and
schedule for Sylvan Beach Pavilion to include Sunday morning rentals for non-profit
organizations, if there is no Saturday rental in place.
